The decree of the 5th of September. lB85 (Enclosure No. l ), regulates the elections of "Deputes." Enclosure No. 2 relates to the elections of " Senateurs," and annex No. 3 to Munieipal Elections. Il sera ouvert hnit heures du matin. Toutefois, dans les communes ou, pour faciliter aux electeurs l'exercice de leurs droits, il paraitra utile de devancer cette heure, cet effet des arretes speciaux qui seront publies et affiches dans chaque les prefets pourront prendre commune interessee, cinq jours au moins avant la reunion des colleges electoraux. Dans tous les cas, le scrutin sera clos a six heures du soir. Le depouillement suivra immediatement. 5. Le second tour de scrutin, s'il est necessaire d'y proceder, aura lieu le deuxieme dimanche qui suivra le jour de la proclamation du resultat du premier scrutin. a a Consulat de France, a Melbourne. Les 225 senateurs des departements et des colonies sont elus par un college electoral compose des deputes, des consei!lenrs generanx, des eonseilleurs d'arrondissements et des deiegues elus, un par chaque conseil municipal parmi tous les electenrs de la commune (Loi constitntionnelle 24 fevrier 1875, art. 4). Nul n'est elu senateur a l'un des deux premiers tours de scrntin s'il ne reunit :-1°. La majorite absolue des suffrages exprimes. 2° Un nombre des voix egal an quart des electeurs inscrits. An troisieme tour de scrutin, la majorite relative suffit, et en cas d'egnlite de suffrages le plus age est elu (loi constitutionelle, 24 fevrier 1875, article 4, Fr. Loi organique, 2 aout Ul75, art.15.) Les trois tours de scrutin out lieu le meme jour. Le premier scrutin est ouvert a huit heures du matin et ferme a midi. Le second, s'il y a Ueu, est ouvert a deux heures et ferme a quatre heures. Le troisierue, s'il y a lieu, est ouvert a six heures et ferme a huit. No. 3. Loi sur !'organisation municipale, (5 avril, 1884). Art. 15. L'assemblee des Clecteurs est eonvoqnee par arrete du prefet. L'arrete de convocation est publie dans la commune quiuze jours au moins avant !'election, qui doit toujours avoir lieu un dimanche. Il fixe le local ou le scrutin sera ouvert ainsi que les heures auxquelles il doit etre ouvert et ferme. Art. 20. IJe scrutin ne dure qn'un jour. Art. 26. Le president doit constater, an commencement de !'operation. l'heure a laquelle le scrutin est ouvert. Le scrutin ne pent ctre ferme qu'aprc3 avoir ete ou.vert pendant six heures au moins. Le president constate l'heure a laquelle il declare le scrutin clos ; apres cette declaration, aucun vote ne peut etre rC(,JU. Art. 30. Nuln'est elu au premier tour de scrutin s'il n'a reuni :-1°, La majorite absolue des suffrages exprimes. 2°. Un nombre de suffrages egal au quart de celui des clectenrs inscrits. Au deuxieme tour de scrutin, !'election a lieu a la majorite J'elative que! que soit le nombre des Yotants. Si plusieurs candidats obtiennent le meme nombre de suffrages, !'election est acquise au plus age. En cas de deuxieme tour de scrutin, l'assemblee est de droit convoqnee ponr le dimanche suivant. (Publisheil in the" Journal Officiel" of the 8th September, 1885.) 3. The balloting shall be for one day only. It shall be opened at eight o'clock a. m. Nevertheless, in the townships where, in order to afford the electors facilities for the exercise of their rights, it shall appear advantageous to anticipate that hour, the prefects shall have power to issue special notices to that effect, wl1ieh shall be published and posted up in each township interested, at least five days before the meeting of the assembly of electors. In every case the balloting shall be closed at six o'clock p.m. The scrutiny shall follow immediately. 5. The second balloting, if it is necessary to go on ·wi!h it, shall take p!ace on the second Sunday following the announcement of the result of the first balloting. j j 3 No. 2. The 225 Senators of the departments and of the colonies shall be elected by an electoral assembly -composed of the deputies, the councillors general, the district councillors, and of the delegates electeJ, one by each municipal council among all the electors of the Commune.-(Constitutional Law, 24 February, 1875, Art. 4.) No one is electeJ senator on one of the two first ballotings if he does not poll :-1. The absolute majority of the votes given. 2. A number of votes equal to a quarter of the electors enrolled. ·On the third balloting the relative majority is sufficient, and in case of an equality of votes, the elJer man is ·elected.-(Constitutional Law, 24 February, 1875, Article 4.:.-0rganic Law, 2 August, 1875, Article 15.) The three ballotings shall take place on the same day. The first balloting is openeJ at eight o'clock a.m., and closed at midday. The second, if it be taken, is openeJ at two o'clock and closed at four o'clock. The third, if taken, is opened at six and closed at eight o'clock. The results of the balloting are examined by the board anJ published the same day by the President of the Eleetoral Assembly. (Organic Law of .the 2nd August, 1875, Article 14.) No. 3 Law on Municipal Organization, 0 April, 1884. Article 15. The assembly of the electors is convoked by notice of the prefect. The convocation notice is published in the township a fortnight at least before the election, which mnst always take place on a SunJay. He fixes t.he locality where the balloting shall be opened, as well ns the honrs at which it must be opened antl closed. Article 20. The balloting is for one day only. Article 2~. The presiJent must state at the commencement of the proceedings, the hour at which the balloting is opened. The balloting cannot be closed until it has been opened for six hours at least. The president states the hour at which he declares the ballot closed. After this tleclaration no vote can be yeceivetl. Article 30. No one is elected on the first balloting, if he has failed to poll :-1. The absolute majority of the votes given. 2. A nnmber of votes equal to a quarter of that of the electors enrolled. On the second balloting, the election goes by the relative majority, whatever be the number of the voters. If several candidates obtain the same number of votes, the election is gain ea by the eluest man. In case of a _. second balloting, the meeting is July convokell for the following Sunday.
