OFFICIAL SELFIE PHOTO CONTEST RULES
“My Pet and I” (the “Contest”) 1.
CONTEST PERIOD
The Contest begins on October 1st, 2014 at 10:00 a.m. (EST) and ends on October 31,
2014 at 11:00 a.m. (EST) (the “Contest Period”).
2.
ELIGIBILITY
2.1
The Contest is conducted by Bio Biscuit Inc. (“Bio Biscuit”) and is open to all legal
residents of Canada who have reached the age of majority where they reside, subject to
the provisions of section 2.2.
2.2
Entrants are not eligible to participate in the Contest if they are: (a) employees, agents or
representatives of Bio Biscuit or any of its affiliates, subsidiaries, related companies,
advertising or promotional agencies, or assignees; or (b) a member of the immediate
family of any of the aforementioned parties and the persons with whom they are
domiciled (for the purpose of the Contest Rules, “immediate family” means spouse,
parents, siblings and children, whether or not they reside in the same household).
3.
ENTER THE CONTEST
3.1
To enter the Contest:
3.1.1
Visit the following Facebook page:

3.1.2
Select the “Selfie Contest / Concours selfie” tab;
3.1.3
Click on “Like”;
3.1.4
Choose a picture of your pet and you (the selfie), fill out the entry form
with your title, full first name and last name, language, and email address;
3.1.5
Declare that you have read and accept the Contest Rules;
3.1.6
Click on “Enter contest” before the end of the contest to automatically
enter the Contest;
3.1.7
Participation limit: there is a limit of one entry per person per day.

PRIZE
4.1
There will be one (1) prize available to be won, consisting of one 5-pound food bag or
one 2.5-pound Oven-Baked Tradition cat food bag (the “Prize”). For more information,

4.2
Prize must be accepted as described in these Contest Rules and may not, in any case,
be in whole or in part transferred to another person, replaced by another prize or
exchanged for cash, unless otherwise agreed by Bio Biscuit.
4.3
Bio Biscuit reserves the right to award a prize (or portion thereof) of the same kind and
of equivalent value or, at its sole discretion, the cash value of the Prize (or portion
thereof) as indicated in the Contest Rules.
4.4
The winner will be responsible for all costs, charges or expenses not explicitly mentioned
in the Contest Rules.
5.
PRIZE DRAW
5.1
At the end of the month, the participant whose photo received the highest amount of
votes through the last month will be selected as a winner. The drawing will be held on
October 31, 2014 at 11:00 a.m. (EST) at the offices of Bio Biscuit, located at 5505,
Trudeau Street, Suite 15, St-Hyacinthe QC J2S 1H5. The Prize will be shipped to the
Prize winner by FedEx.
5.2
The selected participant must comply with the terms of these Contest Rules.
5.3
A representative of Bio Biscuit will contact the selected participant by telephone or by email, at the sole discretion of Bio Biscuit, within 7 days of the draw. If a selected
participant is reached by e-mail, he/she must reply in accordance with the instructions
given in the e-mail, as the case may be. In the case of the return of an e-mail prize
notification as undeliverable, Bio Biscuit will have the entire discretion to disqualify the
participant’s entry or to try to reach him/her by phone. The Prize may only be claimed by
the person registered for the Contest.
5.4
If the selected person cannot be reached within 7 days following the draw or does not
accept the Prize, he/she shall be disqualified and another draw will be held for the Prize
winner, in accordance with the Contest Rules, until a participant is selected and declared
the Prize winner. In such a case, the same terms and conditions will remain applicable
and will be adapted as necessary, as the case may be. Bio Biscuit is not responsible for
a selected eligible entrant’s failure to receive notification for any reason whatsoever.

