Official Rules
1. Entry Period: The Royal Conservatory Share the Celebration: Celebration Series® Video
Countdown (“Celebration Countdown”), sponsored by The Royal Conservatory (“Sponsor”), begins
on October 23, 2014 at 12:00 p.m. Eastern Time (“ET”) and ends on March 20, 2015 at 2:00 p.m. ET
(the “Countdown Period). The computer clock of Sponsor’s webmaster is the official timekeeping
device of the Countdown.
2. Eligibility: The Celebration Countdown is open to permanent lawful residents of Canada and the
United States who have reached the age of majority in their province, state or territory of residence as
of the starting date of the Celebration Countdown. Professional musicians are not eligible to enter or
win a prize in the Celebration Countdown. Prospective entrants who are under the age of majority in
their province, state or territory of residence may participate in the Celebration Countdown; however,
a parent or legal guardian of the minor must enter the Celebration Countdown and complete all
documentation required for purposes of the Celebration Countdown on the minor’s behalf. Parents or
legal guardians who enter the Celebration Countdown on behalf of a minor will, if their eligible entry
is selected and they otherwise comply with these Celebration Countdown Official Rules, accept the
prize on the minor’s behalf; however, the minor will be declared the winner. Finalists in the
Celebration Countdown will be required to attend an online event on March 21, 2015 in order to be
declared a winner in the Celebration Countdown. Sponsor reserves the right to verify the identity of
entrants at any time during the Countdown.
Employees of the Sponsor, agents, advertising, and promotion agencies, and any other entity that
develops, produces, or distributes materials for or related to this Celebration Countdown, and
members of the immediate families (defined for these purposes as including parents, spouse, children,
siblings, grandparents, and each of their respective spouses), households or domiciles (whether
related or not) of any of the above, are NOT eligible to enter or win. By participating in the
Celebration Countdown, entrants agree to be bound by these Official Rules, the decisions of the
judges, which are final. The Celebration Countdown is subject to all applicable federal, provincial,
state and municipal laws and regulations, and is void where prohibited by law.
3. How to Enter: No purchase necessary. To enter, visit the Celebration Countdown website at
https://www.rcmusic.ca/social-media-hub/share-celebration-video-countdown (the “Website”) during
the Celebration Countdown Period and enter by following the onscreen instructions and those
instructions contained in these Official Rules. By entering, each entrant represents that he/she has
read the Official Rules and the Website policies, and agrees to be bound by all of them.
The Sponsor will post twelve (12) repertoires on the Website, one for each level, from Preparatory A
through to and including Level 10 piano. Eligible entrants may enter by submitting (via the online
entry form) a YouTube or Vimeo link to an original video of their own (or, if entering the Celebration
Countdown on behalf of a minor, the minor’s) solo piano performance of one of the Celebration
Countdown repertoires provided on the Website. The title of each entrant’s video submission (which,
together with the completed online entry form will constitute an entry) must include:

The title of the Celebration Countdown: “Share the Celebration: Celebration
Series® Video Countdown”;
The name and composer of the repertoire selection;

The Celebration Countdown entrant’s first name, city/town of residence (if the entrant is
a parent/guardian of a minor, only the parent’s first name and city/town of residence
should be provided) and entrant or minor’s piano teacher’s name (if any); and
The highest piano level achieved by the entrant (entrants may not submit a repertoire for
a level lower than that which they have achieved as of the date upon which they enter the
Celebration Countdown. For example, an entrant who has achieved a Level One Piano
may not submit a video of a Preparatory A repertoire).
Videos must be presented in horizontal (i.e., not vertical) format. No editing, digital effects,
colorization or image manipulation of videos is permitted. The Celebration Countdown entrant (or if
an entrant is entering on behalf of a minor, the minor) must remain wholly within the video frame
during the entire repertoire performance. Performances must be memorized. Non-memorized
performances will result in disqualification of entries. If there is no sound in the video submission, or
if any other technical issue prevents a video submission from meeting any of the entry requirements
set forth in these Official Rules, the entry will be deemed ineligible.
Limit one entry per person. Should multiple entries be received, all such entries will be ineligible.
