I am the manager of IT Integration and Business Improvement for the Canadian Firearms Program (CFP) of the Royal Canadian Mounted Police (RCMP). The CFP oversees the administration of the Firearms Act (or Act). As such, I have personal knowledge of the matters to which I affirm in this Affidavit. To the extent that any information contained herein is based on information and belief, I have stated the source of the information and I believe such information to be true. 000151 2. I have read the Notice of Application and the affidavit evidence filed by the Applicant in these proceedings prior to affirming this affidavit. A. PROFESSIONAL BACKGROUND 3. I have been a public servant since April 1982 when I started my career with the RCMP. I held numerous positions within the RCMP organization from April 1982 until November 1997. 4. In November 1997 I became the Special Project Advisor to the Registrar of Firearms within the Canadian Firearms Registry. 5. In August 2001 I became the Manager, Business Operations for the CFP, taking responsibility for the Business Requirements Model of the Program and becoming prime liaison with the Program's Central Processing Site. 6. I held several management positions within the CFP between September 2001 and May 2009. 7. In May 2009, I became Manager of IT Integration and Business Improvement which is my current position. In this capacity, I am the prime liaison between the RCMP CFP and the RCMP Chief Information Officer (CIO) Sector. I am responsible for management and maintenance of the Program Business Requirements and also act as Project Manager for projects that are of a national scale. 8. In addition, in 2012, I oversaw the procedural implementation of An Act to Amend the Criminal Code and Firearms Act (Amendment Act), which came into force on April 5, 2012. The Amendment Act removed the registration requirement for non-restricted firearms, and 2 000152 required that the records in the Registry related to the registration of those firearms be destroyed as soon as practicible. B. THE REGISTRAR OF FIREARMS AND CHIEF FIREARMS OFFICERS 9. The Registrar of Firearms (Registrar) is a federal employee responsible for the establishment, maintenance, and day-to-day operation of the Canadian Firearms Registry (Registry). The Registry operates within the organizational structure of the RCMP. 10. Distinct from the Registrar, each province and territory has a Chief Firearms Officer (CFO) responsible for the administration of the licensing scheme under the Firearms Act. Aside from the government of Ontario, four other provincial governments have opted, pursuant to the Firearms Act, to appoint a CFO that has juridsiction over their territory. They are: the governments of Nova Scotia, Prince Edward Island, Quebec and New Brunswick (the participating provinces). In each case, the CFO is a provincial public servant, and in each case, as is also provided under the Act, the province receives funding from the federal government, to cover the salary, benefits and administrative expenses of the CFO and their personnel, as well as to cover expeditures related to office space, furniture, equipment and supplies. 11. The CFOs of the five remaining provinces, namely, Newfoundland and Labrador, Manitoba, Saskatchewan, Alberta and British Columbia, and the three territories, are employees of the federal government, specifically, the RCMP. Some CFOs are responsible for both a province and a territory. The federal government bears all of the costs related to the federal function of the CFOs in these provinces and territories in relation to the administration of the Firearms Act. 3 000153 C. THE CANADIAN FIREARMS REGISTRY 12. The Registry is maintained by the CFP on behalf of the Registrar. The Registry contains information collected by both the CFO and the Registrar in carrying out their respective duties under the Firearms Act. This information includes: o records of licence applications, refusals and revocations; o registration information for restricted and prohibited firearms; o information concerning the loss or theft of a firearm; and, o information concerning firearms held by law enforcement and government officials. 13. Prior to the implementation of the Amendment Act, the Registry also contained registration information for non-restricted firearms. Registration information for non-restricted firearms is no longer collected (except for residents of Quebec due to ongoing litigation), and the stale-dated information previously collected has been destroyed in all provinces except for residents of Quebec. 14. At an operational level, the information contained in the Registry is kept in a complex, central computerized registry called the Canadian Firearms Information System (CFIS). A subset of the information in CFIS is provided to the enforcement community by way of Canadian Firearms Registry OnLine (CFRO). The enforcement community has access to CFRO by way of the Canadian Police Information Centre (CPIC). 15. The CFRO, through CPIC, has been, and continues to be, consistently accessed by law enforcement. In 2010, the average number of daily inquiries was 14,729; in 2011, the average 4 000154 number was 17,782; in 2012, the average number was 18,185. Based on the iiii:iliiiif:iillliil iiififiijifiii>mfiMj the average number of daily inquiries currently is 18,745. 