Le Datavideo HS-2800 est un studio mobile HD de 8 ou 12 canaux, il est
conçu pour être utilisé sur le terrain. Ne laissez pas sa taille vous tromper, cette
machine compacte vous offre un plein écran multi vues de 17,3", un mélangeur
de production de 8 ou 12 canaux, et un intercoms 8 canaux avec interface
Tally. Avec deux PiP, deux DSK et diverses autres options, cet appareil est aussi
flexible que vous en avez besoin pour vos productions de terrain.
Le Datavideo HRS-30 est la dernière génération d'enregistreurs mobiles de
terrain. Cet enregistreur fonctionne avec disques durs SSD, enregistrement en
MXF et MOV dans différents débits, avec un moniteur de direction parfaitement clair et net de 10,1". Sur la face arrière, vous trouverez un montage pour
batterie, le rendant ainsi encore plus pratique sur le terrain.
Datavideo vous offre un prix spécial limité sur ce pack de production. Le prix
normal pour ce pack est 10425 € HT, mais nous avons une offre limitée pour

Généralités
1.1 Toute commande ou vente des produits commercialisés par DATAVIDEO France est soumise aux présentes conditions générales de vente, dont l'acheteur
affirme avoir pris connaissance et qu'il déclare accepter expressément et sans réserve , nonobstant ses propres conditions générales d'achat. Toute
modification des présentes conditions générales de vente devra faire l'objet d'une acceptation écrite, préalable et expresse de la part de DATAVIDEO France.
1.2 Les présentes conditions générales de vente prévalent sur toute clause différente ou contraire figurant dans les documents ou la correspondance de l'acheteur,
en ce compris ses propres conditions générales d'achat.
1.3 DATAVIDEO France se réserve le droit de modifier à tout moment ses conditions générales de vente , sans aucun préavis.
1.4 Le fait que DATAVIDEO France ne se prévale pas à un moment donné de l'une quelconque des stipulations des présentes conditions générales de vente ne
peut être interprété comme valant renonciation à s'en prévaloir ultérieurement.
1.5 Si une stipulation des présentes conditions générales de vente est déclarée nulle, illégale ou inapplicable , en tout ou en partie, les autres stipulations
demeureront en vigueur.
1.6 Toute erreur ou omission dans la documentation commerciale , site web , offre, liste de prix, facture ou autre document fourni par DATAVIDEO France est soumis
à correction sans aucune responsabilité de la part du vendeur.
2.
Ouverture de compte
2.1 L'ouverture d'un compte ne peut être effectuée que sur production du K-bis et du document intitulé "Confirmation du statut de revendeur" .
2.2 Un délai minimum de 10 jour s est nécessaire à la mise en place effective d'un nouveau compte à compter de la réception de la demande et des document
nécessaires (2.1).
3.
Commandes et offres
3.1 Toutes les offres ont une durée de validité de 30 jours à partir de la date de leur exécution . (sauf indication spécifique )
3.2 Pour être considérée comme valable et définitive, toute commande doit être adressée à DATAVIDEO France par écrit, quel qu'en soit le support . Les
commandes négociées verbalement ne pourront être considérées comme valables et définitives qu'après envoi à DATAVIDEO France d'une confirmation
écrite.
3.3 Toute commande est ferme et ne peut être annulée par l'acheteur, sauf acceptation exceptionnelle expresse de DATAVIDEO France donnée par écrit.
3.4 Toute modification de la commande demandée par l'acheteur ne sera prise en considération que si elle est parvenue par écrit à DATAVIDEO France avant
l'expédition des produits.
4.
Livraisons
4.1 La livraison est effectuée soit par la remise directe du produit à l'acheteur , soit par simple avis de mise à disposition, soit par délivrance à un expéditeur ou un
transporteur dans les locaux de DATAVIDEO France ou de DATAVIDEO Europe.
4.2 Les livraisons sont opérées en fonction des disponibilités des produits et dans l'ordre d'arrivée des commandes.
4.3 DATAVIDEO France est autorisée à procéder à des livraisons globales ou partielles, chacune des livraisons partielles devant donner lieu à un paiement à due
concurrence des produits livrés.
4.4 En toute hypothèse, le respect des obligations de livraison de DATAVIDEO France est subordonné à l'exécution conforme par l'acheteur, dans les délais, de ses
obligations.
4.5 Les délais de livraison proposés à la commande sont donnés de bonne foi mais qu'à titre indicatif et n'engagent en aucun cas DATAVIDEO France. Un retard
apporté à la livraison ne pourra justifier ni annulation de commande, ni refus des produits, ni dommages et intérêts, ni pénalités.
4.6 La première livraison est toujours effectuée après un paiement préalable ou contre-remboursement.
6.
