The Urban Municipality Act, 1984

TO THE HONOURABLE
THE LIEUTENANT GOVERNOR IN COUNCIL
The undersigned has the honour to report that:
1 Sections 4, 6 and 7 of The Urban Municipality Act, 1984 provide,
in part, as follows:
4(1) The persons within a resort area in a rural municipality
may apply to the minister, by petition in accordance with the
other provisions of this section, to have the resort area
incorporated as a resort village if the resort area contains:
(a) 100 or more persons who would be electors of the
proposed resort village if it were incorporated or who are
dependent children of such persons and resident with them;
and
(b) 50 or more separate dwelling units or business premises.
(2) The petition mentioned in subsection (1) is to be in the
form prescribed by the minister, to be accompanied by a map or
plan showing in detail the boundaries of the proposed resort
village and to contain:
(a) the signatures of at least 30 persons who would be
electors of the proposed resort village if it were incorporated;
and
(b) the name and address of a person residing within the
proposed resort village who will undertake on behalf of the
petitioners all further communications with the minister
respecting the petition.
(3) On receipt of a petition, the minister shall appoint a
person to canvass the area of the proposed resort village and
make a list of:
(a) those persons who would have been electors of the
proposed resort village if it had been incorporated and an
election had been held on the day on which the petition was
submitted to the minister; and
(b) all separate dwelling units and business premises within
the boundaries of the proposed resort village.
(4) The minister shall provide the person mentioned in
clause (2)(b) with a copy of the list prepared pursuant to
subsection (3) and shall require that person to:
(a) publish at least once each week for two successive weeks
in a newspaper circulating in the area of the proposed resort
village; and
(b) personally deliver or send by ordinary mail to:
(i) all persons included on the list prepared pursuant to
subsection (3); and
(ii) the council of the rural municipality and the boards of
the school divisions within which the proposed resort
village is situated;
a notice, in the form prescribed by the minister, stating a
time, not less than four weeks from the day on which the
notice is last published, delivered or sent, by which objections
are to be filed with the minister against the incorporation of
the resort village.
(7) If an objection is filed with the minister within the time set
out in the notice described in subsection (4), the minister may
order that a public meeting be held to discuss the proposal to
incorporate the resort village...
(9) The minister may, in his discretion, order that a vote of
those persons who would, on the day the vote is taken, be
electors of the proposed resort village if it were incorporated be
taken on the question of the incorporation of the resort village.
(10) ... if a vote has been held pursuant to this section and a
majority of those voting vote in favour of the incorporation of the
resort village, the minister shall recommend to the Lieutenant
Governor in Council that the resort village be incorporated.
6(1) The Lieutenant Governor in Council may, by order,
incorporate a resort village ... if its incorporation is recommended
by the minister pursuant to section 4...
7 In making an order pursuant to section 6 incorporating an
urban municipality, the Lieutenant Governor in Council ...
shall:
(a) declare the urban municipality to be incorporated, assign
a name to it and describe its boundaries;
(b) state the day on which the order becomes effective;
(c) fix a day, hour and place for the nomination day for the
election of a council, which day may be prior to the effective
date of the order;
(d) appoint a person to act as the returning officer for the
election;
(f) fix a day, hour and place for the first meeting of the
council; and
(g) include any other provisions the Lieutenant Governor
in Council considers necessary to facilitate the incorporation
of the municipality and...
2 Persons within the resort area known as the Resort Area of Leslie
Beach in the Rural Municipality of Foam Lake No. 276 have applied
to the Minister of Municipal Affairs, Culture and Housing, to have
the resort area incorporated as a resort village.
3 A public meeting was held on October 3, 1998, to discuss the
proposal.
4 On April 24, 1999, a vote was held on the question of the
incorporation of the resort village; 197 persons voted in favour and 29
were opposed.
The undersigned, therefore, has the honour to recommend that
Your Honour’s Order do issue pursuant to sections 4, 6 and 7 of The
Urban Municipality Act, 1984:
(a) declaring the Resort Village of Leslie Beach to be
incorporated having the boundaries described in the attached
schedule;
(b) fixing the effective date of this Order as July 1, 1999;
(c) fixing the nomination day for the election of a council for
the Resort Village of Leslie Beach as Saturday, June 5, 1999,
between 9:00 a.m. and 4:00 p.m. at the Leslie Beach office at the
Resort Area of Leslie Beach, Saskatchewan;
(d) appointing Emily Kreuger of Foam Lake, Saskatchewan
to act as the returning officer for the election;
(e) fixing the day, hour and place for the first meeting of the
council as Tuesday, July 6, 1999 at 7:00 p.m. at the Leslie Beach
office at the Resort Village of Leslie Beach, Saskatchewan; and
(f) requiring the Council of the Resort Village of Leslie Beach
to enter into an agreement with the Leslie Beach Recreational
Co-operative Limited (owner of all lands in the resort village)
setting out their respective authorities, responsibilities and
liabilities with respect to the provision of municipal services in
the resort village.

SCHEDULE
The boundaries of the Resort Village of Leslie Beach shall comprise
the territory in the Province of Saskatchewan lying within:
(1) Township 33, Range 11, West of the 2nd Meridian and described
as:
(a) the west half of Section 7;
EXCEPTING: all those portions of the fractional southwest
quarter section including the boat launch cement pads located
on the main beach, as measured and shown outlined in green on
Schedule “A” (forming part of a land lease agreement between
the Leslie Beach Recreational Co-operative Limited and the
Fishing Lake Regional Park Authority), and ordered by the
Minister of Saskatchewan Environment and Resource
Management on February 11, 1999 to be the boundaries of the
Fishing Lake Regional Park.
The portions of the section described in this schedule include the
adjoining south and west road allowances, intersections thereof and
widenings thereto by plan of survey.

