This report contains a list of titles reviewed by the Prohibited
Importations Unit (PIU), Traveller Border Programs Division, at
Headquarters in Ottawa, during the period April 1 to
June 30, 2011. Titles for which a determination was
rendered in accordance with section 58 of the Customs Act, or
re-determined as per sections 59 and 60 of the Customs Act,
during the stated period are listed, along with the related
decision. Titles are categorized by commodity and listed
alphabetically. Where applicable, additional bibliographical
information has been included.

l’Unité des importations prohibées (l’UIP), Division des
programmes frontaliers pour les voyageurs, à l’Administration

centrale à Ottawa, entre le le 1 avril et le 30 juin 2011.
Les titres pour lesquels une décision a été rendue
conformément à l’article 58 de la Loi sur les douanes ou pour
lesquels une révision a été faite conformément aux articles 59
et 60 de la Loi sur les douanes, durant la période en question,
sont indiqués, ainsi que la décision connexe. Les titres sont
séparés selon le genre de matériel dont il s’agit et sont
présentés par ordre alphabétique. Des renseignements
bibliographiques supplémentaires ont été inclus lorsque
disponibles.
You will note that the report has been divided into three
sections:

1) Section 58 – Determinations: This section lists titles for
which initial classification decisions have been made at
Headquarters in accordance with section 58 of the
Customs Act. Goods are “determined” to either fall within or
outside of the provisions of tariff item 9899.00.00 (obscenity or
hate propaganda).
1) Article 58 – Déterminations : Cette section comprend la
liste des titres pour lesquels une décision de classement
initiale a été rendue par l’Administration centrale,
conformément à l’article 58 de la Loi sur les douanes. Il est
«déterminé» que les biens sont visés ou non par les
dispositions du numéro tarifaire 9899.00.00 (obscénité ou
propagande haineuse).
2) Section 59 – Re-determinations: This section lists
titles that have been previously prohibited under tariff
item 9899.00.00 and which have been the subject of program
monitoring. The re-determination was initiated by the PIU, in
order to ensure that goods have been correctly classified.
2) Article 59 – Révisions : Cette section comprend la liste
des titres préalablement prohibés en vertu des dispositions du
numéro tarifaire 9899.00.00 et pour lesquels une révision a
été effectuée. La révision a été amorcée par l’UIP dans le
cadre du contrôle de programme afin de confirmer la validité
du classement tarifaire.
3) Section 60 – Re-determinations: This section lists titles
that were previously prohibited under tariff item 9899.00.00
and which have been re-determined, at the importer’s request,
by the Recourse Directorate, Appeals Division, as per section
60 of the Customs Act.
3) Article 60 – Révisions : Cette section comprend la liste
des titres préalablement prohibés en vertu des dispositions du
numéro tarifaire 9899.00.00 et pour lesquels une révision a
été effectuée, à la demande de l’importateur, par la Direction
des recours-Division des appels, conformément à l’article 60
de la Loi sur les douanes.
For the purposes of this report, decisions are defined as
follows:
Aux fins de ce rapport, les décisions se définissent comme
suit :
1) Prohibited: Indicates that the material was reviewed and
found to fall within the provisions of tariff item 9899.00.00. Its
importation into Canada is therefore prohibited, that is not
allowed, as it constitutes obscenity or hate propaganda.
1) Prohibé (prohibited) : Indique que le matériel fût révisé et
qu’il est visé par les dispositions du numéro tarifaire
9899.00.00. Son importation au Canada est donc prohibée,
c’est-à-dire interdite, car le matériel constitue de l’obscénité
ou de la propagande haineuse.
2) Admissible: Indicates that the material was reviewed and
found NOT to fall within the provisions of tariff item
9899.00.00. Its importation into Canada is therefore
acceptable, as it does not constitute obscenity or hate
propaganda.
2) Admissible : Indique que le matériel fût révisé et qu’il n’est
PAS visé par les dispositions du numéro tarifaire 9899.00.00.
Son importation au Canada est donc acceptable, c’est-à-dire
permise, car le matériel ne constitue pas de l’obscénité ou de
la propagande haineuse.
This list should only be consulted as a reference guide and
should not be considered an absolute authority. If you have
