London Eco-Roof Manufacturing Inc. warrants that, within Canada, under normal atmospheric conditions (which excludes any other corrosive or aggressive
atmospheres such as those contaminated with chemical fumes or salt spray) for a period of fifty (50) years after the date of delivery the Galvanized® steel
substrate will not as the result of corrosion, fail structurally, perforate or rupture and for a period of thirty (30) years after the date of delivery the
Polyester Mat paint film will not:
a) Crack, check or peel (lose adhesion). This does not include minute fracturing, which may occur in proper fabrication of the steel.
b) Chalk in excess of ASTM D-4214-07 method AD 659 number (6) rating.
c) Change colour more than (9.0) Hunter ΔE units as determined by ASTM method D-2244-02. Colour change shall be measured on an exposed painted
surface that has been cleaned of surface soils and chalk and the corresponding values measured on the original or unexposed surface. It is understood that
fading or colour changes may not be uniform, if surfaces are not equally exposed to the sun and elements.
d) Cut edges are covered by guarantee for up to 10 years
TERMS AND CONDITIONS
This warranty is subject to the following terms and conditions:
1. The steel roofing which fall under this warranty are defined as Pre-painted Polyester Mat Series, Galvanized Steel Roofing manufactured by London Eco-Roof Manufacturing
Inc. and erected in Canada.
2. This warranty applies to non-vertical panels only when they are erected in such a manner that they have an adequate degree of pitch from the horizontal so as not to allow
free standing or accumulation of water.
3. Damage to the panels caused directly or indirectly by panel contact with fasteners is not covered by this warranty. The responsibility for selection of suitable long-lasting
fasteners rests solely with the Buyer.
4. Steel shavings or minute particles from sawing sparks that come into contact with the pre-painted finish is not covered by this warranty.
5. Minor hairline cracking of the pre-painted finish surface of the steel roofing and siding panels is not covered by this warranty.
6. Minor color variances between separate orders are not covered by this warranty.
7. Damage to the panels resulting from edge corrosion or failure of the metal substrate is not covered by this warranty.
8. Defects or damage to the pre-painted finish of the steel roofing, after delivery by London Eco-Roof Manufacturing Inc. , resulting from handling, shipping, transit, processing,
improper storage or installation, or prolonged moisture contact or contact with corrosives and/or similar materials are not covered by this warranty.
9. Damage resulting from Abnormal atmospheric conditions is not covered by this warranty, the term Abnormal atmospheric conditions includes but is not limited to hail,
exposure to salt, high pressure water spray, corrosive or harmful chemicals (whether solids, liquids or gases), animal excréments or airborne contaminants.
10. This warranty does not apply to damage caused by acts of God, falling objects, external forces, explosions, fire, riots, civil commotions, acts of war, excessive radiations, or
other such similar or dissimilar occurrences beyond London Eco-Roof Manufacturing Inc.
11. The steel roofing pre-painted finish is not warranted under non-uniform conditions of exposure or use.
12. The buyer shall inspect material received from the Seller prior to installation so as to mitigate expenses involved in repairing, repainting or replacing defective panels.
13. Claims under this warranty must be made in writing to London Eco-Roof Manufacturing Inc. at the address set forth below within 30 days after discovery
of the defect. London Eco-Roof Manufacturing Inc. shall then have a reasonable opportunity to inspect the steel roofing panels before any further action shall be taken.
14. To be effective, the buyer shall include in all claims under this warranty adequate identification of materials involved in the claim, including
original invoice.
15. If it is determined by London Eco-Roof Manufacturing Inc. upon inspection, that a claim for a defective pre-painted finish on steel roofing is valid, the remedy for the claim
shall be at the sole discretion of London Eco-Roof Manufacturing Inc. and shall be limited to refinishing or replacing of the non conforming panels as should result in providing
the prorated performance remaining under the original guarantee for the non conforming panels.
16. London Eco-Roof Manufacturing Inc. SHALL NOT BE LIABLE FOR ANY LOSSES. DAMAGES OR EXPENSES WHETHER DIRECT, INDIRECT, OR CONSEQUENTIAL, CAUSED BY OR
RESULTING FROM THE USE OF DEFECTIVE OR NON CONFORMING STEEL ROOFING AND SIDING PANELS OR FOR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND
THE TOTAL LIABILITY OR London Eco-Roof Manufacturing Inc. IS EXPRESSLY LIMITED TO THE PURCHASE PRICE OF THE STEEL ROOFING AND SIDING PANELS. Without limiting
the generality of the foregoing, this warranty pertains to product only, and the seller shall not be liable for damages for or relating to labour or loss of use of structure or damage
to the contents of structure.