CONDITIONS OF PARTICIPATION
By participating in this Contest, the participant agrees: (a) to be bound by the Contest
Rules; (b) to be bound by the decisions of Bio Biscuit, which shall be final and binding in
all respects subject to applicable federal, provincial and municipal laws and regulations;
(c) to sign and return the consent and declaration forms that Bio Biscuit will provide
him/her by mail, fax or e-mail to the effect that he/she has fulfilled all the requirements of
these Contest Rules, and return it to Bio Biscuit for them to receive it within seven (7)
days of its receipt.
7.
USE OF PERSONAL INFORMATION
By participating in the Contest, participant: (a) grants to Bio Biscuit and its affiliates and
subsidiaries the right to use his/her personal information for the purpose of administering
the Contest, including but not limited to contacting and announcing the winner; (b) grants
to Bio Biscuit and its affiliates and subsidiaries the right to use his/her name, place of
residence and pet photo, without further compensation or notice, for publicity and
promotional purposes relating to the Contest in any and all media now known or herafter
devised including the Internet; (c) acknowledges that the Bio Biscuit may disclose his/her
personal information to third-party agents and service providers in connection with any of
the activities listed above; (d) permits Bio Biscuit to use and share his/her information
with its subsidiaries and affiliates in order to promote to the participant services or
products that may be of interest to him/her. Personal information collected in connection
with the Contest will be used by Bio Biscuit in accordance with its privacy policy
available at www.ovenbakedtradition.com/en/terms-of-use.
8.
LIMITATION OF LIABILITY
Bio Biscuit will not be liable for: (a) any incorrect or inaccurate information, whether
caused by the Contest Web page users or by any equipment or programming associated
with or utilized in the Contest or by any technical or human error which may occur in the
processing of entries in the Contest (b) any error, omission, interruption, deletion, defect
or delay in operation of the contest website or any transmission in connection with the
Contest; (c) any communications line failure, theft, destruction or unauthorized access
to, or alteration of, entries; (d) any problems with, or technical malfunction of, any
telephone network or lines, computer on line systems, servers or providers, computer
equipment, software, or failure of e-mail which may occur for any reason whatsoever,
including technical problems or traffic congestion on the Internet or at any website
combination thereof; or (e) any damage to participants’ materials in this Contest. If the
Contest is not capable of running as planned for any reason, including infection by
computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or
any other causes beyond the reasonable control of Bio Biscuit which corrupt or affect the
administration, security or proper conduct of this Contest, Bio Biscuit reserves the right
at its sole discretion to, without advance notice, terminate or suspend the Contest, in
whole or in part, or modify it in any way.

GOVERNING LAW
The Contest is subject to applicable federal, provincial and municipal laws and
regulations and is void where prohibited by law.
10.
DISCREPANCIES
The terms and conditions of the Contest Rules shall prevail in the event of any
discrepancy or inconsistency between the terms and conditions of the Contest Rules
and disclosures or other statements contained in any Contest related materials
including, but not limited to, the Contest entry form.

12.
GENERAL CONDITIONS
12.1
Bio Biscuit reserves the right to terminate the Contest if circumstances beyond its control
prevent the Contest from being continued and it shall not be held liable in such an event.
12.2
Bio Biscuit reserves the right to disqualify a person or to cancel one or several entries of
a person who participates or tries to participate in this Contest by using methods that do
not comply with these Contest Rules or that are unfair to other participants (e.g. entries
exceeding the authorized limit).
12.3
Any attempt to deliberately damage the Contest web site and/or any related web site or
to sabotage the legitimate conduct of this Contest constitutes a violation of civil and
criminal laws. Should there be any such attempts, Bio Biscuit reserves the right to reject
the participant’s entries and obtain legal or equitable relief under applicable laws.
12.4
In no event shall Bio Biscuit be required to award more prizes than indicated in these
Contest Rules or to award a prize otherwise than in compliance with these Contest
Rules.
12.5
Persons who enter or try to enter this Contest release the Released Parties from any
liability for damage these said persons may incur as a result of their entry or their
attempt to enter the Contest.
12.6
This promotion is in no way sponsored, endorsed or administered by, or associated with,
Facebook. You are providing your information to Bio Biscuit and not to Facebook. By
participating in this promotion you agree to a complete release of Facebook from any
claims.
12.7
In case of discrepancy between the French and English versions of these rules, the
French version will prevail.
4 RÈGLEMENTS OFFICIELS DU CONCOURS PHOTO SELFIE « Mon animal et moi » (le « Concours ») 1.
PÉRIODE DE CONCOURS
Le Concours débute le 1er octobre 2014 à 10 h (HNE) et se termine le 31 octobre 2014
à 11 h (HNE) (la « Période de concours »).
2.
ADMISSIBILITÉ
2.1
Le Concours est organisé par Bio Biscuit Inc. (« Bio Biscuit») et est ouvert à tous les
résidents du Canada qui ont atteint l’âge de la majorité dans la province ou le territoire
où ils résident, sujets aux dispositions du paragraphes 2.2.
2.2
Les personnes ci-après ne sont pas admissibles à participer au Concours : (a) les
employés, mandataires ou représentants de Bio Biscuit ou de l'une ou l'autre de ses
affiliés, filiales, sociétés apparentées, agences de publicité ou de promotion, ou
cessionnaires ainsi que les membres du jury; ou (b) les personnes avec qui l'une ou
l'autre des parties susmentionnées est domiciliée ainsi que les membres de sa famille
immédiate (aux fins des Règlements de concours, la « famille immédiate » signifie le
conjoint, les parents, le frère, la sœur et les enfants, qu'ils vivent ou non sous le même
toit).