Force majeure .
6.1 Les cas de force majeure ou les cas fortuits ou assimilés délient DATAVIDEO France de toute obligation de livrer, sans versement d'une indemnité de quelque
nature que ce soit. DATAVIDEO France tiendra l'acheteur au courant, en temps opportun, des cas de force majeure, cas fortuits ou assimilés.
6.2 Sont notamment considérés comme cas de force majeure, la guerre, l'émeute, l'incendie, les grèves, les accidents, l'impossibilité pour DATAVIDEO France
d'être lui-même approvisionné .
7.
Transport et Assurance
7.1 Les produits voyagent aux risques et périls de l'acheteur dès leur départ des entrepôts ou magasins de DATAVIDEO nonobstant la clause de réserve de
propriété stipulée ci-dessous . Cette clause s'applique également si le transport est effectué par l'acheteur ou un transporteur désigné par lui.
7.2 L'acheteur devra faire constater par le dernier transporteur tous cas d'avarie ou de manquant à l'arrivée et lui notifier ses réserves ou protestations dans les
formes et les délais légaux, conformément à l'article L. 133-3 du Code de commerce.
Le destinataire s'oblige en particulier :
à vérifier au moment de la réception l'état et la quantité des produits en procédant au besoin, en présence du transporteur , à l'ouverture de tout colis ;
à formuler en cas d'avarie ou de manquant, des réserves sur le récépissé de transport en spécifiant la nature et l'importance des dégâts (notamment
bruit de casse, colis endommagé, mouillures, colis manquant etc ....) ;
à confirmer ces réserves par lettre recommandée avec avis de réception adressée au dernier transporteur dans les 3 jo urs ouvrables suivant la livraison, et à
adresser copie de ces réserves à DATAVIDEO France dans le même délai.
Des réserves imprécises ou de caractère systématique telles que «sous réserve de déballage >> ou << sous réserve de contrôle quantité et qualité», apposées
sur le récépissé de transport sont inopposables à DATAVIDEO France.
8.
Réclamations-RMA (Return Material Authorization)
8.1 Sans préjudice des dispositions à prendre vis-à-vis du transporteur, toute réclamation, notamment sur les vices apparents ou la non conformité du produit livré
au produit commandé ou au bordereau d'expédition, doit être formulée à DATAVIDEO France dans les 3 jours de l'arrivée des produits chez l'acheteur ou dans
tout local désigné par l'acheteur ,par lettre recommandée avec accusé de réception.
8.2 Toute demande de doit être déposée par mail : [email protected] et comporter les références précises des conditions d'achat, telles que notamment numéro
de commande, numéro de facture ,code produit, numéro de série, du bon de, document de transport, et description de la réclamation.
8.3 Il appartiendra à l'acheteur de fournir toutes justifications quant à la réalité des vices ou anoma lies constatés. Il devra laisser à DATAVIDEO France toute facilité
pour procéder à la constatation de ces vices et pour y porter remède.
8.4 Le retour des produits par l'acheteur ne sera accepté qu'après que DATAVIDEO France ait donné son accord écrit et préalable. Tout produit retourné sans cet
accord serait tenu à la disposition de l'acheteur et ne donnerait pas lieu à l'établissement d'un avoir ou à un remplacement ou réparation.
8.5 En cas d'accord, les produits seront retournés sous 3 jour s, franco au siège de DATAVIDEO France dans l'état où ils ont été fournis par DATAVIDEO France,
notamment sous emballage d'origine, en parfait état, avec les références précises des factures concernées et la documentation d'origine.
8.6 Les frais et risques du retour sont toujours à la charge de l'acheteur.
8.7 En cas de vice ou d'anomalie constaté par DATAVIDEO France, la réparation sera limitée au remplacement du produit ou composant, à sa réparation ou à son
remboursement au choix de DATAVIDEO France, à l'exclusion de tous dommages et intérêts.
8.8 La responsabilité de DATAVIDEO France ne saurait être engagée après la prise en charge par l'acheteur, en cas de défaut constaté sur le produit imputable à
de mauvaises conditions de stockage chez l'acheteur.

9.
Garantie
9.1 Les produits sont garantis contre tout défaut de matière ou de fabrication pendant une durée de 12 mois à compter de la date de livraison. Le client peut étendre
la période de garantie jusqu'a 24 mois à partir de la date de livraison à condition d'enregistrer ses produits sur le site web de_DATAVIDEO :www . datavideo.info
9.2 La période de garantie de réparation et les pièces sont toutefois limités à 6 mois.
9.3 Les interventions au titre de la garantie ne sauraient avoir pour effet de prolonger la durée de celle-ci.
Au titre de cette garantie, la seule obligation incombant à DATAVIDEO France sera le remplacement gratuit ou la réparation gratuite du produit ou de l'élément
reconnu défectueux par DATAVIDEO France sauf si ce mode de dédommagement s'avère impossible ou disproportionné .