18,414 D. LICENSING REQUIREMENT IN THE FIREARMS ACT 16. Since 1979, every individual who seeks to acquire any firearm must obtain a licence. A licence is necessary regardless of whether the firearm is classified as a prohibited firearm, a restricted firearm, or a firearm that does not fall within either of those classifications (nonrestricted firearm). 17. Since 1994, every licence applicant must, unless alternatively certified by the CFO of the province in which he or she resides, pass the examination associated with the Canadian Firearms Safety Course or the Canadian Restricted Firearms Safety Course, as the case may be. In 2012, over 110,000 individuals completed the Canadian Firearms Safetey Course, and close to 40,000 indviduals completed the Canadian Restricted Firearms Safety Course. 1) Licence Application 18. A licence applicant must complete an application in a prescribed form. Attached as Exhibit A is a true copy of the current licence application form. The licence application requires an individual to disclose detailed information, including: o The applicant's name, date of birth, contact information and guaranteed photo identification; o Consent of an applicant's spouse, common-law spouse or other conjugal partner; o Information concerning any individual with whom the applicant had a conjugal relationship during the prior 2 years; 5 000155 o Information concerning any criminal charges or any prohibition orders m respect of the applicant or any family member; o Information concerning whether the applicant has been the subject of a complaint in the last 5 years relating to domestic violence; o Information concerning mental health issues in the prior 5 years; o The class of firearms the individual wishes to acquire in the next 5 years; and, o Two references who can attest to the accuracy of the information provided in the application. 19. Pursuant to section 55 of the Firearms Act, the CFO may inquire with the individual's neighbours, community workers, social workers, any person who has worked or lived with the individual, the spouse or common-law partner of the individual, family members or any other person they believe may be able to provide relevant information. 20. The CFO makes a determination of eligibility based upon the criteria set out in section 5 the Firearms Act. The CFO must have regard to whether the licence applicant: o has been convicted of an offence where violence or the threat of violence was used; o has been convicted of criminal harassment; o has been convicted of a trafficking offence under the Controlled Drug and Substances Act; o has been treated for mental illness associated with violence or threatened violence; and/or o has a history of violent behaviour. 6 000156 Individuals who are prohibited by court order from possessing a firearm are not eligible for a licence. 21. The CFOs provide notice of the licence application to those individuals that are or were in a conjugal relationship with the licence applicant within the last two years. If notification is not feasible the CFO has other avenues for conduct pursuant to the Fireams Licences Regulation subsection 4(3). 22. Based upon the eligibility criteria set out in the Firearms Act the CFO may issue, refuse to issue, and place conditions on a licence. A possession and acquisition licence is valid for a five year period and must be renewed at the end of that period. While an individual holds a valid licence, automated daily checks are performed to ensure that they remain eligibile to hold a licence. These eligibility checks include the use of Firearms Interest Police ("PIP") reports. The PIP reports provide notification of incidents of violent acts which have been reported to the police. These incidents are then matched with individuals holding firearms licences. Matches are forwarded electronically to the CFOs for review in accordance with the eligibility criteria mentioned above. 24. In addition, where the courts issue a firearms prohibition order, an individual becomes ineligible to hold a licence. In such circumstances, the CFO will be notified and the licence is revoked. 27. The Amendment Act does not change the requirement for all individuals to hold a licence to possess or aquire a firearm. The licensing eligibility requirements, including continued eligibility and monitoring, safety training and safe storage requirements for anyone who uses or owns a firearm continue to be in force. E. FIREARMS REGISTRATION 28. A requirement for individuals who possess restricted or prohibited firearms to register their firearms has been in place in some form since 1934. The registration application required a 9 000159 firearms holder to indicate his/her name, address, and some descriptors for the restricted or prohbited firearm, including the serial number. In 1998, there were about 1.2 million registered prohibited or restricted firearms. 