SYLLABUS GRADUATE LAW PROGRAM Course title: Introduction to Comparative Law (US/EU) Credits: 3 ECTS credits Teaching language: English Teacher in charge of the course: Aurélien Raccah, PhD, FLD/Université Catholique de Lille Specialist lecturers: Professor MCINTOSH (MC Law, USA) 1) COURSE PRESENTATION Course objective: This course introduces the students to the main issues of the Comparative Law in the USA and in Europe. It gives a broad overview of some current and classical themes of European Union Law. The course is divided in 2 parts, one focused on US Law, the other one on EU & national Law. At the end of the course, the student should be able to: - Understand the US and EU legal systems according to their main characteristics; - Differenciate common law systems from civil law systems; - Know the main public institutions and jurisdictions; - Understand the purpose of legal comparison in the context of the TTIP (US/EU Agreement). Prerequisite: The students shall be at least in 3rd year of law in a European university or having a major in law in an American or any other university. Content: Introduction to International and Comparative Law 1. Comparative law as a component of International Law 2. Comparative Law as legal methodology 3. Comparative Law in EU Law Chapter I Comparison of the national legal orders A. Autonomy of the national legal orders 1. Civil Law versus Common Law 2. The attendance component will be calculated as follows: full attendance 20%, 1 unauthorized absence 10%, 2 unauthorized absences 5%, 3 or more unauthorized absences 0%. Students with 0% attendance will also have their final grades capped at a maximum of B+.