PARTICIPATION
3.1
Pour participer au Concours:
3.1.1

3.1.2
Rendez-vous sur l’onglet “Selfie Contest / Concours selfie”;
3.1.3
Cliquez sur « J’aime »;
3.1.4
Sélectionnez une photo de votre animal de compagnie et vous, et
remplissez le formulaire électronique, en indiquant votre titre, prénom,
nom de famille, langue et adresse courriel;
3.1.5
Cochez la case correspondant à l’énoncé qui consiste à avoir lu et
consenti aux règlements du concours;
3.1.6
Cliquez sur « Participer au concours » avant la fin du Concours pour
automatiquement être inscrit au Concours;
3.1.7
Limite de participation: il y a une limite d’une participation par personne
par jour.

PRIX
4.1
Il y a un (1) prix à gagner au total, consistant un sac de nourriture Oven-Baked Tradition
de 5 livres pour chiens ou un sac de 2.5 livres pour chat (le « Prix »). Pour toute

4.2
Le Prix doit être accepté tel qu'il est décrit dans ces Règlements de concours et ne peut,
en aucun cas, être transféré, en tout ou en partie, à une autre personne, ni substitué par
un autre prix ni payé en argent, sauf si autorisé par Bio Biscuit, à sa seule discrétion.
4.3
Bio Biscuit se réserve le droit de substituer le prix ou toute partie de ce dernier, pour
quelque raison que ce soit, contre un prix ou une partie de prix de valeur équivalente ou
supérieure, y compris, sans s’y limiter et à son entière discrétion, un prix en argent

Le gagnant sera responsable de tous les frais et dépenses qui ne sont pas
expressément mentionnés dans le présent règlement.
5.
TIRAGE DU PRIX
5.1
À la fin du mois, le participant dont la photo aura reçu le plus de votes au cours du mois
écoulé sera sélectionné comme gagnant du Prix. La sélection aura lieu le 31 octobre
2014 à 11 h (HNE) dans les bureaux de Bio Biscuit situés au 5505, rue Trudeau, local
15, St-Hyacinthe QC J2S 1H5. Le Prix sera envoyé par FedEx au gagnant admissible.
5.2
Pour être déclarées gagnantes, les personnes sélectionnées doivent respecter les
modalités de ces Règlements de concours.
5.3
Un représentant de Bio Biscuit communiquera avec le participant sélectionné par
téléphone ou par courriel, à la seule discrétion de Bio Biscuit, dans les 7 jours suivant le
tirage. Si la personne sélectionnée est jointe par courriel, elle devra répondre
conformément aux instructions qui seront fournies dans le message, selon le cas. Dans
le cas où une notification du prix par courriel serait retournée en tant que message non
reçu, Bio Biscuit, à son plein gré, pourra disqualifier la participation ou tenter de joindre
le participant par téléphone. Le prix peut seulement être réclamé par la personne ayant
participé au concours.
5.4
Si la personne sélectionnée ne respecte pas l’une ou l’autre des modalités de ce
Règlement, ne peut être jointe dans les 7 jours suivant le tirage ou refuse le Prix offert,
elle sera disqualifiée et un autre tirage du Prix aura lieu, jusqu’à ce qu’un participant soit
sélectionné et déclaré gagnant du Prix ou, à la seule discrétion de Bio Biscuit, annuler le
prix. Dans le cas d’un nouveau tirage, les mêmes modalités demeureront applicables et
seront adaptées au besoin, selon le cas. Bio Biscuit n’est pas responsable du fait qu’un
participant admissible sélectionné ne reçoive pas d’avis, pour quelque motif que ce soit.