9.4 La garantie ne joue pas pour les vices apparents .
9.5 La garantie ne s'applique pas pour les défauts et détériorations provoquées par l'usure naturelle ou pour tout produit qui aura it été démonté hors des ateliers de
DATAVIDEO France ou qui présenterait des traces de choc, d'immersion , d'utilisation , de conservation ou de traitement non conforme à sa destination ou aux
préconisations d'usager du fabricant.
9.6 La garantie est encore inopérante si le matériel a subi des modifications ou reçu des adaptations d'accessoires non recommandées par le fabricant et sans
l'accord préalable et écrit de DATAVIDEO France.
9.7 La garantie ne peut en aucun cas s'étendre aux conséquences directes ou indirectes d'un défaut et ne couvre pas le préjudice qui pourrait résulter d'une
immobilisation du produit.
10.
Prix
10.1 Les produits sont fournis sur la base des tarifs de DATAVIDEO France en vigueur au jour de la commande , étant précisé que DATAVIDEO France se réserve
le droit de modifier son tarif à tout moment, (sous réserve du respect d'un préavis d'un mois) indépendamment des listes de prix figurant sur les catalogues .
10.2 Les prix s'entendent hors taxe et hors droit.
10.3 Tout impôt, taxe, droit ou autre prestation à payer en application des règlements français ou communautaire , ou de ceux du pays de l'acheteur , sont à la
charge de l'acheteur , de même que tout frais consécutif à des conditions particulières d'expédition telle que notamment envoi express , coursier ou Chronopost,
10.4 Le franco de port est accordé pour tout envoi d'un montant minimum de 500 € HT toutes remises déduites. En dessous de ce montant, une participation aux
frais de port de 30 € HT sera facturée .
11.
Modalités de paiement
11.1 Sauf stipulation contraire acceptée par écrit par DATAVIDEO France. les factures sont payables au siège de DATAVIDEO France, à réception de
livraison par chèque ou virement.
11.3 Le paiement s'entend de l'encaissement effectif du prix à l'échéance convenue . La simple remise de traites ou de tout titre créant une obligation de payer ne
constitue donc un paiement qu'après leur encaissement effectif par DATAVIDEO France, la créance originaire de DATAVIDEO sur l'acheteur subsistant , avec
toutes les garanties qui y sont attachées, y compris la réserve de propriété, jusqu 'à ce que ledit effet de commerce ait été payé.
11.4 Tout défaut ou retard de paiement, total ou partiel, des factures de DATAVIDEO France à leur date d'échéance entraînera de plein droit et sans mise en
demeure préalable l'exigibilité de pénalités de retard égales à une fois et demi le taux de l'intérêt légal en vigueur au jour de ladite échéance , calculées sur le
montant hors taxes impayé, et pourra entraîner , à la seule discrétion de DATAVIDEO France, la suspension immédiate de toute nouvelle livraison jusqu 'à
parfait paiement de l'ensemble des échéances restant à courir et des pénalités de retard.
En outre, tout acompte antérieurement payé par l'acheteur restera acquis à DATAVIDEO France à titre de clause pénale.
11.5 Au cas où l'acheteur serait redevable de sommes trouvant leur origine dans plusieurs factures , les paiements s'imputeront en priorité sur les factures les plus
anciennes .
11.6 Quelles que soient les réserves émises par l'acheteur à réception des produits, notamment en cas de casse , la fraction de la livraison reçue en bon état et
conforme à la commande sera payée au prix convenu et selon les modalités de paiement prévues à la commande.
11.7 Les recouvrements par voie contentieuse donneront lieu à une majoration forfaitaire de 15 % de la créance litigieuse avec un minimum de 500 €
12.
Photos
12.1 Les photos ou images des produits, les dessins , mesures, poids, spécifications techniques, ou couleurs contenus soit dans les sites web , les catalogues ou les
listes de prix peuvent ne pas être identiques aux produits livrés chez le client.
12.2
Aucune différence ne pourra être acceptée pour just ifier l'annulation d'une commande ou les conditions d'un arrangement spécifique .
13.
Transfert de propriété
13.1 DATAVIDEO France se réserve la propriété des produits livrés jusqu 'à paiement intégral du prix en principal et accessoires. L'acheteur s'engage à conserver
en stock dans des conditions garantissant l'absence de détérioration des produits livrés et en individualisant les produits livrés mais non encore payés. En cas
de revente, l'acheteur en informera le sous-acquéreur qui devra s'engager à respecter cette dernière stipulation.