Proof that an entrant uploaded or submitted a video link to enter does not constitute evidence that the
Sponsor actually received it by the appropriate deadline. By entering, each entrant represents that
his/her entry is his/her original work and that neither the entry itself nor the act of preparing the entry
infringes or infringed on the property rights or other rights of any third party; and that the entry has
not been submitted in any other promotion or won any award in any promotion. Modifying,
enhancing or altering a third party’s pre-existing work does not qualify as an entrant’s original
creation. The Sponsor reserves the right to disqualify any entry that it determines (in its sole
discretion) to contain any content that is obscene, defamatory, dangerous, discriminatory, infringing
or otherwise inappropriate or unsuitable for publication to general audiences, or that contains any
third party trademarks (other than those of Sponsor should entrant choose to include Sponsor’s
trademarks in the entry).
The deadline for submission of an entry in the Celebration Countdown is 11:59:59 p.m. ET on the
following dates:

During the Celebration Countdown Period, selected entries may be linked to or posted on the
Website. Entries featuring minors will not be linked to or posted on the Website during the
Celebration Countdown Period. Such postings may be on a rotating or occasional basis and may be
discontinued at any time at Sponsor’s sole discretion. Posting of an entry at this phase of the
Celebration Countdown Period is not meant to indicate that the entry is a winner in the Celebration
Countdown, or that it is otherwise favoured in any way. Postings will occur solely for promotional
and educational purposes.
All entries become the property of the Sponsor and will not be returned.
4. Finalist/Winner Selection Process: Chances of winning depend on the number of eligible entries
received within each level and application of the technical testing requirements described below to
those entries. The Sponsor is unaware of how many eligible entries will be received. One
Finalist/winner per level will be selected, for a total of twelve (12) Finalists/winners in the
Celebration Countdown. All eligible entries at each level will be reviewed by a panel of qualified
judges based upon whether the video submission meets the technical testing requirements for that
level as set out in the Sponsor’s Piano Syllabus, 2008 Edition, available online at:
https://examinations.rcmusic.ca/sites/default/files/files/S29_PianoSyllabus_2013%20online_SECUR
ED.pdf. Each of the technical testing requirements is weighted equally for purposes of assessing an
entry in the Celebration Countdown.
The top-scoring entrant from each level based upon the requirements described above will be deemed
a “Finalist” and will be notified by the Sponsor by e-mail. Finalists must provide a copy of the
original video file to Sponsor. Individual scores will not be disclosed publicly or to any entrant,
Finalist or winner in the Celebration Countdown. Videos must be in one of the following formats:
MP4/MPEG4 or .MOV files. If Sponsor is not provided with a copy of the original video file or
cannot contact a potential Finalist by e-mail within seven (7) days of Sponsor’s first notification
attempt, then such potential Finalist will be disqualified and another potential Finalist will be chosen
based on the same technical requirements. In the event of a tie within any level, the judges will
reassess the tied entries in accordance with a new requirement, “general musical interest”, which
assesses to what extent the entry sustains musical interest. The entrant with the highest score in
accordance with the new “general musical interest” requirement will be judged a Finalist.
Subject to verification by the Sponsor, the Finalist at each level will be declared a winner in the
Celebration Countdown. The winner for each level will be announced at the offices of the Sponsor at
2:01 p.m. ET on the following dates:

5. Prizes: Twelve (12) prizes will be awarded in the Celebration Countdown, with one (1) prize being
awarded to the winner at each level from Preparatory Level A to Level Ten, inclusive. The winner at
each level will receive a party kit consisting of party hats, noise makers, banners, invitations,
balloons, and direction signs and an invitation to an online event hosted by the Sponsor on March 21,
2015. Approximate Retail Value (“ARV”) of each prize: $100 CAD. Any difference between the
stated maximum value and the actual value will not be awarded to winner. Prizes will be delivered to
confirmed winners by the Sponsor or a representative thereof. Winners will be responsible for all
taxes owing in connection with the receipt of a prize in the Celebration Countdown. In the event that
the online event portion of the prizes cannot proceed for any reason, the remainder of the prizes will
be awarded as described above and no alternate arrangements or compensation will be provided by
the Sponsor.
Total ARV of all prizes in this Celebration Countdown: $1,200 CAD. All dollar amounts herein are
expressed in Canadian currency (“CAD”). The prizes consist only of items specified herein; all prize
details not specified herein shall be determined by Sponsor in its sole discretion. Any options or
upgrades on a prize that are not expressly included with the prize shall be the winner’s responsibility.
No transfer or substitution of prizes (or any portion thereof) or cash alternative permitted, except as
provided herein. Sponsor reserves the right to substitute a prize (or portion thereof) of equal or greater
value in the event the advertised prizes (or portion thereof) are unavailable. The Sponsor accepts no
liability or responsibility for loss incurred by the prize winners or any third party if any prize (or
portion thereof) is unavailable or substituted for any reason. The prizes will be awarded provided a
sufficient quantity of qualifying entries is received, and the prizes are claimed properly in accordance
with these rules.