CONDITIONS DE PARTICIPATION
En participant à ce Concours, le participant accepte tous les énoncés suivants : (a)
d'être lié par les Règlements de concours; (b) d'être lié par les décisions de Bio Biscuit,
lesquelles sont finales et exécutoires à tous les égards et sujettes aux lois et règlements
fédéraux, provinciaux et municipaux applicables; (c) de signer et de retourner les
formulaires de consentement et de déclaration que Bio Biscuit lui fera parvenir par la
poste, par télécopieur ou par courriel voulant que le participant ait satisfait les exigences
de ces Règlements de concours, et de retourner ces documents à Bio Biscuit dans les
sept (7) jours suivant leur réception.
7.
UTILISATION DES RENSEIGNEMENTS PERSONNELS
En participant à ce Concours, le participant : (a) autorise Bio Biscuit et ses filiales et
sociétés affiliées à utiliser ses renseignements personnels aux fins de l'administration du
Concours, incluant, mais sans s'y limiter, contacter et annoncer les gagnants; (b)
autorise Bio Biscuit et ses filiales et sociétés affiliées à utiliser son nom, son lieu de
résidence, la photo partagée de son animal de compagnie, sans rémunération
supplémentaire ou avis, à des fins promotionnelles et publicitaires reliées au Concours,
dans tout média quel qu'il soit, connu maintenant ou ultérieurement, y compris l'Internet;
(c) autorise Bio Biscuit d'utiliser et de partager ses renseignements personnels avec ses
filiales et sociétés affiliées afin de promouvoir des produits ou services qui pourraient
intéresser le participant, sujets à l'autorisation du participant; et (d) divulgue les
renseignements à Bio Biscuit seulement, lesquelles informations seront utilisées
conformément aux modalités contenues dans les présents Règlements. Les
renseignements des participants obtenus dans le cadre du Concours seront utilisés par
Bio Biscuit conformément à sa politique de confidentialité disponible à
www.ovenbakedtradition.com/conditions-dutilisation.
8.
LIMITES DE RESPONSABILITÉS
Bio Biscuit se dégage de toute responsabilité découlant de : (a) toute information
incorrecte ou erronée pouvant être causée par les utilisateurs de la page Web du
Concours, par tout équipement ou toute programmation de l’équipement reliée au
Concours ou utilisée pour le Concours ou par toute erreur technique ou humaine étant
survenue au cours du traitement des participations; (b) toute interruption, tout délai,
toute erreur ou toute perte pouvant être causés, en tout ou en partie, par la transmission
de toute information visant la participation au concours; (c) toute défectuosité de la ligne
de transmission ou tout dommage ou toute perte des informations saisies relativement
au Concours; (d) tout problème ou mauvais fonctionnement causé par le réseau ou les
lignes téléphoniques, par les systèmes informatiques en direct, par les serveurs ou
fournisseurs, par toute composante informatique, tout logiciel ou toute défaillance de
transmission des courriels qui pourrait survenir, pour toute raison, incluant les problèmes
techniques ou de congestion du trafic sur Internet ou sur tout site Web ou une
combinaison des deux; ou (e) tout dommage à la documentation du participant durant le
Concours. Si le déroulement du Concours n’est pas en mesure d’avoir lieu comme prévu
pour toute raison, y compris le dommage causé par un virus informatique, un bogue,
une altération, une intervention non autorisée, une fraude, une défectuosité technique
ou toute autre cause hors du contrôle de Bio Biscuit, laquelle aurait un effet sur
l’administration, la sécurité ou le bon fonctionnement du Concours, Bio Biscuit se
7 réserve le droit, à son seul gré et sans avis préalable, de cesser le Concours, en tout ou
en partie, ou de le modifier de quelque façon que ce soit.
9.
LOI APPLICABLE
Le Concours est régi par les lois et règlements fédéraux, provinciaux et municipaux
applicables et il est nul là où il est interdit par la loi.
10.
PRÉSÉANCE DES RÈGLEMENTS DE CONCOURS
Les Règlements de concours auront préséance en cas de divergences entre les
Règlements de concours et toutes divulgations ou autres énoncés contenus dans tout
matériel relié au Concours, incluant, mais sans s'y restreindre, le formulaire de
participation du Concours.

RÈGLEMENTS OFFICIEL

12.
CONDITIONS GÉNÉRALES
12.1
Bio Biscuit se réserve le droit de mettre fin au Concours si des circonstances
indépendantes de sa volonté empêchent la tenue du Concours et Bio Biscuit ne pourrait
être tenue responsable dans un tel cas.
12.2
Bio Biscuit se réserve le droit de disqualifier un participant ou d'annuler une ou plusieurs
participations d'une personne qui participe ou qui tente de participer au Concours à
l'aide de méthodes non conformes aux Règlements de concours ou injustes envers les
autres participants (p. ex., nombre de participations excédant la limite autorisée).
12.3
Toute tentative visant à endommager délibérément la page Web du Concours et/ou tout
site Web relié au Concours ou toute tentative visant à saboter le cours légitime du
Concours constitue une infraction aux codes civil et criminel. Dans les cas de telles
tentatives, Bio Biscuit se réserve le droit de rejeter les participations concernées et de
prendre des mesures légales en vertu des lois applicables.
12.4
En aucun cas, Bio Biscuit ne peut être tenue de décerner plus de prix que les
Règlements du concours l'indiquent ou de décerner un prix autrement qu'en conformité
aux Règlements de concours.
12.5
Les personnes qui participent ou qui tentent de participer à ce Concours dégagent les
Parties quittancées de toute responsabilité à l’égard des dommages que ces personnes
pourraient subir à la suite de leur participation ou de leur tentative de participation au
Concours.
12.6
Ce concours n’est aucunement commandité, approuvé, administré ou organisé en
association avec Facebook. Les participants conviennent qu’ils fournissent des
renseignements personnels à Bio Biscuit et non à Facebook.
