After Coté, Grant, Suberu and Sinclair, what is the law on searching, questioning and arresting in compliance with the Charter of Rights and Freedoms? Has anything changed and, if so, how can criminal practitioners in motions court best advance their position? What constitutes a search incident to arrest? What is investigative detention? When should an accused person speak to the police? And how should the Crown and the defence question witnesses called on a Charter motion? All of these questions and more will be answered in a full day program dealing exclusively with sections 7, 8 and 9 of the Charter of Rights and Freedoms. The program will offer a mix of panels featuring some of the most experienced and knowledgeable members of the Canadian criminal justice system, and live demonstrations by both Crown and defence counsel.