17. The express warranty stated herein is the exclusive warranty applicable to the pre-painted finish on steel roofing. London Eco-Roof Manufacturing Inc. MAKES NO
GUARANTEES EITHER EXPRESSED OR IMPLIED BEYOND THE FACE HEREOF AND WITHOUT LIMITATION ALL WARRANTIES AS TO FITNESS AND OR MERCHANTABILITY ARE
RESTRICTED TO THE EXPRESS TERMS HERE OF. Moreover, additional liabilities upon the rights and remedies of the Seller contained in such documents as purchase order or
order acknowledgments which may subsequently be exchanged between parties shall have no force upon this guarantee. All proposals, negotiations and representations, if any,
made prior to or with reference hereto are merged herein.
18. London Eco-Roof Manufacturing Inc. extends this warranty solely to the Buyer, this warranty is non-transferable and non-assignable.
19. London Eco-Roof Manufacturing Inc. reserves the right to terminate or modify this warranty except with respect to orders which it has already accepted
upon the giving of written notice thereof.

London Eco-Roof Manufacturing inc. garantie qu’au Canada, pour une période de cinquante (50) ans après la date de livraison que ces produits en aciers
galvanisés sous des conditions atmosphérique normal (ce qui exclu toute condition atmosphérique contenant des produits corrosifs, des acides et polluant tel que
ceux contenu dans les fumées émanant des usines de produits chimiques ainsi que le sel contenu dans l’atmosphère) ne se déformeront pas, ne perforeront pas
et ne se rompront pas à cause de la rouille et qu’elle garantie pour les trente (30) années suivant la livraison que, la peinture en polyester mat :
a)ne craquera pas, ne pellera pas (perte d’adhésion), ne se raillera pas. Cela exclu toute fracture de l’acier galvanisé qui pourrait se produire lors de la fabrication
du produit.
b)ne deviendra pas poreux au-delà de la norme acceptable à ASTM D-4214-07 calculé selon la méthode AD659 niveau (6)
c)ne changera pas de couleur à plus de (9.0) Hunter  E unités tel que déterminé par la méthode ASTM D-2244-02. Le changement de couleur doit être mesuré
sur une surface exposée, nettoyée de toute saleté de surface et de porosité en comparaison avec une surface originale ou non exposée. Il est entendu que les
changements de couleur ou le palissement peuvent ne pas être uniforme, si les différentes surfaces ne sont pas également exposées au soleil et aux éléments.
d)les bords coupées sont couvert par la garantie jusqu’à dix (10) ans de la livraison.
TERMES ET CONDITIONS
Cette garantie est soumise aux termes et conditions suivants :
1)Les pièces de toit en acier galvanisé couvertes par la présente garantie sont définis comme des produits (panneaux de toit et lambris) en acier galvanisé
Pré-Peint Polyester Mat, pour toiture et manufacturés par London Eco-Roof Manufacturing inc. pour installation au Canada.
2)Cette garantie s’applique seulement aux panneaux vendus par un revendeur autorisé.
3)Les panneaux doivent être installés par un installateur certifié.
4)Lorsque les panneaux sont installés, ils doivent avoir un degré d’angle suffisant de manière à s’assurer qu’ils ne sont pas en position horizontal ou permettant
une accumulation d’eau ou de neige, ni en position vertical.
5)Tous les dommages aux panneaux galvanisés causés directement ou indirectement par le contact entre lesdits panneaux et les systèmes d’ancrage ne sont
pas couverts par cette garantie. Il est de la responsabilité du client de faire l’acquisition de la quincaillerie pour l’ancrage des panneaux; ceux-ci devront être de
qualité pour conserver une durée de vie à long terme.
6)La garantie ne couvre pas toute égratignure ou bris découlant de la coupe des panneaux d’acier galvanisé incluant les particules d’aciers qui sont évacués lors
de la coupe ou qui viendrait en contact avec les panneaux d’acier galvanisé pré-peint.
7)Les craquelures mineures apparaissant sur le fini pré-peint des panneaux en acier galvanisé pour le toit et les lambris ne sont pas couvert cette garantie.
8)Les variations de couleurs mineurs entre (2) commandes ne sont pas couvertes par la présente garantie.
9)Tout dommage aux panneaux d’écoulant d'une corrosion des côtés des panneaux, ou lambris, ou d’un défaut de fabrication du substrat d’acier galvanisé n’est
pas couvert par la présente garantie.
10)Tout dommage ou défaut aux produits vendus après la livraison par Londres Eco- Roof Manufacturing Inc., résultant de la manipulation, le transport, le transit,
le traitement, l’entreposage, une mauvaise installation, ou le contact prolongé avec de l'humidité, avec des substances corrosives ou des produits similaires ne
sont pas couverts par cette garantie.
11) Tout dommage découlant de conditions atmosphériques en dehors de la normal ne sont pas couverts par la présente garantie. La définition de condition
atmosphérique anormale inclut toute exposition au sel, à des jets d’eau sous haute pression, des produits corrosifs ou chimiques (qu’il soit solide ou liquide ou
sous forme de gaz), excrément d’animaux ou tout autre contaminant contenu dans l’air.