6. Rights: By submitting an entry, each entrant warrants that the entry is the entrant’s wholly original
creation and does not infringe any copyright, trademark, publicity, privacy or other proprietary right
of any third party, union or guild. Submission of an entry grants Sponsor the right to publish, use,
adapt, edit and/or modify the entry for educational purposes in any way in any and all media
worldwide now known or hereinafter developed, without limitation and without notice or
consideration to the entrant. By submitting an entry, each entrant in the Celebration Countdown
further agrees (on his/her own behalf and on behalf of the minor, if applicable) that his/her entry
constitutes an assignment of all rights, title and intellectual property rights in and to such entry to
Sponsor as a condition of competing for a prize, including without limitation the right to make any
derivative version of the entrant’s entry, and absolute discretion to alter the entrant’s entry in any
way, including without limitation editing, cropping, reformatting, title changes, and removal or
addition of any element. Sponsor may require each potential winner (or, in the case of a minor, the
minor’s parent or legal guardian) to execute documents to confirm this transfer of rights, or prize will
be forfeited and an alternate potential winner selected based on the criteria stated herein.
Entrants and/or anyone who appears within the submitted video(s) grant permission to Sponsor to use
their entries, any derivatives/portions thereof, names, likenesses, and biographical information for
educational purposes in all media worldwide, without notice or further compensation, unless
prohibited by law. By participating, entrants hereby agree to release and hold harmless Sponsor, its
employees, agents, and advertising and promotional agencies (collectively the “Releasees”) from and
against any and all liability for claims, costs, injuries, losses or damages of any kind, (including,
without limitation, claims, costs, injuries, losses or damages related to personal injuries, death,
damage to, or loss or destruction of property, rights of publicity or privacy, defamation or portrayal in
a false light) which may occur in connection with use of the Website (including but not limited to
damage to entrants’ or others’ computer equipment resulting from participation), their preparation for
or participation in the Celebration Countdown or preparation/posting of any entry, or from their
acceptance, possession use/misuse of any prize they may be awarded.
Winners (or their parent/legal guardian, if a minor) agree to indemnify and hold the Releasees
harmless from and against any claims, suits, losses, damages and expenses, including reasonable
attorneys’ fees, which arise in connection with any allegation that their entry violates the intellectual
property rights of any third party, or in connection with any allegation based on rights of privacy or
publicity, defamation or portrayal in a false light. Each Finalist will be notified by e-mail and will be
required to execute and return a Release of Liability and Publicity within seven (7) days of first
attempted written prize notification or that potential winner may be disqualified and an alternate
potential winner selected based on the criteria stated herein.
Without an express opt-in permitting Sponsor to use entrants personally identifiable information for
marketing purposes, entrants personally identifiable information will only be used as needed to
administer the Celebration Countdown. The terms of this Celebration Countdown, as set forth in
these Official Rules, are not subject to amendment or counter-offer, except as set out herein.
7. Entry Errors/Tampering: Sponsor is not responsible for: (i) electronic or digital transmissions or
any entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, postage-due
or misdirected; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions,
defects, delays in operation or transmission, communication failures, destruction or unauthorized
access to, or alteration of, entries; (iii) failed or unavailable hardware, network, software or telephone
transmissions, damage to entrants’ or any person’s computer and/or its contents, or causes beyond
Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper
conduct of this Celebration Countdown; (iv) any entries submitted in a manner that is not expressly
allowed under these Official Rules; (v) incorrect or inaccurate entry information whether caused by
entrants or by any of the equipment or programming associated with or utilized in the Celebration
Countdown, (vi) any typographical or other error in the printing or advertising of the Countdown,
administration or execution of the Celebration Countdown, or in the announcement of prizes/prize
winners/finalists; or (vii) malfunctions or interference resulting from illicit, malicious or injurious
code (including but not limited to viruses, worms and denial of service attacks). If for any reason the
Celebration Countdown cannot be executed as planned, including but not limited to transmission
failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical
failures, or any other causes beyond the control of Sponsor that corrupt or affect the security,
administration, fairness, integrity or proper conduct of the Celebration Countdown, or if the
Celebration Countdown is compromised or becomes technically corrupted in any way, electronically
or otherwise, Sponsor reserves the right, by posting a notice at the Website and with the consent of
the Régie des alcools, des courses et des jeux in Quebec, to cancel, modify or terminate the
Celebration Countdown and reserves the right, but shall not be obligated, to select the winners from
among all non-suspect entries received in each category as of the date/time of such
termination/cancellation or modification. Sponsor reserves the right, at its sole discretion, to
disqualify and prosecute any individual who tampers with or attempts to tamper with the entry
process or who votes using any automatic or programmed entry duplication method.
CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY
WEBSITE OR OTHERWISE CORRUPT THE CELEBRATION COUNTDOWN OR TO
UNDERMINE THE LEGITIMATE OPERATION OF THE CELEBRATION COUNTDOWN
MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN
ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY,
PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST
EXTENT PERMITTED BY LAW.
8.
Winners List: For the names of the winners and/or a copy of the Official Rules, visit the Website.
The winners’ names will be posted after March 20, 2015 following verification of the winners and
awarding of the prizes.
9.
Quebec Residents: Any litigation respecting the conduct or organization of a publicity contest may be
submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the
awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a
settlement.
10. Sponsor: This Celebration Countdown is sponsored by The Royal Conservatory, 273 Bloor Street
West, Toronto, ON M5S 1W2. Neither YouTube nor Vimeo is a participant in, or a sponsor of, the
Countdown.
Concours Share the Celebration: Celebration Series® Video Countdown
Règlement officiel

Période d’inscription : Le concours Share the Celebration: Celebration Series® Video Countdown
(le « Concours »), commandité par The Royal Conservatory (le « Commanditaire »), débute à 14 h,
heure de l’Est (« HNE ») le 15 octobre 2014, et se termine à 14 h (HNE), le 20 mars 2015
(la « Durée du concours »). L’horloge de l’ordinateur du webmestre du Commanditaire sert de
chronomètre officiel du Concours.
2. Admissibilité : Le Concours ne s’adresse qu’aux résidents permanents autorisés du Canada et des
États-Unis qui ont atteint l’âge de la majorité dans leur province, état ou territoire de résidence à la
date de début du Concours. Les musiciens professionnels ne sont pas admissibles à participer au
Concours ou à y remporter un prix. Les participants éventuels qui n’ont pas atteint l’âge de la
majorité dans leur province, état ou territoire de résidence peuvent participer au Concours; cependant,
le parent ou tuteur légal du mineur doit s’inscrire au Concours et remplir tous les documents exigés
aux fins du Concours pour le compte du mineur. Si sa participation admissible est choisie et qu’elle
est conforme au Règlement officiel du Concours, le parent ou le tuteur légal qui participe au
Concours pour le compte d’un mineur doit accepter le prix pour le compte du mineur; toutefois, c’est
le mineur qui est déclaré gagnant. Les Finalistes du Concours sont tenus de participer à un événement
en ligne, le 21 mars 2015, en vue d’être déclarés gagnants du Concours. Le Commanditaire se réserve
le droit de vérifier l’identité des participants à tout moment pendant le Concours.
Les employés, les mandataires, les agences de publicité et de promotion et toute autre entité qui
conçoit, produit et distribue du matériel dans le cadre du Concours, et les membres de la famille
immédiate (désigne aux fins des présentes, les parents, conjoints, conjointes, enfants, frères, sœurs,
grands-parents, et leurs conjoints et conjointes respectifs) ainsi que les membres du ménage ou de la
résidence (qu’ils aient ou non un lien de parenté) de l’une des personnes susmentionnées, NE sont
PAS admissibles à participer ou à gagner. En participant au Concours, les participants conviennent
d’être liés par le présent Règlement officiel et les décisions des juges, lesquels sont définitifs. Le
Concours est assujetti à l’ensemble des lois et des règlements fédéraux, provinciaux, étatiques et
municipaux applicables, et il est frappé de nullité là où la loi l’interdit.
3. Comment s’inscrire et participer : aucun achat n’est requis. Pour participer, rendez-vous sur le
site Internet du Concours à l’adresse https://www.rcmusic.ca/social-media-hub/share-celebrationvideo-countdown (le « Site Internet ») pendant la Durée du concours et inscrivez-vous en suivant les
instructions à l’écran ainsi que celles qui figurent dans le présent Règlement officiel. En s’inscrivant
et en participant au Concours, chaque participant déclare avoir lu le Règlement officiel et les
politiques du Site Internet et il convient d’y être lié.
