AUTHORIZING A REQUEST FOR A PROJECT ON
INTEGRATED RECREOTOURISM ON THE LOTS 5A AND
6A OF RANGE 1 THOSE LOTS ARE ADJACENT TO
HIGHWAY 327

CONSIDÉRANT la demande d’autorisation d’un projet
particulier visant à autoriser et à définir les
conditions
d’autorisation
pour
un
projet
intégré
récréotouristique avec de l’hébergement atypique, soit
des Éco-dômes, des tipis et une yourte, des activités
d’interprétation et de santé, situés sur les lots 5A et
6A du rang 1 ;
WHEREAS
the
application
for
authorization
of
a
particular project to authorize and define the permit
conditions for an integrated project of recreational
tourism with atypical accommodation as Eco-domes, tipis
and
yurts,
interpretive
and
health
orientated
activities, located on the lots and 5A and 6A range 1;
CONSIDÉRANT qu’il s’agit d’un projet admissible en
vertu
du
Règlement
229-2014
sur
les
projets
particuliers de construction, de modifications ou
d’occupation d’un immeuble (PPCMOI) ;
WHEREAS that it is an eligible project under By-law
229-2014
on
specific
construction,
alteration
or
occupancy proposals of an immovable (PPCMOI);
CONSIDÉRANT que la demande du projet a fait l’objet
d’une étude par le comité consultatif d’urbanisme de la
municipalité du Canton de Harrington lors de sa réunion
du 28 novembre 2014 et ce, en fonction des critères
d’évaluation applicables du Règlement 229-2014 ;
WHEREAS the project application was the subject of a
study by the Planning Advisory Committee of the
Municipality of the Township of Harrington at its
meeting of 28 November 2014 and that, according to the
applicable evaluation criteria of the By-law 229-2014;
CONSIDERANT la recommandation favorable

CONSIDÉRANT QUE le Conseil a émis des conditions sous
lesquelles le projet peut être autorisé et que cellesci n’ont pas été énoncées dans la résolution # 2015-03R029, tel que prescrit dans la loi ;
WHEREAS the council has issued conditions under which
the project can be authorize that were not mentioned in
the resolution # 2015-03-R029, as prescribed by law;

Condition 1 : qu'une lettre de crédit au montant
de 20 000$ soit déposée à la municipalité; celleci servira en cas de non-complétion du projet à
remettre le terrain à l’état initial, à la
démolition des bâtiments ou tous autres travaux
jugés nécessaires;
Condition 2 : les travaux doivent être terminés au
plus tard dans les vingt-quatre (24) mois à partir
de
la
date
de
l’approbation
par
la
MRC
d’Argenteuil;
Condition 3 : un maximum de deux (2) tipis, une
yourte, cinq (5) éco-dômes tels que décrits dans
le plan daté du 5 novembre 2014 et accepté par le
Conseil;
Condition 4 : une limite
personnes est imposée;

To abrogate the second draft resolution # 2015-03-R029;
To adopt this second draft resolution and to authorize
the project under the conditions below:
Condition 1: a letter of credit in the amount of $
20,000 to be deposited to the municipality; it
will be used for non-completion of the project to
restore the land to its original state, demolition
of buildings or other work deemed necessary;
Condition 2: the work must be completed no later
than twenty-four (24) months from the date of
approval by the MRC d'Argenteuil;
Condition 3: a maximum of two (2) tipis, yurts,
five (5) eco-domes as described in the plan dated
November 5, 2014 and accepted by the Council;
Condition 4: accommodation

concerned, under penalty of nullity of this resolution.

la lecture dudit règlement, une copie ayant été remise
aux conseillers absents dans les délais impartis.

