financière
difficile
depuis
quelques années. Ainsi, les
Malgaches auront à prendre une
décision afin de remettre à flot
cette compagnie. Il faudrait soit
privatiser soit ouvrir le capital
à des partenaires stratégiques.
Dans cette optique, Air Mauritius
compte soumettre une proposition
à Air Madagascar. D’ailleurs, un
appel à expression d’intérêt a
donc été lancé à 25 compagnies
du secteur. Parmi lesquelles figure
Air Mauritius avec laquelle Air
Madagascar entretient des liens
particuliers depuis longtemps.

Pravind Jugnauth, leader du MSM,
confie qu’il passe par des moments
difficiles.
Le leader du MSM, Pravind
Jugnauth a confié qu’il passe
par des moments difficiles au
niveau politique et familial
en ce moment, notamment
parce qu’il attend la date de
son jugement en appel dans
l’affaire MedPoint. Il estime
que sa condamnation à douze
mois de prison dans cette affaire a marqué un tournant
dans sa carrière politique. Il
a déclaré que la vie continue
malgré les obstacles ou les
malheurs. C’était lors d’une
cérémonie organisée à SaintJulien dans le cadre du Shiva-
ji Day (célébré le 1er mai).
Par ailleurs, Pravind Jugnauth dit avoir déjà une
idée de ce qu’il fera après
son jugement d’autant qu’il
a fait comprendre qu’il n’est
pas indispensable. Le leader
du MSM avance que si la
décision de la Cour va dans
une direction, ce sera au
Premier ministre de décider
quoi faire. Mais si la décision va dans une autre direction, il saura ce qu’il fera.
Dans une telle éventualité, dit-il, il agira vite, sans
donner plus de détails.

Jean Maigrot est venu renforcir l’effectif de Xavier-Luc Duval.
Jean Maigrot est le nouveau Senior Adviser au
Premier ministre adjoint
Xavier-Luc Duval. Il prend
officiellement ses fonctions
le 16 mai. Juriste de formation, il est né à Maurice
en 1957. Jean Maigrot a
eu une riche carrière dans
la finance internationale.
Diplômé en droit de
l’université d’Aberystwyth,
au Pays de Galles, il a
notamment travaillé pour
la Société Générale et la
banque
d’investissement
ABN AMRO, l’une des
plus grandes institutions
bancaires des Pays-Bas.
Il a, par ailleurs, organisé
une conférence de haut
niveau à Londres pour promouvoir Maurice comme
plateforme d’investissement
en Afrique, lorsque XavierLuc Duval était ministre
des Finances. Avant de se
joindre au bureau du Premier ministre adjoint, il était

Newsmith Capital Partners,
société
d’investissement
spécialisée dans la gestion
des avoirs, basée à Londres.

Cultural Centre (ICC) continue de faire polémique. Les

entre le Chairman de l’ICC,
et le ministre suivant la mort
de cinq Mauriciens lors du
Hadj, l’année dernière. Sam
Lauthan avait mis en cause
le manque de formation des
pèlerins qui étaient partis
avec des visas supplémentaires obtenus à la dernière
minute grâce à l’intervention
de Showkutally Soodhun.
Et, l’organisation du pèlerinage cette année n’a fait que
creuser davantage le gouffre entre les deux hommes.
Jusqu’à présent, c’était l’ICC
qui s’occupait du dossier
Hadj du début à la fin. Mais
après les remous de l’année
dernière, Sam Lauthan avait
déclaré vouloir imposer plus
de contrôle et de discipline
dans l’organisation de ce
pèlerinage. De plus, le responsable du centre culturel
islamique avait exprimé son
désaccord concernant le fait
que Showkutally Soodhun
ainsi que Dan Baboo, ministre des Arts et la culture,
imposent des personnes
au sein du board de l’ICC.
Sam Lauthan ne cachait pas
sa tristesse à l’idée de quitter son poste. Il a dit qu’en
peu de temps, il a aidé à rehausser le niveau du centre
et le bilan est très positif.
Les projets majeurs qu’il
laisse en gestation sont la
formation des pèlerins et
une formation en leadership
qui devait commencer la semaine prochaine mais il dit
qu’il quitte l’ICC avec la conscience claire et tranquille.

Les chasseurs ne pourront plus avoir plus de deux fusils.
Les chasseurs regroupés
au sein de la Société des
chasseurs de l’île Maurice
ont été déboutés devant le
Privy Council. Ils ne peuvent pas détenir plus de
deux armes à feu à la fois.
C’est ce qu’ont statué les
Law Lords qui ont rejeté,
le lundi 16 mai leur appel.
Selon la communauté des
chasseurs, la ‘Firearm Act’
de 2006 les prive de leurs
droits, et est anticonstitutionnelle. C’est en sep-
tembre 2007 que cette loi
est entrée en vigueur, celle
de 1940 ayant été abrogée.
Elle stipule qu’aucun individu n’est autorisé à avoir
en sa possession plus de
deux armes à feu à la fois.
Mécontente, la Société des
chasseurs a initié des actions en Cour suprême.
Elle a réclamé une injonction perpétuelle interdisant
au commissaire de police
et à l’État d’enfreindre les
droits acquis de ses mem-
bres, et de les priver de leurs
droits de posséder plus de
deux armes à feu. Le juge
de première instance leur
a donné gain de cause.
Le commissaire de police
et l’Etat ont alors interjeté
appel. Le Senior Puisne
Judge d’alors, Keshoe Parsad Matadeen, et le juge
David Chan ont renversé la décision du juge de
première instance. D’où le
recours de la Société des
chasseurs au Conseil privé.

