This document is intended as useful information for applicants.
Given varying call requirements and specificities, the replies included in this document cannot and
do not replace or overrule the information contained in the respective Guidelines for grant applicants
that are published for each call for proposals.
They also do not substitute the provisions in the Practical Guide to Contract Procedures in External
Actions. In case of discrepancy between the FAQ and the Guidelines for grant applicants, the latter
is the only legally binding document.

1) Eligibilité du demandeur et des partenaires / Eligibility of applicants and partners

Il est écrit dans les critères d'éligibilité que "la personne morale doit être
antérieurement enregistrée à la date de publication du présent appel sur le site..."
Or un peu plus loin il est écrit : "l'enregistrement préalable de PADOR pour le
présent appel à proposition est non-obligatoire..." Sachant que mon association de
droit privé qui oeuvre dans la production et la création théâtrale n'est pas enregistrée
sur le site de l'Europe, je voudrais savoir si je suis tout de même éligible et si je jeu
en vaut la chandelle de poursuivre le processus de remplissage du formulaire de
candidature.

Is it optional to have such partners included in the application or is it mandatory for
this grant to have a specific working partner in another ACP country other than the
one in which the applying organization is based?

Partnership is compulsory and must comply with the requirements specified in the
Guidelines. (Cf. Guidelines 2.1.1 Applicants, and 2.1.2 Partnerships and eligibility
of partners)

Q
We are a European NGO and would like to submit a proposal for Mozambique,
Swaziland and Brazil. Actions in Brazil would only be in limited number and
intended to the benefit the ACP countries (i.e. Brazil as a model for Mozambique)
Partners would be from 2 from the ACP states and 1 from Europe and a Brazilian
entity would be an associate. Is that ok?

In the interest of equal treatment of applicants, the Contracting Authority cannot
give a prior opinion on the eligibility of an applicant, a partner, an action or specific
activities. (Cf. Guidelines 2.2.4)

In the partnership, the number of entities from ACP countries must always be
higher than the number of entities from other countries.

I seek clarification on whether our organization would be eligible as an
“international organization”. Our organization […] is a formally constituted, notfor-profit international organization – the Constitution of the organization is
international in its remit, the board and the membership are international in their
composition, there are regional chapters in all continents, and the organization has
staff members located in Africa, Latin America, Europe and the Pacific. The
Secretariat is based in Sydney, Australia, and the company is registered in Australia.

In the interest of equal treatment of applicants, the Contracting Authority cannot
give a prior opinion on the eligibility of an applicant, a partner, an action or specific
activities. (Cf. Guidelines 2.2.4)
“International organization” means international public sector organizations set up
by intergovernmental agreements, and specialized agencies set up by such
organizations. These organizations may have worldwide or regional scope.
Organizations created under national law are not considered international
organizations (e.g. national NGO with several regional/country offices).

My organization would like to submit a proposal for Lot 1, however we would need
some clarification. In the Guideline it states, 'For actions supporting film/audiovisual
production, the applicant must annex the following complementary documents to the
application form:
How plan was to have the script for a documentary developed in first year of project,
as it will be a participatory process involving scripts writers and anthropologists. Is
this not acceptable?

For actions supporting film/audiovisual production, the complementary documents
listed in chapter 2.2.1 of the Guidelines are required and must be sent together with
the application form.

Suite à votre appel à projet ACPCULTURES+, nous souhaiterions connaître vos
disponibilités quant au financement possible de la création d'un centre culturel à
Bruxelles, pouvant accueillir des activités artistiques basées sur des collaborations
Nord-Sud avec l'Afrique ?

Afin de garantir un traitement équitable des demandeurs, l’Administration
contractante ne peut pas donner d’avis préalable sur l’éligibilité d’un demandeur,
d’un partenaire, d’une action ou d'une activité spécifique. (Cf. Lignes directrices
2.2.4)
Tout projet dans les domaines du cinéma et audiovisuel (Lot 1) ou des autres
industries culturelles (Lot 2) peut être proposé. Les actions proposées doivent
répondre aux objectifs spécifiques de l'appel et peuvent porter sur les secteurs de la
production/création, distribution/promotion, formation/professionnalisation et/ou de
la réglementation. Une liste indicative des activités est fournie dans les Lignes
directrices. (Cf. Lignes directrices, points 1.2 Objectifs du programme et priorités et
2.1.3 Éligibilité des actions : pour quelles actions une demande peut-elle être

présentée ?)
Un nombre limité d’activités peuvent être mises en oeuvre dans des pays non-ACP,
dès lors que ceci est clairement justifié et que l’activité bénéficie aux pays ACP. (Cf.