haaving read the present by-law and waive the right for
its reading, a copy has been given to the councillors
absent in the allotted delays.
CONSIDÉRANT QUE la Municipalité a le pouvoir de
modifier ses règlements relatifs aux constructions et
aux permis et certificats;
WHEREAS the Municipality has the power to amend its bylaws
regarding
construction
and
permits
and
certificates;
CONSIDÉRANT QU’il y a lieu de modifier ces règlements
afin d’apporter les modifications aux articles qui
réfèrent
au
Règlement
sur
le
captage
des
eaux
souterraines (c. Q-2, r.6) qui a été remplacé par le
Règlement
sur
le
prélèvement
des
eaux
et
leur
protection (c. Q-2, r. 35.2) et de préciser les
documents et informations à fournir dans le cadre de
l’application dudit règlement;
WHEREAS it is appropriate to amend these by-laws in
order to make changes to the articles that refer to the
By-law on groundwater catchment (c. Q-2, r.6) which was
replaced by the By-law on sampling and water protection
(c Q-2, r 35.2..) and to specify the documents and
disclosures in the context of the application of this
by-law;
CONSIDÉRANT QU’un avis de motion et un projet de
règlement ont été adoptés lors de la séance du 13 avril
2015;
WHEREAS the notice of motion and the draft by-law have
been adopted at the regular meeting on Avril 13, 2015;

signé par un professionnel, montrant :
• l’emplacement de l’installation de prélèvement des
eaux projetée;
• les puits existants;
▪ les bâtiments desservis;
• les limites de propriété;
• la présence de cours d’eau, d’une zone inondable
et de la cote 0-20 ans et 20-100 ans si
applicable;
d) Dans le cas d’un prélèvement des eaux souterraines,
en plus des renseignements énumérés aux paragraphes a),
b) et c), les renseignements suivants :
• la localisation de tout système étanche et non
étanche de traitement des eaux usées et la distance
entre l’installation de prélèvement des eaux projetée
et un tel système situé dans un rayon de 30 m;
• la localisation des éléments suivants : une aire de
compostage, une cour d’exercice, une installation
d’élevage, un ouvrage de stockage des déjections
animales, une parcelle en culture, un pâturage, un
terrain où un cimetière est exploité et la distance
entre l’installation de prélèvement des eaux et ces
éléments situés dans un rayon de 30 m;
e) Dans le cas d’un système de géothermie, en plus des
renseignements énumérés aux paragraphes a), b), c) et
d), la description détaillée des équipements et du
fonctionnement du système projeté;
f) Toute autre information requise en
Règlement
sur

prélèvement
des
eaux
protection (c. Q-2, r. 35.2);

SAMPLING INSTALLATION
In addition to the plans and documents required under
Article 3.2.1, the following documents, information or
plans must be provided by the applicant in the case of
a building application or for the modification of a
water sampling facility or the application for building
or modifying of a geothermal system:
a) The projected capacity;
b) a sketch or building plan showing details of the
proposed facility: type of sample, the materials used,
a typical cut, the documents required in connection
with work on the shore and shoreline , if applicable;
c) A location plan, to scale, prepared and signed by a
professional, showing:
• the location of the projected water sampling
facility;
• existing wells;
• serviced buildings;
• property lines;
• the presence of rivers, watercourses, of the 0-20
years
and
20-100
years
flooding
zones;
if
applicable;
d) In the case of a sampling of groundwater in addition
to the information listed in paragraphs a), b) and c),
the following information:
• the location of all leak tight and not tight system
of wastewater treatment and the distance between
the projected water sampling system and such a
system within a radius of 30 m;
• the location of the following: a composting area, a
yard, a livestock facility, a storage of manure, a
cultivated parcel, a pasture, land where a cemetery
is operated and the distance between the water
sampling system and elements within a radius of 30
m;
e) In the case of a geothermal system in addition to
the information listed in paragraphs a), b), c) and d),
the detailed description of the equipment and operation
of the proposed system;
f) Any other information required by the By-law on the
sampling and water protection (c. Q-2, r. 35.2).;
g) A report as required under Articles 21 and 30 of the
By-law on the sampling and water protection (c. Q-2, r.
35.2).

A notice of motion is given by Councillor Brian Hudgin
to the effect that will be presented for adoption at a
subsequent council sitting a By-law concerning site
planning and architectural integration program (SPAIP)
specifically in the area of the Harrington Valley and
mountain peaks within the territory of the municipality
of the Township of Harrington.
This By-law will aim to require the issuance of:
a) Construction permit authorising a new construction,
enlargement of a main building, renovations to the
exterior sidings of a main building (whatever its size)
or accessory building over 20m2, including openings and
roof construction or replacement of a fence or
landscaping;
b) Subdivision permit;
c) Certificates of authorization on the signage or the
cutting of trees;
Within those areas of the territory of the municipality
of the Township of Harrington, considering the prior
approval of plans relating to the site and the
architecture
of
the
construction
or
the
land
development including the work connected to it.