13.2 Jusqu'à complet paiement du prix, l'acheteur n'aura pas le droit de mettre en gage, ni d'utiliser de quelque manière que ce soit les produits livrés comme
garantie. L'acheteur restera toutefois libre de revendre lesdits produits, sauf si cela lui a été expressément interdit par DATAVIDEO France par lettre
recommandée, DATAVIDEO France se réservant cette faculté dés le premier incident de paiement.
13.3 Au cas où les produits livrés auraient été revendus par l'acheteur avant complet paiement de leur prix, l'acheteur s'engage à céder à DATAVIDEO France sa
créance du prix de revente desdits produits à titre de garantie de leur paiement. DATAVIDEO France sera dès lors autorisée à réclamer le paiement
directement au sous-acquéreur à concurrence de sa propre créance.
13.4 En cas de non-paiement par l'acheteur des produits à l'échéance, DATAVIDEO France, sans perdre aucun de ses droits, sera libre de revendiquer les produits
aux frais et risques de l'acheteur . Il en sera de même en cas de cessation de paiements de l'acheteur.
13.5 En outre, DATAVIDEO France pourra unilatéralement et immédiatement faire dresser un inventaire des produits impayés détenus par l'acheteur. L'acheteur
devra agir de manière loyale en procurant à DATAVIDEO France toutes les facilités nécessaires lui permettant de procéder à cet inventaire.
14.
Clause résolutoire
14.1 L'acheteur prendra sous sa responsabilité toutes mesures de nature à assurer le respect des obligations découlant des présentes conditions générales de
vente .
14.2 Le vendeur se réserve la faculté en cas de manquement à l'une des obligations souscrites, et après simple constatation de celui-ci, de procéder
immédiatement à la reprise du produit.
14.3 En outre, faute pour l'acheteur de respecter ses obligations , toutes les ventes que DATAVIDEO France a conclu avec lui et qui n'auraient pas encore été
payées, pourront être résolues de plein droit à l'initiative de DATAVIDEO France , après mise en demeure restée infructueuse, adressée par lettre
recommandée avec avis de réception.
15.
Propriété intellectuelle
En aucun cas, l'exécution des présentes conditions générales de vente par l'acheteur ne saurait lui conférer un quelconque droit direct ou indirect sur la propriété
des marques des produits, logos ou tous autres signes distinctifs afférents aux produits.

16.
Juridiction
16.1 Tout litige relatif à l'exécution ou l'interprétation des présentes conditions générales de vente sera de la compétence exclusive du Tribunal de Commerce de
MEAUX (77), même en cas d'appel en garantie, de pluralité de défendeurs ou de procédure d'urgence ou en référé.
16.2 La présente clause attributive de juridiction prévaut sur toute autre clause contraire portée sur un bon de commande ou sur tout autre document émanant d'un
acheteur de DATAVIDEO France.
16.3 Les divers modes d'expédition ou de paiement n'apportent ni novation ni dérogation à cette clause attributive de jur idiction.
17.
Responsabilité
En tout état de cause et malgré toute disposition contenue dans les présentes Conditions , en aucun cas, le vendeur ne sera responsable par contrat, délit civil
(y compris la négligence ou manquement à des obligations légales) ou de toute autre manière, et quelle que soit la cause de celle-ci, pour toute augmentation
des coûts ou dépenses de toute perte de profit, contrats commercia ux, les recettes ou d'économies anticipées , ou de tout dommage indirect ou consécutif
dommages spéciaux,de quelque nature que ce soit.
18.
Dissolution
18.1 Dans le cas où le Client devient insolvable, est incapable de payer ses dettes à l'échéance , se déclare en faillite,fait l'objet d'une faillite involontaire, a nommé
un séquestre, ou a son actif affecté , le vendeur peut résilier le contrat sans intervention judiciaire , à moins que le récepteur reconnaît les obligations découlant
du présent contrat en tant que dette de la succession.
18.2 Toutes les demandes pour les deux parties deviennent exigibles et payables au moment de la dissolution . Le client sera responsable de tous dommages , y
compris mais sans s'y limiter la perte de profits et les coûts de transport .
19.
Confidentialité
Le vendeur peut transférer vos informations à notre banque ou des tiers aux fins de l'assurance-crédit , en faisant référence agence de recherches de crédit,
contrôle du crédit, l'évaluation et l'analyse, la titrisation et pour protéger nos intérêts. L'identité de notre banque ou de tiers et que de toute les agences de crédit
utilisées par nous seront aisément disponibles sur demande .
20.
Droit applicable
Les présentes conditions générales de vente , ainsi que les actes qui en sont la conséquence ,
sont soumis au droit français, à l'exclusion de la Convent ion
des Nations Unies sur les
contrats de vente internationale de marchandises signée à Vienne le 11 avril 1980.