Roshi Bhadain, ministre de la Bonne gouvernance et des Services financiers affirme
que l’aide indienne aidera à financer quatre projets dont Heritage City.

de la Bonne gouvernance
et des Services financiers, a
annoncé que l’Inde accorde
une subvention de Rs 12,
7 milliards à l’île Maurice.
Il avance aussi que c’est la
plus importante subvention
qu’a jamais reçue l’île Maurice d’un autre pays. L’argent
sera utilisé dans quatre projets, dont Heritage City.
L’accord en ce sens avec la
Grande péninsule a déjà été
entériné et l’argent est déjà
disponible depuis mercredi 11 mai, a précisé Roshi
Bhadain. Soulignons que
l’île Maurice n’aura pas à
retourner les Rs 12,7 milliards à l’Inde. Ci-dessous les
projets qui seront financés
par cette somme d’argent.
Heritage
City.
Rs 3,7 milliards iront à
ce projet infrastructurel
qui abritera, entre autres, des ministères, le Bureau du Premier ministre
et l’Assemblée nationale.
Le coût total de ce projet
est estimé à Rs 30 milliards.
Un International Convention Center. Une somme de
Rs 1,8 milliard ira à ce bâtiment qui se trouvera dans
l’enceinte de l’Heritage City.
Ce centre de convention
accueillera
de
grands
évènements
locaux et internationaux.
Une Financial Services City.
Rs 3,6 milliards de la subvention seront utilisées dans ce
projet. Cette nouvelle City
se veut un centre pour les
services financiers et sera
dotée d’un ‘twin towers’.
Un projet qui sera dévoilé
lors du Budget. Rs 3,6
milliards seront utilisées
pour un projet que le Premier ministre dévoilera
lors du prochain Budget.
Traité fiscal
Le haut-commissaire indien affirme qu’il n’a
jamais été question d’émettre une ‘Letter of
Termination’

sur Radio Plus l’opposant au
député mauve Reza Uteem,
jeudi dernier, le ministre
des Services financiers et
de la Bonne gouvernance,
Roshi Bhadain a affirmé
que l’Inde nous a fait comprendre qu’elle est en train
de réviser ses traités avec
tous les pays. Si cette révision n’est pas bouclée avant
le 1er avril 2017 (…) L’Inde
nous servirait une Notice
of Termination of Treaty.
Une décision unilatérale.
Par ailleurs, Anup Kumar
Mudgal s’est aussi expliqué
sur la subvention de Rs 12,7
milliards ; subvention accordée par l’Inde à Maurice.
Il explique que la seule et
unique requête que l’Inde a
formulée au gouvernement
mauricien est de choisir
une compagnie indienne
pour les travaux de construction à Heritage City.

Sithanen
évoque une
irresponsabilité
politique

Rama Sithanen n’a pas
tardé à réagir après l’accord
conclu entre l’Inde et
Maurice sur le DTAA, annoncé par Roshi Bhadain
mardi après-midi. Il a déclaré que c’est la fin de notre Global Business, il dit
qu’il n’aurait jamais pensé
qu’un secteur aussi important allait être bradé… Il
estime aussi que c’est de
l’irresponsabilité économique. Maurice a cédé tous
ses droits de taxation à
l’Inde.  Roshi Bhadain a
sacrifié le Global Business
pour financer un projet
spéculatif, Heritage City. 
Rama Sithanen prévoit
le départ de plusieurs
banques internationales,
qui n’ont plus aucune raison de rester à Maurice.

