GPA/131 21 septembre 2015 (15-4866) Page: 1/18 Comité des marchés publics Original: anglais ACCESSION DE LA RÉPUBLIQUE DE MOLDOVA À L'ACCORD SUR LES MARCHÉS PUBLICS Décision du Comité du 16 septembre 2015 Le Comité des marchés publics, Eu égard à l'article XXIV:2 de l'Accord sur les marchés publics, fait à Marrakech le 15 avril 1994 (l'"Accord de 1994"), et à l'article XXII:2 de l'Accord sur les marchés publics de 1994, amendé par le Protocole portant amendement de l'Accord sur les marchés publics, fait à Genève le 30 mars 2012 (l'"Accord amendé")1, Eu égard à la décision du Comité des marchés publics sur l'adoption du texte du Protocole portant amendement de l'Accord sur les marchés publics, prise le 30 mars 2012 (appendice 1 du document GPA/113 du 2 avril 2012), et en particulier à ses paragraphes 3 et 4, Eu égard à l'entrée en vigueur du Protocole portant amendement de l'Accord sur les marchés publics le 6 avril 2014, conformément au paragraphe 3 dudit protocole, et à l'acceptation ultérieure du Protocole portant amendement de l'Accord sur les marchés publics par trois Parties additionnelles, Notant aussi que deux autres Parties à l'Accord sur les marchés publics doivent encore accepter le Protocole portant amendement de l'Accord sur les marchés publics, et Considérant la demande d'accession à l'Accord sur les marchés publics présentée par Moldova, figurant dans le document GPA/63 du 8 janvier 2002, et les consultations tenues avec les Parties à l'Accord sur les marchés publics ainsi que les documents additionnels présentés à la suite de celles-ci, Décide ce qui suit: 1. Conformément aux dispositions de l'article XXIV:2 de l'Accord de 1994 et de l'article XXII:2 de l'Accord amendé, Moldova pourra accéder à l'Accord sur les marchés publics selon les modalités énoncées dans la présente décision, y compris les pièces jointes. 2. L'Accord sur les marchés publics entrera en vigueur pour Moldova le trentième jour suivant la date de son accession, c'est-à-dire la date à laquelle le Directeur général aura reçu l'instrument d'accession reproduisant les modalités énoncées dans la présente décision, y compris la pièce jointe A. 3. Conformément au paragraphe 4 de la décision du Comité des marchés publics sur l'adoption du texte du Protocole portant amendement de l'Accord sur les marchés publics, prise le 30 mars 2012 (appendice 1 du document GPA/113 du 2 avril 2012), Moldova sera lié par ledit protocole à compter de la date à laquelle l'Accord sur les marchés publics entrera en vigueur pour lui. 1 publics". L'Accord de 1994 et l'Accord amendé pris ensemble sont dénommés ci-après l'"Accord sur les marchés GPA/131 -24. À compter de la date à laquelle l'Accord sur les marchés publics entrera en vigueur pour lui, Moldova accordera à toutes les Parties à l'Accord sur les marchés publics l'accès aux marchés couverts au titre de l'appendice I figurant dans la pièce jointe A de la présente décision. 5. À compter de la date d'entrée en vigueur de l'Accord sur les marchés publics pour Moldova, les annexes de l'appendice I concernant l'Union européenne s'appliqueront sous réserve des modalités énoncées dans la pièce jointe B de la présente décision. 6. Jusqu'à ce que le Protocole portant amendement de l'Accord sur les marchés publics entre en vigueur pour toutes les Parties à l'Accord de 1994, entre Moldova et une Partie au seul Accord de 1994, l'Appendice I de l'Accord de 1994 concernant cette Partie s'appliquera. 7. Moldova présentera son instrument d'accession dans les six mois suivant la date de la présente décision, sauf si le délai prévu pour la présentation de l'instrument est prorogé par le Comité. 8. À compter de la date d'entrée en vigueur de l'Accord sur les marchés publics pour Moldova, les modalités annexées à son instrument d'accession feront partie intégrante de l'Accord sur les marchés publics en tant qu'appendices concernant Moldova. GPA/131 - 16 APPENDIX I MOLDOVA ANNEX 7 Page 1/1 ANNEX 7 GENERAL NOTES The following General Notes apply without exception to this Agreement, including to Annexes 1 through 6: 1. This Agreement shall not apply to procurement of agricultural products made in furtherance of agricultural support programmes and human feeding programmes. 2. The provisions of Article XVIII shall not apply to the suppliers and service providers of Israel in contesting that award of contracts by Moldova entities whose value is less than the threshold applied for the same category of contracts awarded by this Party. 3. Moldova will not extend the benefit of this Agreement to the award of contracts by entities listed in Annex 3 in respect of urban and railway transport to the suppliers and service providers of Israel until such time as Moldova has accepted that the Party concerned gives comparable and effective access for Moldova undertakings to the relevant markets.
