74 rue Jean Bleuzen 92177 Vanves Cedex Tél. 0 173 173 434 www.audiens.org 2015 The Conges Spectacles Fund was set up, in compliance with Articles D.7121-30 et seq. of French employment law, to provide a paid holiday service to artists and technicians in the performing arts who have not been employed continuously by a single employer during the twelve months prior to their holiday request, irrespective of the employee’s tax domicile and the type of employment contract (general law or customary fixed-term contract, etc.) The employers stipulated in Articles D.7121-28 and D.7121-29 of French employment law are bound to subscribe to the Fund, which particularly applies to all impresarios, film studios, and TV/radio production and communication companies, irrespective of whether such activities are their main, secondary or occasional line of business, and regardless of their legal status (company, association, etc.). Live performance employers bound by the Guso scheme must send their declaration forms directly to Guso. If any employees have not yet been registered with the Congés Spectacles Fund, they can download a registration form from the www.audiens.org website or apply for registration by post. In respect of foreign employees, the employer is responsible for their registration. The employer must issue the employee with a certificate of employment when engagement ends. For activities in progress on 31 March, two certificates should be issued - the first for the period ending 31 March, the second for the period commencing 1 April. * * * * Your holiday request must be submitted every year, at least two weeks before your holiday, and must be duly completed, including the expected commencement date for your holiday. Do not enclose your certificates of employment, Guso copies or payslips. All periods of work recorded for your account will give rise to the corresponding holiday pay. You can review the activities recorded under your account on our website at www.audiens.org in the “Work Periods” section. When you receive your clearance certificate, if you find that certain work periods were not taken into account, it is your responsibility to send us the employment certificates, the Guso sheets or copies of the corresponding pay slips. A new authentication procedure has been implemented and you can access our virtual management system to manage your account which allows you, among other things, to submit your holiday request online. You will be prompted to enter your email address and a secret question/answer. When logging into the website, you must enter your Congés Spectacles registration number and your secret code. Retraite Assurance de personnes Action sociale Médical Congés payés Services aux professions If you are registered for the online record management service, you will receive email notification that : - the sums declared to the inland revenue are online, - your holiday request is online; you must complete it at least two weeks before the expected commencement date of your holiday, - the items constituting your confirmation of payment are online, which can then be printed off. If you do not wish to fill in your holiday request online, your holiday request form will automatically be sent to you at the end of March, at the same time as the sums declared to the inland revenue. If you have not received holiday pay for the previous year, you may ask for a form either by email as of 1 April or you may contact us 24 hours a day on our website, indicating your Congés Spectacles registration number and the allocated secret code ; * * * * The reference period for calculating holiday pay is from 1 April of one year to 31 March of the following year. Holidays can be taken from 1 May following the reference period. Upon leaving your job, if your employers do not give you a certificate of employment, you should ask them to issue one in the six months following your departure. In case of refusal, inform the Fund immediately. If the company that employed you is subject to a winding-up or liquidation order, ask the official receiver or liquidator to issue you with a certificate of employment and forward this to us immediately. Otherwise, notify us immediately of your period of work. In terms of paid leave, you are entitled to 2.5 daysper 24 days worked orservices for which you have received compensation (articles L.3141-3 etc. of the FrenchLabour Code) for which you receive gross benefits corresponding to10% of the holiday basis amount declared during the reference period. * * * *