SAJ a volé au secours du ministre Bhadain.
Malgré ce qu’a déclaré le
ministre de la Bonne Gouvernance et des Services
financiers, Roshi Bhadain,
le Premier ministre, sir
Anerood Jugnauth a pris
sa défense pour dire aux
journalistes présents qu’il
n’a pas menti sur la révision du traité de non double-imposition fiscale entre l’Inde et l’île Maurice.
C’était samedi soir à l’issue
du Gala Diner Afrasia Golf
International Tournament à
Deep-River-Beau-Champ.
Sir Anerood Jugnauth est
catégorique : Roshi Bhadain
n’a jamais dit que l’Inde a
servi une Notice (of Termination of Treaty). Il a dit
qu’il y a eu des ‘menaces’, et
s’il n’y a pas de discussions
entre l’Inde et l’île Maurice
sur le traité fiscal et s’il n’y
a pas de solutions, c’est à ce
moment-là que les Indiens
prendront des actions. Il a
affirmé que Roshi Bhadain
n’a dit aucun mensonge.
Revenant sur la révision du
traité fiscal entre l’Inde et l’île
Maurice, sir Anerood Jugnauth se dit satisfait du résultat que Maurice a obtenu.
Le Premier ministre a fait
ressortir que maintenant
nous devons apprendre à
nous tenir sur nos pieds.
Nous ne pouvons pas tout
le temps comme si dépendre des autres pour survivre.
Il affirme qu’il est entièrement d’accord sur ce qui a
été fait. Le Conseil des ministres a donné son aval et le
gouvernement ira de l’avant.
Il ajoute aussi qu’il n’a aucune crainte quant à la survie
de notre secteur financier.
Il avance que le précédent
gouvernement n’avait pas de
cran pour négocier et arriver
à une conclusion. A noter
que SAJ n’a pas manqué de
critiquer l’ancien ministre
des Finances Rama Sithanen,
après les propos de ce dernier sur la révision du traité
fiscal entre les deux pays.
Le dossier du Métro Léger pourrait devenir une priorité.
Il y a eu beaucoup de critiques sur le projet du
métro léger, mais il paraît que le présent gouvernement a changé d’avis.
Le dossier est actuellement
traité dans la plus grande
discrétion au niveau du Bureau du Premier ministre.
Une source proche du dossier insiste, d’ailleurs, sur le
fait que  le gouvernement
n’a jamais rayé ce projet.  On disait juste que
ce n’était pas une priorité.
D’après les bruits qui circulent, une partie de l’aide Rs
12,7 milliards accordés par
l’Inde à Maurice pourrait
servir à financer ce projet.
Cependant, on avance que
Rs 3,6 milliards sont insuffisantes pour un tel projet.
Il incombera, alors, au
Premier ministre SAJ
d’annoncer cette nouvelle.
Tout semble indiquer que
cette annonce devrait coïncider avec la lecture du
prochain budget, le 6 juin.
Mardi dernier, le ministre
de la Bonne gouvernance,
Roshi Bhadain, avait annoncé que Rs 3,6 
milliards seront utilisées pour
un projet que le chef du
gouvernement
dévoilera lors de la présentation du Budget 2016-17.

Air Mauritius compte soumettre une proposition
à Air Madagascar
Air Mauritius peut devenir un partenaire stratégiques pour Air Madagascar.
La compagnie aérienne malgache se trouve dans une
situation financière difficile
depuis quelques années. Elle
a plus de Rs 2,3 milliards de
dettes. Et pour les autorités
malgaches, il faudrait soit privatiser soit ouvrir le capital à
des partenaires stratégiques.
Des discussions ont démarré
pour permettre à la compagnie d’aviation nationale de
devenir un partenaire stratégique d’Air Madagascar.
C’est ainsi qu’Air Mauritius
La National Transport Authority (NTA), située à Cassis à Port-Louis.
L’affaire de horsepower falsifiés n’en finit pas. C’est le cas
de le dire car un ancien haut
cadre de la National Transport Authority (NTA) serait
impliqué dans une affaire de
piratage. La police s’intéresse
de près aux ramifications
de cette affaire, liée à la falsification de horsepowers.
Tout laisse croire que cet
ancien haut fonctionnaire
aurait, selon le ministère des
Infrastructures publiques,
bénéficié de la complicité
de certains employés de la
NTA pour avoir accès à la
base de données informa-
tiques de l’institution. Le
ministère a de fortes raisons
de croire que ce piratage informatique est lié à l’affaire
de manipulation de horsepower. Au ministère des
Infrastructures publiques,
on fait ressortir que la police et la Cybercrime Unit
enquêtent pour déterminer
qui sont les personnes qui
auraient pu tirer avantage
de ce piratage informatique.
D’après les informations
glanées, les complices de
cet ancien haut fonctionnaire devront, eux aussi,
s’attendre à des sanctions.
Patrice Armance choisi
pour être candidat au poste
de vice-président
d’Air Madagascar constitue
une réelle opportunité.
Quant au gouvernement
malgache, son principal
souci est de faire voler Air
Madagascar dans un ciel
plus clément, car il y va du
développement du tourisme.
A noter que cette compagnie figure sur l’annexe B de
la liste noire européenne et
ne peut donc pas desservir
l’Europe. C’est pour cette
raison qu’elle a loué deux
Airbus A340-300 pour pouvoir desservir l’Europe sous
immatriculation islandaise.
À cela, il faut encore ajouter huit autres appareils de
plus petite taille. Air Madagascar dessert aussi cinq
destinations régionales et 11
destinations domestiques.
Ramgoolam fait part
de ses appréhensions
Les retombées de l’enquête
devraient être connues sous
peu. Rappelons que c’est le
ministre des Infrastructures
publiques, Nando Bodha,
lui-même, qui avait publiquement révélé que la base
de données de la NTA avait
fait l’objet d’un hacking. Le
ministre avait alors évoqué
les failles informatiques dans
le système gouvernemental.
Pour rappel, l’affaire des
documents de horsepowers falsifiés a éclaté en janvier. L’enquête a conduit à
l’arrestation de 33 personnes,
dont une douzaine d’officiers
de la NTA, la majorité étant
des examinateurs. Le 4 mars,
le ministre Nando Bodha
avait invité les propriétaires
de véhicules dont les horsepowers avaient été modifiés
à l’insu de la NTA, à régulariser leur situation. 1 420
personnes se sont rendues
dans les locaux de la NTA.
Seules 253 d’entre elles ont
été régularisées car elles
avaient seulement ‘gonflé’ le
moteur de leurs véhicules.
Youth Caucus du Parlement panafricain
embauché pour cette raison
principalement. Megh Pillay
aurait également rencontré
des hauts officiels malgaches.
Par ailleurs, des techniciens
d’Air Madagascar étaient
récemment à Maurice pour
explorer des zones de collaboration possibles, confie
une source proche du dossier. Il semble que la compagnie d’aviation nationale
ne souhaite pas se lancer
seule dans cette aventure, vu
sa fragilité financière. La solution : un consortium avec
Air Mauritius comme leader.
L’intérêt de la compagnie est
de consolider ses assises dans
la région. Avec l’ouverture
de nouvelles routes sur de
nouvelles destinations, être
un partenaire stratégique