12) Cette garantie ne s'applique pas aux dommages découlant de cas de force majeure, force extérieur, d’objets venus du ciel, d’explosions, d’incendies,
d’émeutes, d’événements civils, d’actes de guerre, des radiations excessives ou tout autre acte similaire ou non similaire et en dehors du contrôle de London Eco
Roof Manufacturing inc.
13)Les panneaux d’acier galvanisé pré-peint ne sont pas garantis pour les utilisations dans des conditions d’expositions ou d’utilisation, qui ne sont pas
uniformes.
14)L’acheteur se doit d’inspecter tout matériel reçu du revendeur avant l’installation, afin de limiter les frais liés à la réparation, la peinture ou le remplacement
des pièces défectueuses.
15)Toute réclamation sous cette garantie doit être envoyée par écrit à la compagnie London Eco-Roof Manufacturing inc. à l’adresse de la compagnie dans les
trente (30) jours suivant la découverte de tout bris ou défaut de fabrication. Sur réception, London Eco-Roof Manufacturing inc. se réserve le droit d’inspecter les
panneaux défectueux avant que toute décision ou action ne soit entreprise.
16)Toute réclamation doit être accompagnée des documents d’achat originaux incluant, le modèle, la marque, le numoré de commande et tout autre document
permettant d’identifier les produits défectueux.
17)Si suite à la vérification faite par London Eco-Roof Manufacturing Inc., il est décidé que la demande soumise à la garantie de London Eco-Roof Manufacturing
Inc. est approuvée. Celle-ci se réserve le droit à sa seule discrétion soit de remplacer ou de réparer le produit défectueux, soit de repeinturer le panneau
défectueux, le tout de manière à permettre que la garantie s’applique aux produits vendus au client de façon proportionnel au restant de la garantie applicable
aux produits vendus.
18)LONDON ECO-ROOF MANUFACTURING INC. NE POURRA ÊTRE TENUE RESPONSABLE TOUT DOMMAGE OU FRAIS QU’IL SOIT DIRECT OU
INDIRECT OU DÉCOLLANT CAUSÉ PAR OU RÉSULTANT DE L’UTILISATION DÉFECTUEUSE OU NON CONFORME DES PANNEAUX D’ACIER
GALVANISÉS OU POUR TOUTE AUTRES DOMMAGES DIRECT OU INDIRECT OU DÉCOULANT DE L’UTILISATION DES PRODUITS VENDU PAR LONDON
ECO-ROOF MANUFACTURING INC., ET EN TOUT ÉTAT DE CAUSE, LA RESPONSABILITÉ DE LONDON ECO-ROOF MANUFACTURING INC. ET LIMITÉE
AU PRIX D’ACHAT DES PRODUITS VENDUS, TELS QUE LES PANNEAUX DE TOIT ET LES PANNEAUX DE REVÊTEMENT OU PANNEAUX À LAMBRIS
D’ACIER LÉGER OU D’ACIER. Sans limité la généralité de ce qui précède, cette garantie s’applique seulement aux produits vendus, et le vendeur ne pourra être
tenu responsable de tout dommage découlant ou en relation aux travaux effectués, perte de structurelle ou dommages au contenu ou à la structure.
19)La garantie expresse formulée ici est la garantie exclusive applicable au produits pré-peint en acier galvanisé pour le toit ou pour les panneaux de revêtement
vendus par London Eco-Roof Manufacturing inc. ou ses revendeurs, London Eco-Roof Manufacturing inc. ne fait aucune autre représentation ou garantie
expresse directe ou indirecte et est la seule garantie quant à la garantie légale à l’effet que les produits sont exemptes de vices pouvant en affecter la qualité ou
leur utilisation, qui les rends impropre à l’usage auxquels ils sont destinés ou en diminue l’utilité ou en affecte la qualité. De plus, toute responsabilité ou
réclamation découlant des droits et remèdes contenus à la convention d’achat, au bon de commande ou toute autre entente qui peuvent avoir été ou seront
échangés entre London et son revendeur n’auront aucun impact sur la présente garantie. Toute proposition, négociation, ou représentation, qu’elle soit faite
avant, pendant ou après et concernant la présente garantie devra être faite par écritpour en faire partie ou amender la présente.
20)London Eco-Roof Manufacturing inc. garantie le produit entre les mains de l’acheteur original et cette garantie est non transférable.
21)London Eco-Roof Manufacturing inc. se réserve le droit de modifier et de mettre fin à la présente garantie sous réserve des commandes en cours et
acceptées en donnant un simple à cet effet.
22)Cette présente garantie est soumise aux lois de l’Ontario et tout litige en découlant devra être présenté devant les tribunaux de Mississauga, Ontario.
23)Le préambule fait partie intégrale des présentes.
