Le droit humanitaire et les règles relatives à la protection des droits
fondamentaux de l’homme présentent des similarités d’objet mais ne
doivent pas être confondus tant leurs champs d’application respectifs
sont, à l’origine, différents ;
les juges internationaux ont étendu le champ d’application des droits de la
personne humaine de manière telle que ceux-ci semblent désormais
s’appliquer aux zones en conflit et en temps de guerre. Cette position
a généralement été approuvée par la doctrine ;
en cas de conflit entre les droits de l’homme et le droit humanitaire,
le mécanisme de résolution des conflits de normes qui a traditionnellement
été privilégié est le principe de la lex specialis derogat generali.
A l’analyse, nous remarquons toutefois que la CIJ semble plutôt
interpréter les droits de l’homme conformément au droit humanitaire en
faisant application du principe d’interprétation dit « d’intégration
systémique ». Il en a résulté une « humanitarisation » des droits de
l’homme ; et
inversement, les juges pénaux internationaux interprètent le droit
humanitaire à la lumière des droits de l’homme. Il en a résulté une
humanisation du droit humanitaire.