29. In order to transfer a restricted or prohibited firearm, an individual was required to notity the Registrar in advance of the transfer and, if the transfer was approved, the Registrar would issue a registration certificate. Under the current statutory regime, the transfer of a restricted or prohibited firearm can be completed by paper, through a call centre, or online. The decision to register a firearm is generated automatically by the computer system and is approved unless there are flags on either a transferor or transferee (such as a FIP) or on the firearms (such as a CPIC flag for stolen firearm). In those instances, the CFO will conduct a further review. 30. The Amendment Act does not change the registration requirements for restricted and prohibited firearms. ~~~f:wfiii:ii!~i~D!ii:iiiii, there were 804,993 826,531 registered restricted or prohibited firearms in Canada. 31. Prior to 1998 there was no requirement to register non-restricted firearms. On December 1, 1998, a requirement to register non-restricted firearms was imposed for the first time upon any individual who possessed or sought to acquire a non-restricted firearm. That requirement remained in place until April 5, 2012. During that period, the Firearms Act required compliance with the registration requirement for existing non-restricted firearms holders by January 1, 2003. 32. In order to encourage and facilitate compliance with the new registration requirement for non-restricted firearms, amnesty orders were made pursuant to section 117 .14 of the Criminal Code. The first amnesty period concerning only non-restricted firearms came into force on May 17, 2006, and has been extended so that it now covers a period beginning on May 17, 2006 and 10 000160 ending on May 16, 2012. A true copy of the Amnesty Order and Amending Orders, is attached as Exhibit B. 33. As is the case for restricted and prohibited firearms, the application to register a non- restricted firearm was largely automated and required an individual to provide their licence number and the characteristics of the non-restricted firearms to be registered. The transfer provisions also applied. 34. Under the current regime, an individual seeking to transfer a non-restricted firearm must ensure that the transferee is licensed and must have no reason to believe the transferee is not entitled to acquire and possess the non-restricted firearm. Failure to do so is a criminal offence. The Act provides a mechanism by which an individual may confirm with the Registrar that a transferee is licensed. 35. I have read the affidavit of Anil Anand of the Toronto Police Services, wherein he indicates that firearms seizures by the Toronto Police Services dropped 41.88% between 2011 and 2012. This statistic is not consistent with either the national rate of firearms seizures or the rate of firearms seizures in Ontario, both of which are provided to the Registrar under the Public Agent Firearm Regulations. 36. According to the information in the CFIS, the national firearms seizures reported to the CFP totalled 33,934 in 2011, 27,837 of which were non-restricted firearms. In 2012, the national firearms seizures were 32,315, 25,993 of which were non-restricted firearms. From January to September of 2013, there have been 25,002 national seizures effected, 19,858 of which were non-restricted firearms. Similarly, in Ontario, there were 9,647 firearms seizures in 2011 (7,736 11 000161 non-restricted); 9,736 in 2012 (7,503 non-restricted); and, from January to September 2013, there have been 6,219 firearms seizures (4,667 non-restricted). F. CHALLENGES WITH THE CANADIAN FIREARMS PROGRAM 37. In a 2006 Auditor General's Report, the Auditor General noted that, notwithstanding the efforts made to ensure accuracy of data in the CFIS, there were data quality problems. Some of the factors the report highlighted included inaccurate address information, inability to verify information contained in the CFIS with other provincial databases, and inaccurate descriptions of registered firearms. Attached as Exhibit B is a true copy of the 2006 Report. 38. The Auditor General has not completed any further reviews of the program since 2006. Attached as Exhibit C is a statement by Sheila Fraser outlining the prior reviews conducted by the Auditor General. 39. Please note that our little investigation will result in a cleanup, as they were not aware of the large number of 'miss-classified' protected firearms. So, although data may not look good, it is at least a good discovery that will result in some good done! Here are some findings: - Some of these were entered with very poor descriptions; e.g. FIN 10848792 has the following errors make/model combo does not exist in FRT manufacturer does not exist user entered a semi-automatic handgun but provided a barrel length of 650mm - Some appear to have been entered with partially correct data, though not an FRT match (FIN 10701625). The user entered a HG and gave a very short barrel length (restricted or prohib) but they made an error when answering the barrel length question - essentially they told us the barrel length is greater than 470mm. Both of these are caused by user error in data entry. That's all we could find so far. I hope this helps. En 2013, Ie PCAF s'est attache a ameliorer la securite en matiere d'armes a fcu grace a une initiative de sensibilisatfon relative a la securite en matiere d'armes a feu dans le Nord.