Le Commanditaire doit afficher douze (12) répertoires sur le Site Internet pour chacun des niveaux,
du niveau préparatoire A au niveau 10 au piano. Les participants admissibles peuvent s’inscrire en
soumettant (au moyen du formulaire d’inscription en ligne) un lien vers leur propre vidéo originale
sur YouTube ou sur Vimeo (ou la vidéo du mineur, si le participant s’inscrit au Concours pour le
compte d’un mineur) de leur interprétation d’un solo de piano qui figure dans l’un des répertoires
affichés sur le site Internet du Concours. Le titre de la vidéo soumise par chaque participant
(accompagnée du formulaire d’inscription en ligne rempli constitue une participation) doit
comprendre :
o le nom du Concours : « Share the Celebration : Celebration Series® Video Countdown »;
o le nom et le compositeur du répertoire choisi;
o le prénom et la ville de résidence du participant au Concours (si le participant est le
o
parent ou le tuteur légal d’un mineur, seuls le prénom et la ville de résidence du parent
doivent être indiqués) ainsi que le nom du professeur de piano du participant ou du
mineur (s’il y a lieu);
le niveau le plus avancé atteint par le participant au piano (le participant ne peut pas
soumettre un répertoire d’un niveau inférieur à celui atteint à la date d’inscription au
Concours. Par exemple, un participant qui a atteint un Niveau 1 au piano ne peut pas
soumettre une vidéo du répertoire de niveau préparatoire A).
Les vidéos doivent être présentées en format paysage (c.-à-d. non en format portrait). Le montage,
l’effet numérique, la colorisation et la manipulation d’images de la vidéo sont interdits. Le participant
au Concours (ou le mineur, si un participant s’est inscrit pour le compte du mineur) doit rester
entièrement visible dans l’image vidéo tout au long de l’interprétation de la pièce. La pièce doit être
interprétée de mémoire. Une pièce qui n’est pas interprétée de mémoire entraîne l’exclusion des
participations. S’il n’y a pas de son sur la vidéo soumise, ou si un autre problème technique empêche
la vidéo soumise de respecter les conditions relatives à l’inscription prévues dans le présent
Règlement officiel, l’inscription est réputée inadmissible.
Limite d’une participation par personne. Si plusieurs participations sont reçues, elles seront toutes
inadmissibles. Une preuve que le participant a téléversé ou soumis un lien vers une vidéo aux fins
d’inscription n’atteste pas que le Commanditaire l’a bien reçue dans le délai prescrit. En participant,
chaque participant déclare que sa participation est son œuvre originale et que ni la participation même
ni le fait de préparer la participation ne violent ou n’ont violé les droits exclusifs ou d’autres droits
d’un tiers; et que la participation n’a pas été soumise dans le cadre d’aucune autre offre
promotionnelle ou qu’elle n’a pas remporté de prix dans le cadre d’une offre promotionnelle. La
modification, l’amélioration ou le changement d’une œuvre préexistante d’un tiers n’est pas
admissible à titre de création originale d’un participant. Le Commanditaire se réserve le droit
d’exclure une participation qu’il juge (à sa seule appréciation) contenir un élément obscène,
diffamatoire, dangereux, discriminatoire, préjudiciable ou autrement inapproprié ou inadapté à
l’affichage au grand public, ou qui contient des marques de commerce de tiers (autres que celles du
Commanditaire si le participant décide d’inclure les marques de commerce du Commanditaire dans sa
participation).
L’échéance pour la remise des participations au Concours est l’une des dates suivantes à
23 h 59 min 59 s (HNE) :

Au cours de la Durée du concours, des participations choisies ou un lien vers celles-ci peuvent être
affichés sur le Site Internet. Aucune participation mettant en vedette des mineurs ni aucun lien vers
celle-ci ne peuvent être affichés sur le Site Internet pendant la Durée du concours. L’affichage de ces
participations peut faire l’objet d’une rotation ou être occasionnel et peut être supprimé à tout moment
à la seule appréciation du Commanditaire. L’affichage d’une participation à cette étape de la Durée
du concours ne vise pas à indiquer que la participation remporte le Concours, ou qu’elle est avantagée
de quelque manière que ce soit. L’affichage se fait uniquement à des fins promotionnelles et
éducatives.
Toutes les participations deviennent la propriété du Commanditaire et ne seront pas retournées à ceux
qui les ont soumises.