Posso apresentar uma proposta ao programa ACP-UE, para um ou mais festivais de
cinema em Angola, Cabo-Verde ou Brasil? Como posso saber os países
contemplados no Programa?
A fim de garantir a igualdade de tratamento dos requerentes, a Administração
Contratante não pode formular um parecer prévio quanto à elegibilidade de um
requerente, de um parceiro, de uma acção ou de actividades específicas. (Cf.
Orientações destinadas aos requerentes, § 2.2.4)
Todas as acções propostas no âmbito do programa ACP Cultures+ devem enquadrarse nos objectivos específicos e respeitar os critérios de elegibilidade relativos aos
requerentes, às parcerias, aos tipos de acções e aos custos. As acções podem incidir
nos
sectores
da
produção/criação,
distribuição/promoção,
formação/
profissionalização e/ou da regulamentação.
As acções devem ser realizadas num ou mais países ACP, cuja lista figura no Anexo
F (do qual o Brasil não faz parte). Pode ser realizado um número limitado de
actividades nos países não ACP, desde que tal seja claramente justificado e que a
actividade beneficie os países ACP.

du décret XXX de rendre opérationnel l'Institut National d'Action culturelle avec la
participation des pays francophones de la sous-région XXX. Il formera des
professionnels cadres moyens de la culture. Pouvez-vous nous dire si ce projet est il
éligible?

3) Contrats / Contracts

My doubts mainly concern:
1. The partners should be from at least two different African or pacific countries,
right?
2. One partner can be a multimedia small enterprise?
3. What is expected from a partner concerning funds' management? The partner is
expected to be given funds to accomplish their tasks and being in charge of managing
it? Or, the applicant is responsible to manage all the funds, including those budgeted
by a partner?

3. The applicant is directly responsible for the preparation and management of the
action with any project partners and therefore has the role of coordinator. If selected,
the applicant becomes the grant Beneficiary and contracting party. The grant is paid
to the Beneficiary, who alone shall be accountable to the Contracting Authority for
the implementation of the Action. The partners participate in designing and
implementing the action, and the costs they incur are eligible in the same way as
those incurred by the Beneficiary (Cf. Guidelines, Annexes G1/G2 (Special
conditions, art. 7.2) and Annex II (General conditions, art. 1.1 to 1.3)). The
Beneficiary is responsible for any payments made to the partners and ensures that the
partners respect the applicable conditions.

Est-ce que le demandeur peut attribuer une somme d’argent provenant de votre
subvention à son partenaire ou à son associé pour la réalisation d’activités qui font
partie du projet, dont le partenaire ou l’associé est en charge ? Est-ce que les
partenaires peuvent émettre des factures au demandeur pour la réalisation des actions
qui font partie du projet ?

Les associés participent effectivement à l’action mais les coûts qu'ils encourent ne
sont pas éligibles à l’exception des frais de voyage et de séjour. Les coûts encourus
par les partenaires sont éligibles au même titre que ceux encourus par le bénéficiaire
de la subvention. (Cf. Lignes directrices 2.1.2 Partenariats et éligibilité des
partenaires)
La facturation implique une prestation de services par des contractants (aussi
désignés "sous-traitants") pour lesquels s'appliquent les règles de passation de
marchés énoncées à l’annexe IV du modèle de contrat de subvention. Toutefois,
l'exécution par des contractants ne peut concerner qu'une portion limitée des activités,
l’essentiel de l'action devant être mis en oeuvre par le Bénéficiaire et ses partenaires.

Les partenaires ou les associés ne peuvent pas être des sous-traitants.

4) Soumission de la proposition / Submission of the proposal

I am writing to ask you some information on the registration in PADOR. In the
Guidelines it is said that prior registration in PADOR is not mandatory. However,
one of the data to be provided by the partners is the EuropeAid ID- given after an
organization registers in PADOR. I assume that organizations should register
themselves in PADOR, since they have to provide this information.

For the present call for proposals prior registration in PADOR is not required.
Therefore the EuropeAid ID is not mandatory.

We are a Barbados based film company seeking to submit a proposal in your current
open call I would be grateful if you might advise on the rules for funding TV series.
Is there a minimum of episodes, duration, format etc. that might or might not be
considered?

There is no specific requirement as to the number of episodes, duration, format of TV
series or any other audiovisual production.

Q
I have a question concerning the own funding (20%). Should it be divided into all
partners and coordinator (so among 3 organizations) or can the lead partner only
(European partner) bear the costs of own funding, as the organizations from West
Africa, which are supposed to be partners, are not so financially strong?

are referring to "Article 14 of the General Conditions to the Standard Grant Contract
(see Annex G of the Guidelines)".

Please explain: The list of Concept Notes will be reduced in accordance to the
ranking to those whose sum of requested contributions amounts to at least twice the
available budget for this Call for Proposals, taking into account the indicative
financial envelopes foreseen by lot

The indicative budget for this call is € 14.8 million. The evaluated Concept Notes
will be put on an ascending list according to the rank of the total score obtained by
each. The list will terminate once the added total of the grants requested reaches the
amount of € 29.6 million. (Cf. Guidelines 1.3 Financial allocation provided by the
Contracting Authority; 2.3.1 Opening and administrative checks and concept note
evaluation)

In order to remove any doubt we would be grateful if you would inform us of the
following:

1. Would a project proposal for a TV Series fall into the category of 'grants for
production/postproduction of films' or 'other grants'? Ie- if a contract was awarded
would it follow Annex G1 or Annex G2?
2. How do you specifically evaluate section 1.4 of the evaluation grid (stable and
sufficient sources of finance)?

1. Annex G1 applies for production/postproduction actions in the audiovisual field
including TV series.
2. In the grant application form (Annex A), the applicant is required to provide
information relative to its resources including the profit and loss account and balance
sheet of the organization, the financing sources and the number of staff. (Cf.
Guidelines Annex A, 3.3.3. Resources)