(CEO) d’Air Mauritius, s’est
rendu à Antananarivo, capitale de la République malgache, il y a deux semaines.
Il y a rencontré Gilles Filiatreault, directeur-général
d’Air Madagascar depuis le
2 octobre dernier. Celui-ci
jouit d’une longue expérience en redressement de
compagnies aériennes et a été

Après les opérateurs du
Global Business, c’est au tour
de l’ancien Premier ministre,
Navin Ramgoolam de faire
part de ses appréhensions.
Le leader du PTr intervenait lors d’une conférence de
presse axée sur l’accord sur
le Double Taxation Avoidance Agreement (DTAA),
vendredi 13 mai. Pour Navin
Ramgoolam, il n’y a eu aucune négociation avec l’Inde,
car Maurice n’a fait que céder.
L’Eastern Caucus a
choisi le député du
PMSD et président de
l’aile jeune de ce parti, Patrice Armance
pour être candidat
au poste de viceprésident du Youth
Caucus du Parlement
Navin Ramgoolam a fait
ressortir que l’avantage
que Maurice avait a complètement disparu. Même
les Indiens ont été surpris
qu’il n’y ait pas eu plus de
négociations mais que le
pays ait cédé. L’ancien Premier ministre est allé plus
loin en affirmant que Roshi
Bhadain ne connaît rien
aux négociations et que
SAJ a été tenté uniquement
par l’argent sans se préoc-
panafricain. Les élections auront lieu en
octobre
prochain.
Patrice Armance a
depuis déclaré qu’il
ferait de son mieux
pour servir le caucus
de la jeunesse tout
en remerciant les
cuper des conséquences.
Par ailleurs, le leader du
Parti travailliste a également démenti le ministre
des Services financiers et
de la bonne gouvernance. Il
a souligné qu’à aucun moment Manmohan Singh et
Narendra Modi ont dit que
si Maurice n’accepte pas
l’accord elle aurait eu un
avertissement. Mais Bhadain a craqué et a cédé sur
l’essentiel. Selon l’ancien
Premier ministre, c’est un
acte irresponsable de la part
de SAJ qu’un secteur crucial de Maurice a été vendu
pour de l’argent comptant.
Commentant la situation
dans laquelle se retrouvent
les opérateurs du global
business,
Navin
Ramgoolam affirme qu’ils seront pénalisés. Il a déclaré
que déjà deux compagnies
offshores seront délogées.
C’est un manque de vision.
Il dit qu’il a l’impression
qu’à la fin de sa carrière,
Aneerood Jugnauth mène
une politique de vengeance contre le PTr mais
aussi contre la population.

Traité fiscal avec l’Inde
Des licenciements à prévoir
dans les sociétés offshores
Les
opérateurs
appréhendent le pire pour
le global business. C’est le
cas de le dire après la disparition programmée de
la Capital Gains Tax d’ici
avril 2019 et l’introduction
après mars 2017 d’une taxe
de 7,5 % sur les intérêts en-
grangés par les banques internationales domiciliées à
Maurice. Ceux-ci ont jeté un
froid glacial dans le secteur.
Tim Taylor, Chairman du
groupe Cim, dont le pôle
global business contribue à
hauteur d’un peu plus de 50
% au chiffre d’affaires de ce-
tte société, qualifie la journée
de mercredi de sombre. Il
déclare que même si les autorités indiennes ont donné
une période de transition
pour restructurer le secteur et trouver un nouveau
modèle au global business en
2019, nous allons ressentir
Tim Taylor, Chairman du groupe Cim, s’est montré pessimiste de la situation.

L’inquiétude est partagée par
Rajiv Servansingh, observateur économique. En effet,
il trouve qu’effectivement la
menace est réelle quant à des
pertes d’emplois de qualité
dans ce secteur, fortement
fragilisé par les amendements apportés au traité fiscal. Il explique qu’aujourd’hui
les jeunes universitaires,
qu’ils soient juristes, fiscalistes, comptables ou encore
analystes financiers, trouvent
des débouchés dans le secteur en se faisant embaucher
facilement par des sociétés offshore. Or, à l’avenir,
les choses devront se compliquer. Il y aura des effets
multiplicateurs sur d’autres
secteurs économiques, dans
la mesure où ces jeunes cadres font partie des classes
moyennes, résident dans des
appartements de luxe et font
tourner la consommation.
Couldip Lala, le patron
d’International
Financial
Services (IFS), il attend à des
lendemains difficiles dans
ce secteur. Il dit que la IFS
analyse encore les implications des nouvelles mesures
sur le business model. Mais
d’ores et déjà, il peut dire
qu’il sera difficile d’opérer
dans ce nouveau paysage
qui se profile à l’horizon. Il
ne faut pas compter sur l’IFS
pour recruter de nouveaux
jeunes. Il rappelle qu’une dizaine de management companies réalisent aujourd’hui
80 % des activités du secteur
offshore, contribuant entre
4 % et 5 % au PIB. C’est dire
le poids du global business
dans l’économie mauricienne. Dans le même temps,
il constate qu’une partie de
ces sociétés est tournée vers
le marché indien. Il dit qu’il
y avait un marché à prendre, notamment dans le sillage de la libéralisation de
l’économie indienne. Beaucoup de management companies ont saisi l’occasion
et ont mis des ressources
pour développer ce marché.
Par ailleurs, Couldip Lala
ajoute qu’IFS réalise près de
75 % de son activité avec les
clients indiens. Cela lui a permis de se bâtir une solide réputation sur ce marché après
plus de 20 ans d’existence. Si
Tim Taylor estime que, malgré tout, certaines mesures,
comme le grandfathering,
protègent les investissements existants et qu’un
répit durera jusqu’en avril
2017 pour attirer un flux
d’investissements à Maurice, n’empêche que le pire
surviendra après avril 2019,
quand le pays se retrouvera
sans filet de protection. Avec
notamment les droits de taxation qui vont passer totalement de Maurice à l’Inde. Il
dit qu’on va assister alors à
la morte lente de ce secteur.