MRO 341/99 A 139. Union Pacific Resources Inc. has submitted
an application to drill an off-target well due to topographical features
within the target area. Pursuant to section 27 of The Oil and Gas
Conservation Act, permission is granted to drill an off-target well to
produce from the Medicine Hat Sand located in legal subdivision 7 of
Section 15-16-28 W3M, subject to the following:
1 The daily allowable will be calculated without penalty.

MRO 342/99 A 140. Merit Energy Ltd. has submitted an application
to drill an exploratory off-target gas well to verify seismic
interpretation. Pursuant to section 27 of The Oil and Gas Conservation
Act, permission is granted to drill an off-target gas well to produce
from the Viking/Success Sand located in legal subdivision 3 of
Section 2-26-28 W3M, subject to the following:
1 The net productive area used in calculating the daily allowable
shall be determined in accordance with subsection 30(1) of The Oil
and Gas Conservation Regulations, 1985.

MRO 343/99 A 141. Enron Oil Canada Ltd. has submitted an
application to drill an off-target gas well due to surface obstruction
within the target area. Pursuant to section 27 of The Oil and Gas
Conservation Act, permission is granted to drill an off-target gas well
to produce from the Milk River Formation located in legal subdivision 1
of Section 13-18-26 W3M, subject to the following:
1 The daily allowable will be calculated without penalty.

Corporation to drill and complete one horizontal well in the Bakken
Sand underlying the north-east quarter of Section 16-31-27 W3M, in
accordance with plans filed with Saskatchewan Energy and Mines as
Document No. H.W. 741 and subject to the following:
1 Good production practice is approved.

SALT LAKE LLOYDMINSTER SAND POOL —
WATERFLOOD MODIFICATION
MRO 347/99. Pursuant to section 17.1 of The Oil and Gas
Conservation Act, approval is granted to Renaissance Energy Ltd. to
modify a waterflood project in the Salt Lake Lloydminster Sand Pool.
Permission is granted to construct the facilities and recomplete the
well at 4-23-39-25 W3M as a pressure maintenance water injection
well, in accordance with plans filed with Saskatchewan Energy and
Mines as Document No. P.M. 690.

MONTMARTRE AREA-RED RIVER FORMATION —
HORIZONTAL WELL PROJECT EXPANSION
MRO 348/99. Pursuant to section 17.1 of The Oil and Gas
Conservation Act, approval is granted to Tri Link Resources Ltd. to
drill and complete one horizontal well in the Red River Formation
underlying the south-east quarter of Section 21-13-11 W2M, in
accordance with plans filed with Saskatchewan Energy and Mines as

JAVA WEST CANTUAR SAND POOL
MRO 349/99 PO 23. Pursuant to section 17 of The Oil and Gas
Conservation Act, MRO 509/98 PO 18, dated June 25, 1998, is
rescinded and the following provisions shall apply to the drilling of
vertical oil wells, and production of oil and gas from vertical and
horizontal oil wells in the Java West Cantuar Sand Pool, effective
August 1, 1999:
1 The vertical well drainage unit shall be comprised of one legal
subdivision in a Section and shall contain a maximum of four vertical
wells capable of oil production.
2 Each vertical well shall be located a minimum of:
(a) 150 m from a productive vertical well or the productive section
of a horizontal well; and
(b) 100 m from the pool boundary.

3 Unless otherwise ordered subsequent to August 1, 1999, all wells
shall produce according to good production practice.
4(a) For the first well drilled in each section the operator shall
submit samples of the interval from the top of the Second White
Specks to total depth.
(b) For all subsequent wells drilled in each section the operator
shall submit samples of the interval from the top of the Mississippian
System to total depth.
5 As a minimum requirement, the operator shall run logs to
determine the resistivity, spontaneous potential, porosity and gamma
ray spectra from total depth to surface casing shoe for each well
drilled.

OTHER AREAS — SALT WATER DISPOSAL
MRO 350/99. Pursuant to section 17.1 of The Oil and Gas
Conservation Act, approval is granted to Marathon Canada Limited
to dispose of salt water recovered from oilfield production, by injection
into the Tilston Beds through the proposed well located on legal
subdivision 9 of Section 28-6-34 W1M, in accordance with plans filed
with the Department as Document No. S.W.D. 703 and subject to the
following:
1 Installations shall be subject to the approval of a field
representative of the Department prior to the commencement of salt
water injection and subsequent to any modifications to such
installations.
2 The wellhead injection pressure shall be limited to a maximum
of 9 800 kilopascals (kPa).
3 All injection volumes shall be metered with a Department
approved method.
4 PBTD shall be no greater than 50 metres from the base of the last
perforated interval.
5 The injection packer must be set within five metres of the top set
of disposal perforations.
This approval does not authorize the applicant to dispose of salt
water without the consent of all the mineral owners, other than the
Crown, that might reasonably be adversely affected by such disposal.

MRO 351/99 A 144. Renaissance Energy Ltd. has submitted an
application to drill an off-target gas well due to surface obstruction
within the target area. Pursuant to section 27 of The Oil and Gas
Conservation Act, permission is granted to drill an off-target gas well
to produce from the Second White Specks Formation located in legal
subdivision 13 of Section 15-13-13 W3M, subject to the following:
1 If, after issuing a Public Notice in The Saskatchewan Gazette, no
objections are received, the daily allowable will be calculated without
penalty.
