A MESSAGE FROM THE PRESIDENT
Among our other successes, we must also mention the third
edition of the annual “Fenêtre sur le marché” conference held
in Montréal in January 2014, and the fact that a second – and
remarkably successful – conference was also held in Québec City.
This event is now recognized as one of the real estate industry’s
must-see conferences.
NORMAND RACINE
In the history of the Québec Federation of Real Estate Boards
(QFREB), 2013 will be remembered as the year that a new
governance structure was implemented. This major change
came after a provincial consultation in 2012, which concluded
that it was necessary to review the QFREB’s structure and governance, for the future of the QFREB. The many consultations
held in 2013 and the extraordinary commitment of the governance
task force led to the creation, on October 9, of a renewed
Federation. The Board of Governors and the Board of Directors
that were in place were dissolved, and a new Board of
Directors was established. I am particularly proud and pleased
with this accomplishment that will allow the QFREB to reach its
objectives as a leader in the real estate industry.
Subsequently, we made modifications to the terms of reference,
to the composition of committees and to the Federation’s code of
ethics and by-laws.
The year 2013 will also be remembered for the historic agreement
between the QFREB, the province’s 12 real estate boards and
the Organisme d’autoréglementation du courtage immobilier du
Québec (OACIQ) in order to create a joint advertising campaign
that promotes real estate brokers. The first ads ran in early 2014. It
is important to recognize the task force that successfully managed
this project.
In addition, there was a letter sent in June by Québec’s real
estate boards and the QFREB to The Canadian Real Estate Association (CREA), demanding that they take into account the particular
features that characterize the real estate profession in Québec.
Thanks to the diligence of certain real estate boards, gains were
achieved and some of the real estate boards that withdrew their
CREA membership were reinstated. In March 2014, the QFREB
once again became a member of CREA.
The DuProprio dossier is another issue that will hold our attention
in 2014, as it did in 2013. The QFREB intends to maintain a close
eye on this dossier following its complaint to the Competition
Bureau in 2012, for commercial practices that were considered
misleading.
The QFREB committees kept busy in 2013. Among their actions,
I would like to highlight the work of the affiliated clients committee for developing a policy to better define the rules applicable
to affiliated clients. I also want to highlight the work done since
the fall by the human resources and ethics committee regarding
the recruitment of a new chief executive officer. We have every
reason to believe that we will make a positive announcement in
this regard in 2014.
When reading this annual report, you will notice that a considerable amount of work was accomplished in 2013, and will
continue in 2014, as a result of the combined efforts of QFREB
volunteers and employees. Together, they constitute the driving
force that ensures the vitality and relevance of our organization.

MARKET ANALYSIS
GOVERNMENT RELATIONS
In January 2013, the Québec Federation of Real Estate Boards
(QFREB) held its second annual provincial conference, “Fenêtre
sur le marché”, which focused on Québec’s residential real estate
market perspectives among other topics. Close to 450 members
and industry stakeholders in Montréal took part in this event. The
conference was also attended by approximately 100 people in
Québec City, where it was held for the first time.
In 2013, the Government Relations Committee and its political
liaison team stepped up its efforts to defend the interests of
Québec’s real estate brokers among the different government and
institutional agencies.
The Market Analysis Department produces various information
and economic newsletters. In 2013, among other studies, it published an analysis of the impact of the most recent tightening of
mortgage insurance rules. In fact, there was a significant increase
in the number of subscribers to the Department’s main publications, such as the Barometer, the Window on the Market newsletter and its economic news.
The Department delivered more than twenty presentations to
real estate boards and agencies in 2013. It also responded to a
growing number of requests for statistics from brokers and from
various industry stakeholders.
Finally, the QFREB strengthened its visibility in the media, as
evidenced by the many reports, articles, and radio and TV news
stories that were broadcast across the province. Again this year,
the QFREB is increasingly becoming the reference point for information about Québec’s residential real estate market.