la réflexion plus loin.
Il demande s’il n’y a pas
lieu aujourd’hui de forcer
l’Inde à étendre la période de transition à 2025.
Ce qui donnera le temps
nécessaire aux opérateurs
de muscler, voire de restructurer, leurs opérations afin de mieux affronter les nouveaux défis.

Quasi-certitude que les débris
d’avion découverts à l’île Rodrigues
proviennent du vol MH370
Depuis 2005, l’Etat a acquis quatre immeubles à Ebène.
Le gouvernement a investie
pour acheter quatre immeubles à la cybercité d’Ébène
depuis 2005. Un document
révélant cette information
a été déposé à l’Assemblée
nationale, le mardi 10 mai,
après une question posée
par le Chief Whip Mahen Jhugroo, le 26 avril. La
somme de Rs 1 541 938 067
est citée pour l’acquisition
de ces quatre immeubles.
C’est le bâtiment de la société Arushi Development
Ltd, compagnie appartenant
à Rakesh Gooljaury, qui a
coûté le plus cher, soit Rs
588 662 756. Acheté en 2002,
cet immeuble de 14 étages a
une superficie totale de 14
469 mètres carrés. L’achat de
l’immeuble de Rakesh Gooljaury par la SICOM avait
suscité beaucoup de polémiques. L’acquisition avait
été faite avant même que
l’immeuble soit complété.
Actuellement,
plusieurs
étages sont libres alors
que d’autres sont occupés par le ministère des
Services financiers et de
la Bonne gouvernance.
Le gouvernement a aussi fait
l’acquisition de deux propriétés respectivement à Fortius
Ltd et Altius Ltd, de Victor
Seeyave, en décembre 2010.
L’un des bâtiments, qui est de
12 étages et d’une superficie
de 10 000 mètres carrés, a né-
cessité un investissement de
Rs 430 millions. Le second
a, lui, coûté Rs 350 millions.
Il comprend huit étages
avec un espace de 8 100 mètres carrés. C’est un évaluateur privé qui avait fait
l’évaluation des bâtiments.
Ceux-ci sont désormais la
propriété du National Pension Fund. Un immeuble de
six étages (6 134 mètres carrés) a également été acquis
pour la somme de Rs 173
275 311 de la Société Civile Immobilière B&S Court.
Il n’est pas précisé à qui
appartient cette société.
C’est désormais la Financial Services Commission
qui occupe le bâtiment.
Les débris retrouvés à Rodrigues proviennent de la Malaysia Airlines du vol MH370.

découverts à l’île Rodrigues le 30 mars proviennent du vol MH370
de la Malaysia Airlines.
L’information a été relayée
par la BBC jeudi 12 mai.
Il en est de même pour les débris retrouvés à Mossel Bay
en Afrique du Sud en mars.

Bureau et d’autres experts.

après son décollage de Kuala Lumpur, le 8 mars 2014.