4. Processus de sélection des Finalistes/gagnants : La probabilité de gagner repose sur le nombre de
participations admissibles reçues pour chacun des niveaux et du respect des exigences en matière
d’essais techniques relativement à ces inscriptions décrites ci-après. Le Commanditaire ne connaît pas
le nombre de participations admissibles qu’il est susceptible de recevoir. Un Finaliste/gagnant par
niveau est choisi, pour un total de douze (12) Finalistes/gagnants du Concours. Toutes les
participations admissibles pour chaque niveau sont passées en revue par un jury composé de juges
qualifiés qui évaluent si les vidéos soumises respectent les exigences en matière d’essais techniques
propres à ce niveau, comme indiqué dans l’édition 2008 du plan de cours du Commanditaire intitulé
Piano Syllabus, que vous pouvez consulter en ligne à l’adresse :

ED.pdf. Chaque exigence en matière d’essais techniques est étudiée équitablement aux fins
d’évaluation d’une participation au Concours.
Le participant qui a obtenu le meilleur résultat pour chaque niveau, conformément aux exigences
décrites préalablement, est réputé « Finaliste » et est avisé par courriel par le Commanditaire. Les
Finalistes doivent remettre une copie du fichier vidéo original au Commanditaire. Les résultats
individuels ne sont communiqués ni au public, ni à aucun participant, Finaliste ou gagnant du
Concours. Les vidéos doivent être soit dans un format MP4/MPEG4, soit dans un fichier .MOV. Si le
Commanditaire ne reçoit pas une copie du fichier vidéo original et qu’il n’est pas en mesure de
communiquer avec le Finaliste potentiel par courriel au plus tard sept (7) jours après la première
tentative de notification, il sera alors exclu et un autre Finaliste potentiel sera choisi selon les mêmes
exigences techniques. En cas d’égalité dans le même niveau, les juges étudieront à nouveau les
participations qui sont à égalité conformément à une nouvelle exigence, celle de l’« intérêt musical
général » ou « general musical interest », qui leur permet d’évaluer le degré d’intérêt du participant
pour la musique. Le participant qui obtient le pointage le plus élevé conformément à cette nouvelle
exigence de l’« intérêt musical général » est réputé Finaliste.
Sous réserve de la vérification effectuée par le Commanditaire, le Finaliste de chacun des niveaux
sera déclaré gagnant du Concours. Le gagnant de chacun des niveaux sera annoncé dans les bureaux
du Commanditaire à 14 h (HNE), aux dates suivantes :

5. Prix : Douze (12) prix sont remis dans le cadre du Concours, un (1) prix étant attribué au gagnant de
chacun des niveaux, du niveau préparatoire A au niveau 10, inclusivement. Le gagnant de chaque
niveau recevra une trousse de fête, qui comprend des chapeaux de fête, des crécelles, des bannières,
des invitations, des ballons et des panneaux de direction ainsi qu’une invitation à un événement en
ligne organisé par le Commanditaire le 21 mai 2015. La Valeur au détail approximative (la « VDA »)
de chaque prix est de 100 $ CAN. La différence entre la valeur maximale indiquée et la valeur réelle
n’est pas attribuée au gagnant. Les prix sont remis aux gagnants confirmés par le Commanditaire ou
par son représentant. Les gagnants prennent en charge la totalité de l’impôt et des taxes exigibles
relativement à la réception d’un prix du Concours. Si une partie du prix, notamment l’événement en
ligne, ne peut être remise pour quelque motif, le reste du prix est attribué tel qu’il a été décrit
précédemment et aucune solution de rechange ni aucune rémunération n’est offerte par le
Commanditaire.
La VDA totale de l’ensemble des prix du présent Concours est de 1 200 $ CAN. Aux présentes, tous
les montants en dollars sont exprimés en dollars canadiens (« CAN »). Les prix se composent
uniquement d’articles indiqués aux présentes; toutes les modalités des prix qui ne figurent pas aux
présentes sont établies par le Commanditaire, à sa seule appréciation. Toute option ou amélioration
d’un prix n’est pas expressément incluse dans le prix et incombe au gagnant. Aucun transfert ni
remplacement de prix (ou d’une partie de celui-ci) ni aucune remise en espèces ne sont autorisés, sauf
disposition contraire aux présentes. Le Commanditaire se réserve le droit de remplacer un prix (ou
une partie de celui-ci) de valeur égale ou supérieure si les prix annoncés (ou une partie ceux-ci) ne
sont plus disponibles. Le Commanditaire n’engage aucunement sa responsabilité à l’égard des pertes
subies par les gagnants de prix ou par tout tiers si un prix (ou une partie de celui-ci) n’est plus
disponible ou est remplacé pour quelque motif que ce soit. Les prix sont attribués à condition qu’un
nombre suffisant de participations admissibles soient reçues et que les prix soient réclamés
correctement, conformément au présent règlement.
