I am writing to request an extension to file an expert report reply to the Ecojustice expert report that deals with ‘existing rights’. In the ordinary course, our reply would be due Thursday of this week. We are putting together a paper that we anticipate will help us and the Commission make the legal framework created by NUPPAA more accessible and understandable to participants in the Commission’s process. Unfortunately this one has fallen behind schedule. We would like to continue to refine the paper because a confusing or inaccurate filing could do more harm than good. We think the planning process would be well served by the addition of the paper, and we do not think anyone would be significantly prejudiced by a delay in filing. The paper attempts to explain the statutory regime that already exists – it does not present any information that is truly “new”. Additionally, with the upcoming meetings between NTI, the GN, the IPGs and Canada on NUPPAA related issues, that might be a forum in which we might refine the way the paper expresses the framework in the Act. Therefore we respectfully request an extension until January 31. This is a realistic schedule that allows for discussion at the workshop to feed back into the paper if appropriate, and for finalization and translation to occur after the workshop. If the Commission considers that extension too long, then we respectfully request a shorter extension, but in any case no earlier than January 19. Thanks in advance for considering this request.