Affaire Boskalis
La bataille s’accentue entre Siddick
Chady et Jan Cornelis Haak
Siddick Chady crie au complot.
Mercredi, la Master and Registrar Shameem Hamuth Laulloo a sommé Siddick Chady,
inculpé de corruption, de répondre à plusieurs questions
du témoin Néerlandais, Jan
Cornelis Haak. Entre autres,
il devra dévoiler le montant
de sa rémunération lorsqu’il
était président de la Mauritius Ports Authority (MPA).
Pour rappel, Siddick Chady
avait réclamé des dommages
de Rs 50 millions à Jan Cornelis Haak, le 4 juin 2013, pour
false and malicious allegations. Il se disait victime d’un
complot suivant le témoignage de Jan Cornelis Haak, qui
avait été enregistré en 2012,
à l’hôtel Novotel, à Genève.
Le Néerlandais, représentant la firme Boskalis, avait
incriminé Siddick Chady
en soutenant que ce dernier
avait obtenu des pots-de-vin
afin de favoriser cette firme
en vue de l’octroi d’un contrat
pour des travaux de dragage
du canal Anglais dans le port.
Siddick Chady soutenait que
ce témoignage de Jan Cornelis Haak lui a causé préjudice, et que celui-ci a agi dans
l’illégalité. Toutefois, le Néerlandais avait objecté à cette
plainte de dommages et avait,
par la suite, réclamé que Siddick Chady, par le biais de son
avocat, Me Said Toorbuth, réponde à 100 questions, le 13
mai 2014. Jan Cornelis Haak
avait argué que pour pouvoir
se défendre dans cette affaire
de dommages, on doit obtenir
certaines réponses. Siddick
Chady avait cependant refusé
de répondre à ces questions.
La Master and Registrar a
rendu une décision, mercredi estimant que l’échange de
précisions doit se faire avant
l’ouverture d’un procès, afin
d’éviter des dépenses inutiles. Outre la question sur
son salaire, Siddick Chady
devra expliquer comment
les allégations de Jan Cornelis Haak seraient fausses et
malicieuses. Il devra fournir
des détails précis sur les mots
ou termes exacts employés
par Jan Cornelis Haak pour
prouver que ce dernier l’avait
bel et bien incriminé. Le témoin peut aussi demander
à l’ex-président de la MPA
d’apporter des informations
sur le montant de sa caution
suivant son arrestation et le
moment où il a été relâché
sous caution. Siddick Chady
est également appelé à indiquer s’il fait toujours l’objet
d’une interdiction de quitter
le pays depuis son arrestation.
Par ailleurs, la Master and
Registrar est d’avis que Siddick Chady ne peut pas répondre à toutes les questions.
Certaines sont sans importance, note-t-elle, tandis que
d’autres sont formulées de
telle sorte afin de soutirer des
renseignements en vue de
préparer une ligne de défense.

Gavin Glover, a été arrêté.
Pour rappel, Navin Ramgoolam fait l’objet d’une ac-
cusation provisoire de falsification dans l’affaire BAI.
Dans l’affaire Betamax, ce
sont des accusations provisoires de conspiracy et influencing public official qui
ont été retenues contre lui.

complétée, celle de l’octroi
de terres d’État aux frères
Gowry, aux pandits Sungkur
et Sonu Kumar Jha. L’ancien
Premier ministre fait face
à trois charges provisoires
de ‘public official using
his office for gratification.’
Par ailleurs, Navin Ramgoolam qui répondait aux questions de la presse à sa sortie
en cour de district de PortLouis a confié que son intérêt
est de reconstruire le pays. Il
dit qu’il est attristé par tout
ce qui se passe. Interrogé
sur ses va-et-vient devant la
justice depuis sa première arrestation, il a affirmé n’avoir
aucun esprit de vengeance.
Il a expliqué que ce n’est pas
sa politique de vivre avec
la vengeance et la rancune.
À l’hôpital SSRN
Un médecin en état d’ivresse
se plaint d’avoir été agressé
par un autre collègue
Il y a eu une violente altercation entre deux médecins
à l’hôpital SSR, Pamplemousses, mardi dernier.
Plusieurs personnes auraient entendu en pleine
salle de consultation des
soins d’urgence, des cris
provenant d’un médecin
se plaignant d’être agressé
par un autre médecin qui
était en service ce jour-là.
Selon une préposée du
personnel
hospitalier
qui était présente lors de
l’altercation, la victime avait
l’air d’être en état d’ivresse.
Il s’en prenait aux médecins et
aux membres du personnel.
Il ne cessait d’interrompre
le travail des autres. Cela
aurait déclenché la colère
d’un autre médecin qui
s’est empressé de lui dire
de cesser d’agir de la sorte.
C’est là que le médecin ivre
s’est mis à crier, et à faire
croire qu’il a été agressé.
Quant aux nombreux patients qui ont assisté à cette
scène, ils espéraient que cette
dispute s’arrête pour pouvoir
se faire examiner, expliquent
les membres du personnel.
La police a été mandée sur
place pour calmer les esprits.

Sunjiv Soyjaudah prend
de l’emploi comme directeur
Sunjiv Soyjaudah qui occupait le poste de directeur de
la Tertiary Education Commission (TEC), a démissionné moins d’un an après pour
prendre de l’emploi comme
directeur de l’Information
and Communication Technologies Authority (ICTA).
Il faut savoir que Sunjiv
Soyjaudah a souhaité que
sa démission prenne effet immédiatement, et qu’il
n’a pas besoin de don-
ner un mois de préavis.
On ne sait toutefois pas
quand Sunjiv Soyjaudah assumera son nouveau poste.
Celui-ci est vacant depuis
août de l’année dernière,
soit depuis que l’ancien directeur, Krishna Oolun, a
été suspendu de ses fonctions. Sa suspension fait
suite à la déposition du directeur financier de l’ICTA
au sujet de l’acquisition de
deux voitures de marque.

même été arrêté par
la police en octobre.
En ce qui concerne le remplacement de Sunjiv Soyjaudah à la TEC, le conseil
d’administration lancera un

autorisé rédigé par un ex-officier du bureau de l’Attorney
General, en l’occurrence Me
Mouammar Oozeer, tout
en sachant que le père de ce
dernier était membre du jury.
En se faisant, Me Teeluckdharry aurait tenté
d’influencer
les
jurés.
Pour rappel, Me Teeluckdharry avait réclamé une
révision judiciaire de la
décision
de
l’Attorney
General. La motion a été
rejetée le 6 mars 2013.
Les travaux du comité disciplinaire ont repris le 11
octobre 2013 devant un Full
Bench composé des juges
Ah Foon Chui Yew Cheong,
Abduraffeek Hamuth et
feu Shaheed Bhaukaurally.
Les avocats de Me Teeluckdharry ont à nouveau présenté
une motion pour que les
travaux du comité disciplinaire soient abandonnés.
Dans un jugement interlocutoire rendu le 8 avril 2014,
les juges avaient rejeté la motion de Me Teeluckdharry.
Ils avaient ordonné que
l’affaire soit mentionnée à
nouveau devant le Master and
Registrar de la Cour suprême
le 6 mai 2014 pour être fixée.