6. Droits : En soumettant une participation, chaque participant garantit que sa participation est sa
propre création entièrement originale et qu’elle ne viole aucun droit d’auteur, ne contrefait aucune
marque de commerce et qu’elle ne porte atteinte à aucun droit à la protection de la personnalité, à
aucun droit à la protection de la vie privée, ni à aucun droit exclusif d’un tiers, d’un syndicat ou d’une
confrérie. La soumission d’une participation confère au Commanditaire le droit d’afficher, d’utiliser,
d’adapter, de mettre en forme et de modifier la participation sans restriction à des fins éducatives de
quelque manière et dans quelque média mondial que ce soit, connu maintenant ou conçu par la suite,
sans préavis au participant et sans lui remettre de contrepartie. En soumettant une participation,
chaque participant au Concours convient également (pour son propre compte et pour le compte du
mineur, selon le cas) que sa participation constitue une cession de tous les droits, titres et droits de
propriété intellectuelle sur cette participation et à l’égard de celle-ci au Commanditaire, à titre de
condition en vue de concourir pour un prix, notamment le droit de créer une version dérivée de la
participation du participant, ainsi que le pouvoir discrétionnaire de modifier la participation d’un
participant de quelque manière que ce soit, ce qui comprend notamment la révision, le recadrage, la
nouvelle mise en forme, la modification de titres et le retrait ou l’ajout d’un élément. Le
Commanditaire peut exiger de chaque gagnant potentiel (ou, dans le cas d’un mineur, son parent ou
tuteur légal) qu’il signe les documents afin de confirmer le transfert des droits, ou le prix sera perdu et
remis à un autre gagnant potentiel choisi selon les critères mentionnés aux présentes.
Les participants et toute personne figurant dans la vidéo soumise octroient l’autorisation au
Commanditaire d’employer leurs participations, et toutes parties ou œuvres dérivées de celles-ci, leur
nom, leur image et leurs renseignements biographiques à des fins éducatives dans tous les médias du
monde, sans préavis ni autre rémunération, sauf si la loi l’interdit. En participant, les participants
conviennent par les présentes de libérer et de tenir indemnes le Commanditaire, ses employés,
mandataires et agences de publicité et de promotion (collectivement, les « Renonciataires ») à l’égard
des demandes, réclamations, frais, préjudices, pertes ou dommages-intérêts de quelque nature que ce
soit (notamment, les demandes, réclamations, frais, blessures, préjudices, pertes ou
dommages-intérêts liés à des lésions personnelles, à un décès, à l’endommagement, à la perte ou à la
destruction d’un bien, au droit à la protection de la personnalité ou de la vie privée, à la diffamation
ou à une présentation erronée) qui seraient liés à l’utilisation du Site Internet (notamment,
l’endommagement du matériel informatique du participant ou de tiers découlant de la participation), à
leur préparation au Concours, à leur participation à celui-ci, à la préparation ou à l’affichage d’une
participation, ou à leur acceptation du prix qui leur a été attribué, ainsi qu’à leur possession, à leur
utilisation ou à leur mauvais usage d’un tel prix.
Les gagnants (ou leur parent/tuteur légal, s’ils sont mineurs) conviennent d’indemniser et de tenir
indemnes les Renonciataires à l’égard des demandes, réclamations, poursuites, pertes,
dommages-intérêts, frais et dépenses, y compris les frais et honoraires raisonnables d’avocats,
découlant d’une allégation selon laquelle leur participation porte atteinte aux droits de propriété
intellectuelle d’un tiers, ou d’une allégation fondée sur le droit à la protection de la vie privée ou de la
personnalité, d’une diffamation ou d’une présentation erronée. Chaque Finaliste est avisé par courriel
et est tenu de signer et de retourner une Décharge de responsabilité au cours des sept (7) jours suivant
la tentative de notification par écrit du prix, ou ce gagnant potentiel pourrait être exclu et un autre
gagnant potentiel serait choisi selon les critères mentionnés aux présentes.
Sans acceptation expresse autorisant le Commanditaire à employer les renseignements personnels
permettant d’identifier le participant à des fins de commercialisation, ces renseignements sont
employés uniquement au besoin pour administrer le Concours. Les modalités du présent Concours,
énoncées au présent Règlement officiel, ne peuvent pas faire l’objet de modifications ni de contreoffres, sauf dans la mesure prévue aux présentes.