At the provincial level, the QFREB continued promoting measures
that support first-time buyers, the driving force of the real estate
market. The QFREB recommends an easing of transfer taxes for
first-time buyers, as well as a review of this tax scale. More specifically, we worked with the Finance Minister’s Office to prevent a
possible tightening of mortgage loan conditions. The participation of Québec’s finance minister in the Fenêtre sur le marché
conference in January 2014 demonstrates the QFREB’s credibility
and confirms its position as a leader in the real estate industry.
The QFREB also contributed to the inclusion of septic systems
in the Rénoclimat program. This program will allow for the
upgrading of many septic systems, thereby increasing the value
of these properties and facilitating their possible transactions in
the future.
The QFREB maintained and expanded several partnerships in
2013, notably with the Corporation des propriétaires immobiliers
du Québec (CORPIQ) and the Association provinciale des constructeurs d’habitations du Québec (APCHQ). The 2014 action
plan provides for a close collaboration with our partners on
housing sector demands, with the goal of promoting the implementation of a true housing policy in Québec.
The QFREB was also very active in terms of training and held six
Condo Training Program sessions in 2013. To date, more than
225 brokers have taken this training, which provides 28 continuing education units by the Organisme d’autoréglementation du
courtage immobilier du Québec (OACIQ).

PROVINCIAL COLLABORATION COMMITTEE
The Legal Affairs Department continued its mission of providing
legal protection to QFREB’s members, meaning real estate boards,
agencies and brokers.
The Provincial Collaboration Committee met twice in 2013.
This Committee is composed of 16 real estate brokers from all
regions of Québec, working to promote brokers’ professionalism
and facilitate their collaboration work.
To this end, the Department conducted more than 40 investigations and studies on questionable business models in order
to identify illegal brokerage practices. The Department drafted
16 formal notices and warning letters, and filed approximately ten
complaints with the OACIQ in cases of obvious violations. It ensured the protection of industry trademarks and copyright, which
are the intellectual property of the organization and its members.
One of the main functions of the Legal Affairs Department is to
provide legal support to the QFREB and the province’s real estate
boards. It was therefore involved in major issues such as the
dispute between the OACIQ and DuProprio aimed at declaring the
latter’s activities as real estate brokerage acts, and the complaint
filed with the Competition Bureau against DuProprio regarding
commercial practices that are considered misleading.
As trustee of the real estate brokers’ provincial Centris® database,
the Department ensured the protection of the database and of
members’ real estate listings. It was also responsible for the
regularization of 15 situations of illegality, the signing of 12 agreements and contracts aimed at protecting the database, and the
drafting of policies on real estate data.
Finally, the Legal Affairs Department played an active role in
establishing the QFREB’s new governance and the consolidation
of QFREB by-laws.
As such, new policies for publishing information were recommended by the Provincial Collaboration Committee and adopted
by the QFREB Board of Directors. It was agreed that the uploading
of the notice of disclosure be mandatory when circumstances
require it. This addition will greatly facilitate collaboration between
brokers. Following the QFREB’s intervention, it was also agreed
that the obligation to brokerload the “Repossession” field – which
was removed in January 2013 – be reinstated for mortgage repossessions.
Other recommendations put forward in 2013 by the Provincial
Collaboration Committee will be implemented in 2014.
PROFESSIONAL PRACTICES
The Professional Practices Department opened 120 new files in
2013, with claims totalling $1,166,473. QFREB conciliators held
86 conciliation sessions, which took place, on average, within
49 days after receiving the petitioner party’s file. This period was
70 days in 2011. The number of arbitration sessions decreased
significantly. In fact, only eight arbitration sessions were held, as
many files were resolved amicably before the hearing.
The QFREB presented several conferences in 2013 on the efficient
cause of sale and on decision-making criteria. In addition, five
arbitration decisions were summarized and published in the
Federation Express newsletter. Through these initiatives, the
Professional Practices Department continues to gain notoriety in
the real estate industry.