Free Paradise avec sa boutique hors taxes avait la réputation d’être la plus chère
de la région, la compagnie
travaille sur un plan pour
concurrencer les autres
boutiques de l’océan Indien et celles de Dubayy.
Dans un premier temps, une
baisse des prix de 10% à 15%
a été appliquée sur les liqueurs, parfums et chocolats.
Rakesh Rughoobeer, Chief
Executive Officer (CEO) de
la MDFP a déclaré qu’il y aura
d’autres baisses. L’objectif
fixé serait en bonne voie.
Le CEO assure aussi que
MDFP est en discussion avec
ses fournisseurs pour qu’ils
revoient les prix de plusieurs
produits, qui seront répercutés dans ses boutiques.
Outre la baisse des prix,

Salman Khan hit-and-run case: Maharashtra govt to appeal
against actor’s acquittal
The Maharashtra government on Wednesday told
the Bombay High Court
that it has decided to move
a plea against the acquittal of actor Salman Khan
in connection with the
2002 hit-and-run case.
Government pleader Abhinandan Vagyani informed
Justices A S Oka and G S
Patel that the government
will move a Special Leave
Petition to file the appeal
against the actor’s acquittal
from the five-year sentence.
The court had on Monday asked the government
whether it planned to take
action against erring police officers for dereliction
of duty. And if it does, what
would be the nature of action.
The government, however,
Wednesday said the order of the HC single judge
will be under challenge.
While acquitting the actor, Justice A R Joshi had
on December 10 based his
decision on various “loopholes” he found in the police’s investigation besides
the delay in collection of
blood samples from the
spot. There were two points
raised by the judges after going through the 305 pages
of Justice Joshi’s judgment.
Firstly, they wanted to know
if there were specific guidelines followed by the investigating agencies while collecting blood samples and other
evidence from crime scene.
“Is there any set protocol
on immediate collection of
blood samples,” Justices Oka
enquired with Vagyani. The
government lawyer Wednesday informed that the “golden period” is five to six hours
within which the alcohol
content in the driver’s blood
remains intact and traceable.
However, there are no rules
that provide for a time frame
within which the blood samples are to be tested. The
court said specific rules will
have to be framed when it
comes to collection of blood
samples and its preservation.
The court was hearing
of a public interest litigation filed in 2002 by
journalist Nikhil Wagle.
He had then sought imposition of harsher legal provisions against Khan. On December 10, Salman was given
a clean chit in the case with
the court observing that the
main witness was ‘wholly unreliable’ and that there were
discrepancies in the case.
The HC observed that
“strong suspicion of guilt
cannot be used to hold a
person guilty” in its verdict
earlier this month. Overturning the order of a lower
court, which had in May
convicted the actor under
charges of culpable homicide
not amounting to murder
and sentenced him to a jail
term of five years, Justice A
R Joshi said this was “not
a case where prosecution
has successfully established
its case of all its charges”.
In May, Sessions Judge D
W Deshpande had found
Khan guilty under all eight
charges, including Section
304-II (culpable homicide
not amounting to murder)
of the Indian Penal Code
and Sections 337 and 338
(rash and negligent driving).
The case dates back to 13
years ago when the actor is accused of driving a car under
the influence of alcohol and
killing one and injuring four
others in Bandra, Mumbai.

Chester’s Wish half-reared and was slow out. Navistar jumped awkwardly and shifted out,
crowding Liam onto Anafesto. Anafesto was then eased and taken across to race behind runners. Liam raced wide without cover in the early stages. Approaching the 1100 metres Strum,
which was over-racing, became awkward and had to be eased when close to the heels of Navistar. Rum Tum Tugger, which was following, was also inconvenienced and had to be eased.
Approaching the 250 metres Argun and Rum Tum Tugger came together. Approaching the
100 metres, when being ridden with the whip, Argun shifted out, slightly inconveniencing
Apple Pie, which was shifting in under pressure. When questioned with regard to the poor
performance of Liam, jockey Mansour explained that this gelding had pleased in the lead up
to the race. He added that he expected a good run from it and wanted to race close to the leader,
however after being crowded for room by Navistar, which had jumped outwards, he found
himself racing further out of his ground than expected. He added that leaving the 1300 metres
he found himself racing wide without cover and restrained his mount to secure a position one
off the fence. He added that from then onwards Liam did not feel comfortable, changing legs
on several occasions. He added that leaving the 300 metres, when asked for an effort, Liam
quickened over some distance before staying one pace from the 200 metres onward, being
disappointing. A subsequent veterinary examination of Liam revealed no abnormality.

