Oh You have no idea how Je ne peux pas dire, mais je suis 16 17 tellement content d'etre ici parmi vous pour cette 18 occasion speciale. What does this mark? 19 It marks a great 20 step forward for you. 21 arduous, law schools set high standards, and rightly 22 so. 23 deal of hard work is required. 24 requirements are not easy to meet. 25 LOB courses are long and The Bar Admission Course is demanding, a great The Law Society By your dedication and diligence you ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 9 1 have persevered, you have overcome all difficulties. 2 You have stayed the course. Today you become lawyers. 3 This is no 4 mean feat and your efforts, your accomplishments 5 deserve this well-merited recognition. 6 indeed! Well done I would like as well to extend my very 7 8 best wishes to members of the family, partners, 9 friends of all these lawyers. I know it is extremely difficult to 10 11 live with law students. 12 best of times, they are down-right intolerable at 13 exam time and it is a trait that is difficult to 14 shake. 15 "Don't despair, it gets worse with lawyers." 16 fuss and fume about files and briefs and clients. 17 Their times make it extremely difficult to live with 18 them. 19 --(Laughter/rires) 20 They are difficult at the To those families and partners, may I say, They I can tell you that there is only one 21 thing perhaps worse, that is judges. I think all the 22 profession is united in dislike of judges, and 23 probably rightly so, but you will be glad to know 24 that judges are just as miserable as lawyers when 25 they are getting their reasons ready. So it is sort ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 10 1 of a continuous chronic disease. 2 but you do learn to live with it. 3 --(Laughter/rires) What has all this training and 4 5 It does not improve education meant for you? 6 First and foremost, you have learned 7 to approach all problems, whether of individuals or 8 groups or society, in a reasoned manner seeking 9 always to achieve fairness in your decisions. You 10 know now that violence cannot succeed. 11 right and rather sweet reason and a fair approach 12 must prevail. 13 Might is not In order to achieve a lasting 14 resolution to any problem, you have to learn to 15 follow that preceptive wisdom spoken by the prophet 16 Isaah that has come echoing down the ages: 17 let us reason together." Ideas are not easy. 5 6 There are all sorts of examples of that. Poor old Socrates, who manifested some 7 8 criticism of the way in which the gods were 9 worshipped, he was forced to take the hemlock cup. 10 Those that have specialized in company law know that 11 that was the predecessor of the poison pill. 12 results were just a little worse. 13 concept that the earth was not the centre of the 14 universe, was something that was devastating for 15 human ego and the teaching of the church. Galileo and his These ideas were unpopular. 16 The So too 17 was that of Darwin in the origin of the species. 18 Yet, these ideas have a life of their own and cannot 19 be ignored. 20 our society. 21 They mark changes, and often progress in Thus the importance of the principle. 22 Yet, should there be some limits on it? 23 What of hate literature? In our 24 wonderful multicultural society, should identifiable 25 groups be held up to hatred, ridicule and contempt? It is this sort of difficult We must be free of hate Perhaps the Third Reich will forever Many of our f orbearers came to this 10 11 country in order to express freely their concept of 12 religion, that no matter how sincerely held, can 13 freedom of religion justify mutilation of female 14 children or the refusal to accept life-saving medical 15 treatment? 16 in that situation? 17 What is the balance that should be struck There is the concept of individual 18 dignity that is the foundation of any democracy, 19 particularly ours. 20 of every race, colour and religion. 21 essential element of our judicial system and our 22 Canadian democracy. 23 The dignity of every human being, This must be an So soon is that principle is 24 recognized of the individual's essential dignity, we 25 must recognize the dignity that must be accorded to ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 13 1 all minorities. 2 racism. How superficial and how evil is If you imagine for a minute that you 3 4 could not see and you were waiting for assistance to 5 cross the road would it make one wit of difference if 6 the hand that was to help you was black, yellow or 7 brown? Of course not. 8 If you were hard of hearing and there 9 was a welcoming gesture, would it matter one wit the 10 colour, race or religion of that person? 11 not. Of course The clothing, religion, the colour of 12 13 the individual has nothing to do with the innate 14 dignity that attaches to everyone in Canadian 15 society. That recognition is in your hands to 16 17 be treasured, to be fostered until it grows and 18 glows. 19 You with your training are individuals 20 who can and will make a difference in our society to 21 make improvements to your community and to this 22 wonderful country of ours. 23 You have learned that although 24 difficult problems exist they can be resolved with 25 good will and reason. People 3 always turn to those trained in the law, whether the 4 advice they seek is strictly legal or social. 5 with your ability and your learning of basis of 6 solutions will provide answers. You You are now lawyers as of today. 7 It 8 has been, for centuries, fashionable to make jokes 9 with regard to our profession that are often cruel, 10 misleading and totally inappropriate. Nevertheless, 11 it is up to all of us to demonstrate why these jokes, 12 or most of them, are so false. You will be members of a profession. 13 14 As members of the profession you have dedicated your 15 skill and knowledge to the service of others. All professions are important in the 16 17 course of the history of humanity various professions 18 assume importance. As cities grew it was important to 19 20 have those that could build the walls, build the 21 buildings, construct the roads and sewers, all that 22 was necessary. 23 with medical knowledge and skill were required. 24 The more complex the society the 25 As plague struck those cities, people greater the need for people with legal training to ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 15 l lead people through the complexities of our 2 complicated society. What then are the attributes of a good 3 4 lawyer? Our profession is an old and 5 6 honourable one. 7 its status? I think through these attributes. First, integrity. 8 9 How has it succeeded and maintained Absolute integrity that you can demonstrate from the very beginning and 10 giving what is often unpopular advice to a client. ll Integrity in dealing with the court. 12 compliment can you have in knowing that your word is 13 accepted as your bond. What greater A lawyer is courageous with the 14 15 courage to assess a situation and, if necessary, to 16 give unpopular advice and with the courage to take an 17 unpopular client, an unpopular cause before the 18 courts to ensure that justice is achieved. 19 easy. 20 It is not There are two great counsels of years 21 gone by that can be examples for all of us; Thomas 22 Erskine in England, at the time of the French 23 Revolution, when all English society was worried 24 about stability, he undertook the defence of a 25 printer who had printed really a very clever but a ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 16 1 very devastating cartoon and comment with regard to 2 George III. 3 the Tory party, the King and any hopes in the 4 foreseeable future of appointment or advisement 5 politically or judicially. 6 in that unpopular case and it is worth reading and 7 looking at that case for reinspiration in difficult 8 times. He did live through that, became the 8 9 10 second President of the United States, followed by Jefferson. Then he saw his son assume that office. What courage it took to take those 11 12 Bricks were thrown through unpopular cases. 13 A lawyer needs diligence, industrious 14 in the pursuit of knowledge, preparation of cases. 15 That work goes on forever. Lawyers are the soul of discretion. 16 17 They are the safe repository of more secrets than 18 CSIS ever dreamed of, yet they are never disclosed. There is not a family without secrets, 19 20 there is not a company without secrets, there is not 21 an organization without secrets that must be 22 disclosed to obtain advice, yet lawyers preserve 23 those secrets. 24 25 A lawyer has the legal skills to analyse complex facts, to present them simply, apply ATCHISON & DENMAN COURT REPORTING SERVICES LTD. 155 University Avenue, Suite 302 Toronto, Ontario CANADA M5H 3B7 (416) 865-9339 (800) 250-9059 www.stenographers.com 18 1 the principles of the law to them. 2 demanding role, but so important.