7. Erreurs de saisie/falsification : Le Commanditaire n’est nullement responsable : (i) des
transmissions électroniques ou numériques ou des participations perdues, tardives, volées,
incomplètes, illisibles, endommagées, déformées, détruites, insuffisamment affranchies ou mal
adressées; (ii) des problèmes ou des défaillances techniques, erreurs, omissions, interruptions,
suppressions, défectuosités, retards liés à l’exploitation ou à la transmission, interruptions des
communications, destructions ou modifications des participations ou accès non autorisés à celles-ci;
(iii) d’une indisponibilité ou d’une panne du matériel informatique, du réseau, du logiciel ou des
communications par téléphone, des dommages à l’ordinateur du participant ou d’une personne ou au
contenu de cet ordinateur, ou de causes indépendantes de la volonté du Commanditaire qui nuisent à
l’administration, à la sécurité, à l’égalité, à l’intégrité ou au bon déroulement du présent Concours;
(iv) des participations soumises d’une manière qui n’est pas expressément autorisée par le Règlement
officiel; (v) des renseignements inexacts ou erronés relatifs à une participation, qu’ils proviennent des
participants ou de tout matériel ou programme utilisé dans le cadre du Concours ou y afférant;
(vi) d’une erreur typographique ou autre survenue au cours de l’impression ou de l’affichage du
Concours, de l’administration ou du déroulement du Concours, ou de l’annonce des prix, des
gagnants ou des finalistes, ou (vii) des défectuosités ou interférences découlant de codes illicites,
malveillants ou préjudiciables (notamment, les virus, vers informatiques et attaques par déni de
service). Si le Concours ne peut se dérouler comme prévu, pour quelque motif que ce soit, notamment
un défaut de transmission, une infection par un virus informatique, une erreur, un bogue, une
falsification, une intervention non autorisée, une fraude, des défaillances techniques ou autre cause
indépendante de la volonté du Commanditaire, qui nuisent ou compromettent la sécurité,
l’administration, l’égalité, l’intégrité ou le bon déroulement du Concours, ou si le Concours est
compromis ou devient corrompu sur le plan technique de quelque façon que ce soit, électroniquement
ou autre, le Commanditaire se réserve le droit, en affichant un avis sur le Site Internet et avec le
consentement de la Régie des alcools, des courses et des jeux au Québec, d’annuler ou de modifier le
Concours, ou d’y mettre fin, et il se réserve le droit, sans y être tenu, de choisir les gagnants parmi
toutes les participations non suspectes reçues dans chaque catégorie à la date ou à l’heure de cette fin,
annulation ou modification. Le Commanditaire se réserve le droit, à sa seule appréciation, d’exclure
toute personne qui falsifie le processus d’inscription ou qui vote à l’aide d’une méthode de
duplication de participations automatique ou robotisée, et d’intenter des poursuites contre lui.
MISE EN GARDE : TOUTE TENTATIVE PAR UNE PERSONNE D’ENDOMMAGER
DÉLIBÉRÉMENT UN SITE INTERNET, DE CORROMPRE LE CONCOURS OU DE
MINER LE DÉROULEMENT LÉGITIME DU CONCOURS PEUT CONSTITUER UNE
VIOLATION DES LOIS CIVILES ET PÉNALES. EN CAS DE TENTATIVE SEMBLABLE,
LE COMMANDITAIRE SE RÉSERVE LE DROIT D’EXCLURE CETTE PERSONNE, DE
LA POURSUIVRE EN JUSTICE ET DE LUI RÉCLAMER DES DOMMAGES-INTÉRÊTS
DANS LA PLEINE MESURE AUTORISÉE PAR LA LOI.
8. Liste des gagnants : Pour connaître le nom des gagnants et/ou pour obtenir un exemplaire du
Règlement officiel, rendez-vous sur le Site Internet. Le nom des gagnants sera affiché après le
20 mars 2015 suivant la vérification des gagnants et la remise des prix.
11. Résidents du Québec : Un différend quant à l’organisation ou au déroulement d’un concours
publicitaire peut être soumis à la Régie des alcools, des courses et des jeux afin qu’il soit tranché. Un
différend quant à l’attribution d’un prix peut être soumis à la Régie uniquement aux fins d’une
intervention pour tenter de le régler.
12. Commanditaire : Le présent Concours est commandité par The Royal Conservatory, situé au 273 Bloor
Street West, Toronto (Ontario) M5S 1W2. Ni YouTube ni Vimeo ne participent et ne commanditent le
Concours.