Prior to the start being effected, Tembot became fractious and charged the front of the gates,
getting caught under the gates. It was removed and examined by the Club’s Veterinary Surgeon
and declared unfit to race. The Stewards thus ordered its withdrawal at 1.05 p.m. In view of
this withdrawal, all bets on Tembot were ordered to be refunded and winning bets with bookmakers were paid less 10 cents per rupee, the average price of Tembot being 8/1 at the time
of withdrawal. Trainer C. Ramdin was told that Tembot will have to perform satisfactorily
in a barrier trial before being allowed to race again. Approaching the 100 metres Triad Of
Fortune commenced to shift out. Blue Berry, which was following, had to be taken in to
continue going forward. Jockey Callow (Triad Of Fortune) was shown the video replays of
the home straight, reprimanded and told to stop riding with his whip and straighten his mounts
when they shift ground. When questioned with regard to the improved performance of Esteco,
trainer J. M. Henry explained that this gelding was having its second start for him. He said that
at its first outing Esteco had pleased in the lead up to its race and a good run was expected from
the latter, however, after being urged forward to secure a position close to the pace, Esteco
had faded in the latter stages, being disappointing. He stated that following this, he decided to
fit the gelding with a tongue tie but for today’s race, due to its wide draw, he instructed jockey
Hall to endeavour to drop this gelding out and wait for the 300 metres for his best effort. Mr.
Henry added that, in his opinion, Esteco might have needed its last start and the fact that it
raced settled at the back contributed to its improved performance.
Following the running of the race, the Stewards viewed the video replays of the start and took evidence from
jockey Ghunowa. It was established that prior to the start being effected, Gris Cheval became fractious in
its gate and reared on a couple of occasions, getting its near fore leg entangled at the top of the gate. Gris
Cheval was then attended to by the handler and straightened in its gate. When the start was effected, jockey
Ghunowa had only his left foot in the stirrup and was not ready, hence Gris Cheval took the start without its
rider. The Stewards, acting under MTC Rule 144 (1), declared Gris Cheval a non starter. In view of this, all
bets on Gris Cheval were ordered to be refunded and winning bets with bookmakers were paid less 30 cents
per rupee, the average price of Gris Cheval being 2/1. Leo’s Rush threw its head and was slow out, losing
considerable ground. Brandewyn refused to jump. The Stewards, being of the opinion that when the start
was effected Brandewyn was in a position to jump with the rest of the field but refused to do so, decided to
declare it a runner. Due to the unsatisfactory performance of Brandewyn in the stall, the Stewards advised
Mr. Ramapatee Gujadhur that this gelding will have to pass a couple of barrier trials to the satisfaction of the
Stewards before being allowed to race again. From its wide draw Fort Noble was taken across to race behind
runners. Leaving the 1365 metres Young Royal was taken out to improve on the outside of the riderless horse.
Leaving the 1300 metres, the riderless horse shifted out, carrying Young Royal wider on the track. Young
Royal was then eased to take a position behind the riderless horse passing the 1100 metres. Apprentice Roy
(Young Royal) dropped his whip near the 1000 metres. From approaching the 500 metres Leo’s Rush was
taken out from behind Bataan and, in doing so, carried Fort Noble wider on the track with the latter racing
wide from then onwards. From approaching the 450 metres Young Royal was taken out to improve around the
riderless horse, with the latter commencing to shift out and carrying Young Royal wider on the track. Leaving
the 400 metres Young Royal was eased and taken back to the inside of the riderless horse to continue going
forward with the latter shifting back inwards and carrying Young Royal onto Please To Progress with Young
Royal contacting Please To Progress near the 250 metres. From leaving the 200 metres the riderless horse
commenced to shift in, carrying Please To Progress, which was improving on its inside, inwards onto In The
Frame, with the latter having to be steadied and switched outwards to avoid the heels of Please To Progress.

Kaafel jumped awkwardly and was slow out. Tigre Libre jumped awkwardly, shifted out and
from its wide draw was taken across to race behind runners. Shortly after the start, when being
urged forward, Monarchs Emblem shifted out, crowding Yoda Man onto Roman Express.
Approaching the 600 metres Barnstable became awkward when close to the heels of Power
Dive and was taken out to avoid its heels and, in doing so, carried It’s My Party wider on
the track with the latter racing wide from then onwards. Leaving the 250 metres Power Dive
ducked out sharply despite jockey Naiko’s attempt to straighten it. Roman Express, which
was following, became inconvenienced and had to be switched to the inside of Power Dive to
continue going forward.

Maestro’s Salute, which was restless in its gate, fly-jumped when the start was effected. Allenby Park and Bobby Bear were slow to begin. From its wide draw, Kalinago raced wide
without cover in the early and middle stages and leaving the 1000 metres was taken in to secure
e the position
e behind eMaestro’s Salute. Azapel was taken across to race behind runners in the
early stages. From leaving the 1300 metres Maestro’s Salute commenced to over-race and
threw its head when being settled. Kalinago raced wide from leaving the 400 metres. Leaving
the 200 metres Azapel hung in under pressure and became awkward close to the heels of Zhan
Hu, which was giving ground. Azapel was then taken out from behind Zhan Hu to continue
going forward. Approaching the 450 metres Donnie Brasco shifted in, momentarily crowding
Allenby Park on its inside.
