Il a été convenu et arrêté ce qui suit (It was agreed and decided as follows):
Article 1
 Le modèle déclare être majeur et poser pour des photos artistiques, suivant le style qu’il
souhaite. (The model claims to be an adult and ask for artistic photos, following the style he wants.)
 Le modèle déclare être mineur sous la tutelle d’un parent (Nommé ci-avant), l’accompagnant
à la séance et poser pour des photos artistiques, suivant le style qu’il souhaite. (The model
claims to be a minor under the supervision of a parent (Nominated above), accompanying him to the meeting and
ask for artistic photos, following the style he wants.)
Article 2
Chaque séance donne lieu à la remise des photos au format numérique haute définition, comprenant
une sélection des meilleures images, choisies conjointement, permettant le tirage ultérieur de
nouvelles photos par le modèle.
(Each session results in the delivery of pictures to digital high definition, including a selection of the best images, selected
jointly, allowing the subsequent draw new pictures by the model.)
Article 3
Le photographe est, de par la loi, le propriétaire inaliénable de toutes photos prises par lui-même et
le modèle ne peut revendiquer aucune propriété ou droit d'auteur.

ownership or copyright.)
Le modèle est, de par la loi, le propriétaire inaliénable de son image et le photographe se doit de
respecter ce droit d'image.

En conséquence, le photographe et le modèle devront se consulter mutuellement en cas de besoin
d'exploitation des photos dans un cadre autre que celui défini par le présent accord. Cela inclut,
entre autres, la publication dans les magazines, la vente de droits d'exploitation, l'utilisation des
photos à des fins publicitaires.
(As a result, the photographer and the model will consult each other in case of need Operating photos in a context other

Le photographe et le modèle (sauf accord convenue entre eux) ne devront diffuser seulement les
photos finales, retouchées par le photographe. Toutes photos brutes ne peut avoir lieux d’affichage
ou de retouche par un autre photographe que l’auteur lui-même (sauf accord de celui-ci).

Article 4
Le photographe et le modèle s'autorisent mutuellement l'usage à des fins promotionnelles, et à titre
gracieux, des photos réalisées par le photographe et mettant en scène le modèle pour les utilisations
suivantes (The photographer and the model allow another use for promotional purposes, and cost, of photographs by the
photographer and featuring the model for the following uses) :
• expositions et concours, y compris le droit de reproduction par les organisateurs pour assurer la
promotion de leur manifestation, en particulier : presse locale, nationale spécialisée Photo et Beaux
Arts, (exhibitions and competitions, including the right of reproduction by the organizers for the promotion of their event,
in particular: local press, specialized National Photo and Fine Arts)
• diffusions sur sites et galeries web perso du photographe et du modèle, forums de discussion
photographique sur Internet, (broadcasts sites and personal web galleries photographer and model, photography
discussion forums on the Internet)
• cartes de visite, composites papiers et books personnels du photographe et du modèle, (business
cards, personal papers and composite books of the photographer and the model)
• publication d'un éventuel ouvrage présentant l'œuvre du photographe ou du modèle. (publication of
a possible book presenting the work of the photographer or model.)
• utilisations libres de droits pour le modèle pour toutes actions de démarchages auprès d'agences
(ou structures assimilées) ou pour tous concours, dans la presse traditionnelle ou sur internet, à la
seule condition que le nom du photographe apparaisse clairement en marge de la photo. (free uses for
the model rights for all shares of canvassing from agencies (or similar structures) or to any support, in the traditional media
or on the internet, only that the photographer's name appears clearly on the margins of the picture.)
Article 5
Le photographe s'engage, s'il vend des photos à des fins d'exploitation (à des photothèques
nationales ou internationales, magazines, revues, ouvrages, agences de pub, cartes postales, édition
d'affichages ou autres... ) à prévenir le modèle et lui devra une commission de 10 % sur les ventes de
chaque image, taxes, frais et charges déduits.
(The photographer agrees, if he sells pictures for operational purposes (to national or international photo libraries,
magazines, journals, books, advertising agencies, postcards, displays editing or others ...) to model and will prevent him 10%
commission on the sales of each image, taxes, fees and charges deducted.)
Article 6
Les éventuels commentaires, titres ou légendes accompagnant la reproduction ou la représentation
de la ou de ces photographies ne devront pas porter atteinte à la réputation ou à la vie privée du
modèle.
(Comments may, titles or captions accompanying the reproduction or representation of these photographs or should not
prejudice the reputation or privacy of the model.)
