The creation of a single European rail market requires to integrate the national safety and interoperability
standards. Since 2006, several Directives, like the ones on interoperability and safety, were adopted
and/or recasted. They all included the introduction of Technical Specifications for Interoperability (TSIs) of
which several ones are highly relevant both for the wagon keepers but also their customers, the Railway
Undertakings (RUs).
Parallel to this evolution the General Contract of Use for rail freight wagons entered into force 1st July
2006 and must be called a success after 3 years application. More than 600 signatories, including all
relevant railway undertakings and wagon keepers in Europe have now joined the GCU. 700 000 rail
freight wagons, the vast majority of the European fleet of rail freight wagons are covered by the GCU. The
GCU is applied to practically all cross-border rail freight traffic and to most domestic rail freight traffic and
provides a standard contract for railways and wagon keepers for the exchange of wagons. Without the
GCU thousands of bilateral agreements between RUs and keepers would be necessary. The GCU
ensures the necessary wagon interoperability for the market actors. Its technical annexes refer to the
TSIs and complement them. The knowledge of relevant TSIs is a must for RUs and wagon keepers.
On May 14 a Memorandum of Understanding (MoU) has been signed by important EU Member States to
introduce the concept of the “Entity in Charge of Maintenance” (ECM). It l establishes the basic principles
of a common system of certification of entities in charge of maintenance for freight.
All these initiatives will have a direct impact on the business and the operations of wagon keepers and
railway undertakings.
After 3 years of experience with both, EU Directives, TSIs but also the GCU, and in the light of the
introduction of the ECM principle, UIP, AFWP, ERFA and BEWAG will discuss with you the experience

La création d’un marché ferroviaire européen unique nécessite l’intégration des normes nationales de
sécurité et d’interopérabilité. Depuis 2006, plusieurs directives, comme celles de l’interopérabilité et de la
sécurité, ont été adoptées ou revues. Toutes comportaient l’introduction de Spécifications Techniques
pour l’Interopérabilité (STI). Parmi elles plusieurs concernent particulièrement aussi bien les détenteurs
de wagons que leurs clients, les entreprises ferroviaires.
Parallèlement à cette évolution, le Contrat Uniforme d’Utilisation pour wagons de fret est entré en vigueur
le 1er juillet 2006. Après trois ans d’utilisation, il peut être considéré comme une réussite. Plus de 600
signataires, y compris toutes les entreprises ferroviaires importantes et les détenteurs de wagons en
Europe, ont maintenant rejoint le CUU. 700 000 wagons de fret, l’immense majorité le la flotte
européenne des wagons de fret sont maintenant couverts par le CUU. Ce dernier est appliqué dans
pratiquement tous les transports ferroviaires de fret transfrontaliers et dans la majorité des transports
ferroviaires de fret nationaux et il offre aux entreprises ferroviaires et aux détenteurs de wagons un
contrat standard pour l’échange des wagons. Sans le CUU, des milliers d’accords bilatéraux entre les EF
et les détenteurs seraient nécessaires. Le CUU garantit l’interopérabilité nécessaire des wagons pour les
acteurs du marché. Ses annexes techniques se réfèrent aux STIs et les complètent. La connaissance
des STI concernées est un must pour les EF et les détenteurs de wagons.
